London High court judgment is null and void , submit Dr Chiluba’s lawyers

1003_zambia_02.jpgLawyers representing former president, Frederick Chiluba  have argued that the registration of the London High Court judgment in the Lusaka High Court was done outside the provisions of the law.

Lawyers John Sangwa and Robert Simeza were submitting before Judge Japhet Banda today when the matter came up for hearing of the four applications made by Dr. Chiluba, Faustine Kabwe, Aaron Chungu and Stella Chibanda, to set aside the Lnodon High Court judgment.

The other application was on the notice of an intention to raise preliminery issues
on whether part II of the foreign judgment reciprocal enforcement Act of the London
High Court handed down on the respondents on May 4, 2007 was done properly.

Dr Chiluba’s lawyers  argued that there were some conditions that were to be
satisified before a judgment of the foreign court judgment is registered in Zambia.

“What this means is that a person desiring to register a foreign judgment must
ensure that the judgment passes certain threshold,” Mr. Simeza said.

And Mr. Sangwa submitted that the registration of the London High Court judgment in
the Zanbian courts was nullity, adding that part II of the said Act had not been
extended to the judgment of a foreign country.

He said the power to extend part II of the Act to register foreign judgments was
vested in the President, adding that of relevance to the preliminary issues was
section 31 of the same Act, which provides the procedures for the extension of the
foreign judgment.

He said the President must be satisfied that if he gave recognition of his country,
the foreign country must also recognise the judgments made by the Zambian courts.

Mr. Sangwa also said a President of a particular country must issue a statutory
instrument or an order for the extension of the foreign judgment.

“The precondition is that the President must be satisfied that the court in a
foreign country will accord similar recognition of the judgment in the Zambian
court. There has to be reciprocity in the benefits,” he said.

He submitted that in the event that those preconditions were not met, such judgment
could not be registered and even enforced in Zambia.

He pointed out that since the 1930s, no government or president in Zambia has ever
issued an order extending part II of the Act to the United Kingdom or to the London
High Court of Justice.

“From 1964 to date, we stand to be corrected by the learned Attorney General, none
of the Presidents in Zambia has ever issued a statutory order extending part II of
the Act to the UK. If there is, no judgment from UK can be recognised in this
country, that is the law,” he said.

Mr. Sangwa said if there was any order issues, then the Attorney General, Mumba
Malila should state who issued it and when it was issued.

On this Mr. Malila said the lawyers for the defendants had ambushed him because
certain issues they argued about were not clearly stated in their affidavits.

He therefore applied for an adjournment for him to ascertain the facts of the
arguments.

“Having been misled by the affidavit which was filed as to which facts defendants
will rely upon, it is only fair my Lord that we be given an opportunity to ascertain
the fact so that the court has a well informed fact before a ruling is made on the
preliminery issue made,” he pleaded.

But Mr. Sangwa said he was taken aback by the application for an adjounrment to
ascertain the facts, saying it was basic and fundamental to consider the issue of
whether there was an order on the registration of a foreign judgment into the
Zambian court before Mr. Malila could do so.

However, the Judge Banda adjourned the matter to Friday, July 13th, 2007 to allow
Mr. Malila ascertain the fact on the issues.

Meanwhile, scores of Dr. Chiluba’s supporters and sympathisers gathered outside the
court premises singing solidarity songs.

I told you that Bwana Smith has no jurisdiction over crimes committed in Zambia. You see what Sangwa and Simenza have done is what Malila should have done in the first place. STUDY THE LAWS OF ZAMBIA. Before rushing to UK. I think he should be fired. How can the entire AG claim to be ambushed? Did he think Sangwa is as inept as he is? What Malila has done is tantamount to sabotage. He has messed up the civil case and he has contaminated the criminal case. Commenting or running a another case which may impede on the outcome of a criminal case is Sub judice. Even me I’m not a lawyer i understand that. Malila is supposed to be our top GRZ lawyer. Unfortunately he doesn’t understand the law. Therefore he must be fired forthwith. For bring our justice system into disrepute.

I said Chiluba should involve the IMF/World Bank fo they are ones who deliberately give Zambia loans never said anything to misuse. What Sangwa I said holds no water the trial continues on 13th July 2007. As I have said the court will be not linient when passing judgement on Chiluba for wasting time and taxspayers money. SAGE#4 dont rush to conclude such case have been in past been extended to the Somolon Islands. More this has the blessing of the president for he signed for removal of immunity of FTJ. Why should a small group of pipo continue give us problems? These laywers the drug the case because its source of income. You will see in case PLM should he face same charges they will rush to defend him thank God he himself is a lawyer. The only element of this case is it has been alined with racism and imperialism.

  9. #10 Easy mwaice there are so many issues at play, at no point have ever supported what FTJ did but I condemn the process he went through to get this case settled.If it was done out of all odds, our legal system must have been involved from a-z in much the similar way they participated in reducing the orchestrated 169 cases to 23 and eventually to 2 so whay decide and chart another route to dispose of the case?Zamtrop records were available and Smith used those records there was no added value other than speedy conclusion.But some uncomfortable parallels between the two were drawn during the offshore judgement left so much to be desired

Is not milking a dying cow. FTJ remember you said he has suffered you would him settle down and rest. Any case adjournment of a case doesnt mean the case is lost. Zambians are waiting for justices unless these few individuals have a backing of outsiders.

But what you are saying is that you do not support any corrupt deeds he may have done but you disagree with the process employed by LPM’s government. I can understand your point of view. The only problem I have is that Chiluba seems to have done everything in his power to avoid the courts. What is your take on this?

  15. #16 Firstly the biggest issue was to isolate the presidency from normal civil service,hence the removal of his immunity, secondly the Office of the President is under Oath and this is where Zamtroop comes in.LPM used these ‘OATH’ issues to nail his predecessor and to me this was quite un fortunate because this will have continuous spiral effects on the office of the president.In short the Presidency has been killed by Chuchu totally.Even him where he is he using his over excess powers to do what best suits him, he has even forgetten the existence of the word collaborative management.

  16. Welcome back Kuku, twalisakamana sana. Nomba, Ba Joze balubila kwi? The case is now becoming interesting. The biggest blunder chuchu made was to rush to the UK courts, leaving the soverignity and independence of our justice and legal systems in Zambia. Chuchu should then call Smith to come and help speed up the many pending cases for those guys in Chimbokaila because we do not have enough judges to do the pending cases. Why only FJT’s case? That is why some people have called this as political persecution of FJT. I do not support the way the funds were mishandled by FJT and his cloonies, but the way we have handled this case. Let us wait for Friday and see what the outcome will be. Ba Joze come out if you are still living!

  17. This is the argument that we have always put forward, that reciprocity is easier said than done. This goes to reinforce the fact that, it took the AG a while after Smith’s judgements to come up with some definitive statement, & when he did, not much of it was very convincing, well, the battle has just began between fact & fiction or should we say dreams! It is unfortunate for the AG, in that he was nowhere near the current office he occupies when this whole farce was put in motion – am not making any conclusions yet, I just hope the AG, LPM & the Law fraternity don’t make a fool of our judicial system and Zambia as a whole!!

For the AG to claim to be ambushed on facts as above which bloggers like bauze knew about is certainly a cause for concern. Anyway, people grab your seats, sit tight , the real show has just began. I see adjournments all the way to 2011 and the big losers in all this will be tax payers and the winners the lawyers. So much for a lawyer president.

If a Briton had committed any crime outsde Britain,the british gave will ask that country to sent their citizen to answer their charges. All what the British govt do is to get as much information as they can to make judgemen justy and fair. When you look at this case we are still asking ouselves whether this case and the outcome is fairly carried out.Today is $27milliom the following day is $47million.     For reader, accident with apparent illegal alien crystallized city’s changes
    July 9, 2007
    In our first Gut Check America vote, thousands of readers around the country rated illegal immigration as the issue of most concern for them. Among them was Gary Rutledge, a Tulsa, Okla., college professor who wrote about being involved in a traffic accident with an apparent illegal immigrant. Here is our report on what we found when we traveled to Tulsa to follow up on his story:
    TULSA, Okla. – “Our sovereignty is under direct attack,” warns a commanding voice emanating from a pool of light in the corner of an otherwise dark airplane hangar. Dan Howard, an airplane salesman by day, is in the middle of his weekly two-hour radio show titled Outraged Patriots, a nighttime broadcast devoted entirely to the topic of illegal immigration. Howard, who charges that the U.S. government is failing in its duty to protect the country from a “silent invasion” by illegal immigrants, taps into a deep vein of anger and unease in this conservative south central city, where many longtime residents feel besieged by a recent wave of mostly Hispanic newcomers.That rising tide of resentment is palpable in the city’s Latino community.At Plaza Santa Cecilia, a mall filled with Latino shops in East Tulsa, business is down as much as 40 percent, vendors say. “It’s very quiet,” said Edith, a 17-year-old shopkeeper who didn’t want to give her last name. “Everyone is staying home because of this immigration stuff.”
    The tensions of Tulsa mirror those in many other U.S. cities that have experienced sharp increases in Hispanic immigration in recent years. But other factors are at work here as well.
    City on the leading edge
    Tulsa is on the leading edge of local and state efforts to crack down on illegal immigration following passage by the Oklahoma Legislature of what is arguably the toughest anti-illegal immigration measure in the nation. The Tulsa City Council also embraced the get-tough approach by adopting a resolution calling on police officers to check the immigration status of “all suspected illegal aliens.”Those actions have sparked a fierce political battle, spread fear among Hispanics — both legal residents and those in the country illegally — and triggered an angry public face-off between demonstrators on either side of the great divide.Among the longtime residents shaken by the changes engulfing his city is Gary Rutledge, an MSNBC.com reader who said the demographic shift took his family and friends by surprise.“It’s happened so quickly and our neighborhoods have changed so rapidly,” said Rutledge, a political science professor at nearby Rogers State University. In East Tulsa, just across the main thoroughfare from his comfortable brick home, the broad avenues are now peppered with signs in Spanish and malls catering to Latino shoppers — offering everything from soccer wear and piñatas to check cashing services and Latin pop music. “That whole part of the city has become a miniature Juarez or Tijuana or whatever you want to call it,” said Rutledge.
    Like many longtime residents, Rutledge is quick to say that he is not opposed to immigration by legal means. But he says he objects to being unwillingly taken over by another culture as the result of unchecked illegal immigration.“I’m very concerned that this last wave (of immigrants) has no interest in becoming Americanized,” he said.
    Fallout from federal inaction
    It was Rutledge’s story of a car crash involving an apparent illegal immigrant that led MSNBC.com to Tulsa. But when we arrived we encountered a bigger pileup: the chaotic fallout of a federal framework that neither prevents illegal immigrants from entering the U.S. to work nor provides a way for them to gain legal status.That Catch -22 has forced local jurisdictions like Tulsa to seek their own solutions to the explosive and complex issue.“Increasingly, because there’s no consistent federal law, states and cities are cobbling together immigration laws on their own,” says Sheryl Lovelady, assistant to Tulsa Mayor Kathy Taylor. In Tulsa, Lovelady said, such laws “have caused a lot of confusion, inconsistency and fear, mainly in the Hispanic community.”Tulsa, a city built on oil some 500 miles from the Mexican border, has a population of just over 380,000, including about 40,000 Latino or Hispanic residents, according to 2005 Census estimates. The pace of Hispanic immigration has been quickening, and local newspapers and politicians believe the number is now closer to 50,000.For Rutledge, a car accident personalized the issue. He and his wife were waiting in their pickup at a traffic light one evening when they were hit from behind by a vehicle traveling about 30 miles an hour. They were not badly hurt, only stunned. More shocking, though, was what they heard from the police officer who responded to the accident: The other driver, a young Hispanic man, did not speak English, did not have a driver’s license or insurance. The officer suspected the man was an illegal immigrant, Rutledge said, but he did not check his immigration status because such inquiries weren’t allowed in misdemeanor cases. Before taking the other driver to jail, Rutledge said, the officer told him he should just go home and forget about it.
    ‘There’s not much to be done’
    “He said, ‘We do a lot of this kind of thing and we can tell you that there’s not much to be done about it,’” Rutledge recalled.It’s not clear what happened to the suspect after that. Tulsa police were not able to locate an accident report on the incident.But officers said that the maximum penalty the man could have faced for driving without a license, a misdemeanor, would be 30 days in jail. Driving without insurance is only a ticketable offense.Rutledge said he was floored by the experience. Not only would his own insurance company have to absorb the cost for repairing his truck, but the other driver was soon going to be back on the streets.“It was … a feeling of helplessness,” he said. “There’s no recourse, there’s nothing to do.”Rutledge began comparing notes with friends and family and found that many had a similar story with a similar outcome. That got him thinking about the bigger picture. “I think that when someone comes in this country illegally, it starts a tradition or culture,” he said. “You come in illegally; everything you do from that point on is illegal. And so it’s almost impossible to get a driver’s license or insurance so you just start breaking one law after another. I think it’s seductive. I think after a while … you don’t pay too much attention to rule of law that this country was established on.”
    Making way for newcomers
    While Rutledge’s eye-opening experience occurred behind the wheel, the immigration surge has had an even more striking impact on the Tulsa school system. With many of the immigrant workers in their child-bearing years, the population of Hispanic kids in the school is growing 3 percent a year and will constitute 25 percent of the student body by 2020, the district projects.The city started its first programs to teach non-English speakers just five years ago, and now has 6,000 students in remedial English language classes, said Nilda Reyes, director of equity and diversity for Tulsa schools.The sole mission of Newcomer International School, which opened in 2004, is to help its students — about 250 at any given time — become proficient in English so they can make a transition to mainstream classes. The school district also is making plans to expand remedial English teaching in higher grades, and is offering Spanish courses to teachers and looking to hire additional bilingual staff.As in other communities, Tulsa’s medical system has taken a hit, too. Hospitals have scrambled to find enough interpreters to handle the crush of non-English speakers descending on emergency rooms, bringing in children and housekeepers in some cases, said Tulsa World immigration reporter Leigh Bell.One program run by Catholic Charities offers prenatal care to women without medical insurance or access to Medicare — about 500 at any given time — the vast majority of them illegal immigrants from Mexico, said Tim Sullivan, executive director of the nonprofit agency. The early care helps avert later medical problems that put even more pressure on emergency rooms and other medical facilities.While these pressures are not unique to Tulsa, the response to them is.
    Tough new rules target illegals
    Local and state governments here have crafted rules to curb illegal immigration that are arguably the toughest in the nation. In May, Oklahoma Gov. Brad Henry signed into law HB 1804, also known as the Oklahoma Taxpayer and Citizen Protection Act of 2007. The law, which is scheduled to take effect on Nov. 1, makes it a felony to “knowingly transport, move conceal, shelter or harbor” an illegal immigrant.The law, which proclaims that “the State of Oklahoma finds that illegal immigration is causing economic hardship and lawlessness in this state,” requires companies that do contract work for the state to conduct stringent background checks to avoid hiring illegal immigrants. Other companies would open themselves to discrimination suits if they hired illegal workers over legal residents. It also includes tough language requiring government agencies to ensure they are not providing services such as food stamps to those illegally in the country, though those services are already theoretically denied under federal law.It is unclear how 1804 will be enforced — whether, for instance, nonprofit groups or individuals assisting illegal aliens could be sanctioned for “sheltering or harboring” them.In the end, the bill might not pack much punch, according to David Blatt, policy director for Tulsa’s Community Action Project, who said many of the provisions restate existing federal statutes or may be pre-empted by federal law.”I liken it to a fiercely growling dog — one that is sending out a purposeful message that illegal immigrants are not welcome in Oklahoma,” said Blatt. “… I think the bill will have minimal bite, but that is not to minimize the impact loud growling has on people.” Meantime, activists in the Hispanic community say they plan to mount a legal challenge to 1804 and the American Civil Liberties Union of Oklahoma also is studying the bill to see if it passes constitutional muster.
    Whose job is it?
    In Tulsa, the battle has focused on the degree to which local law enforcement should be involved in checking immigration status, normally the province of federal immigration agents.With the strong backing of conservative U.S. Rep. John Sullivan, a Republican who represents the congressional district that includes Tulsa, the Sheriff’s Department in surrounding Tulsa County is seeking training that would essentially deputize its officers to enforce immigration law. Under section 287 (g) of federal immigration law, the Department of Homeland Security can enter into compacts with state and local law enforcement agencies to create a “force multiplier” for the federal Immigration and Customs Enforcement (ICE) service, especially where federal resources are thin in the interior of the country.Sullivan, among the Republicans strongly opposed to President Bush’s immigration reform bill as too lenient, also was behind the city’s move to crack down on illegal immigrants. At his urging, Tulsa’s City Council passed a resolution in May that requires police officers to determine immigration status of “all suspected illegal aliens” encountered in the course of their regular duties — a significant hardening of the current policy under which only those arrested on felony charges are checked. The police chief is opposed to the measure, as is Tulsa’s Democratic Mayor Kathy Taylor, who is engaged in a bitter political battle with Sullivan.Sullivan charges that Tulsa has become a “sanctuary city” for illegal immigrants under Taylor’s watch because they are usually not reported to the federal immigration officials when they commit minor crimes.He also argues that by getting police involved in reporting immigration violations, the city will be able to demonstrate the need for an ICE office in Tulsa.
    Bill’s aim: Create fear in criminals, not roofers
    “I want to create fear in rapists, drunk drivers, drug dealers and people who conceal weapons,” Sullivan told MSNBC.com. “It doesn’t mean getting the framer down from a roof where he’s working and arresting him.” Taylor argues that the congressman’s approach will cause panic among Hispanics and open the door for racial profiling. She also maintains that public safety will suffer if the people in the community don’t report crimes because they are fearful of immigration consequences. Among those who share her concern is Mark Wollmershauser, a Tulsa police officer who has been on the beat for 30 years.He said he could easily envision a scenario in which the teen daughter of an illegal immigrant is raped, but the family is afraid to report it, leaving the perpetrator on the street.“They will not call us,” said Wollmershauser. “It will drive a stake through the community in terms of crime prevention.”Taylor has refused to sign the council’s resolution and instead issued a “policy clarification” stating that police need only ask about immigration status for felony cases or misdemeanors that result in a trip to jail.
    Emergency mode
    Though it remains to be seen how these laws will be enforced if they survive expected court challenges, they already have stirred visible anxiety in Tulsa’s Hispanic community.If the laws are enforced, “It will take us back to front-counterism, vigilantism and just overloading our (legal) system,” predicted Sebastian Lantos, a legal immigrant from Argentina who is spokesman for the Coalition of Hispanic Organizations. Marcela Frescott, program coordinator of Hispanic services at Catholic Charities in Tulsa, said families with both legal and illegal immigrants are worried about getting split up, referring to parents who are in the U.S. illegally but have children who were born here and therefore are legal citizens.“We had one person who … has four children born here in the U.S., and now they’re afraid to register the kids in school come August because they’re afraid that at that time they might (be) arrested” and deported, she said. Howard, the radio show host who also founded an anti-illegal immigration group called Outraged Patriots, is not swayed by such pleas.“These parents… have ultimate responsibility for their kids,” he said. “I have empathy for them … but I cannot give a waiver on the U.S. Constitution to make way for people who cause their own problem” by coming illegally. He advocates an immediate moratorium on immigration, a clamp down on the border and tough rules that hold employers responsible for checking immigration status.And he wants Washington to send a message to others contemplating sneaking across the border: “I want to see the administration send … a huge corps to deport tens if not hundreds of thousands of illegal aliens.”If something is not done, he said darkly, “A lot of people believe there is civil war on the horizon.”For the moment, Howard is celebrating the defeat of the federal immigration reform bill, which he opposed for offering a legal path to millions of people who entered the U.S. illegally. But he views its defeat in the Senate as merely a temporary success.“You have got to stay vocal,” Howard told his listeners on a recent Monday night broadcast before going to a commercial break. “This issue is not over.”
    Damage control
    Hispanic leaders in Tulsa agree. They called an emergency meeting in June to work on ways of countering what they see as rising anti-immigrant sentiment and measures that they see as institutionalizing racism. Among them is an information campaign to inform Hispanics of their rights if they are pulled over. Get a judgement by a Zambian Judge, and then ask Smith to register the case in UK. I dont think UK would have registered a judgement from the Zambian judge. but there is precedence with the ICJ regarding Mobutu and Abacha’s cases.     BEIJING – China on Tuesday executed the former head of its food and drug watchdog who had become a symbol of the country’s wide-ranging problems on product safety.
    Zheng Xiaoyu’s execution was confirmed by state television and the official Xinhua News Agency.
    “The few corrupt officials of the (State Food and Drug Administration) are the shame of the whole system and their scandals have revealed some very serious problems,” SFDA spokeswoman Yan Jiangyang said at a news conference held to highlight efforts to improve China’s track record on food and drug safety.
    “We should seriously reflect and learn lessons from these cases. We should step up our efforts to ensure food and drug safety, which is what we are doing now and what we will do in the future,” Yan said about Zheng and a separate case involving Cao Wenzhuang, the administration’s former pharmaceutical registration department director.
    Zheng was sentenced to death in May for taking bribes to approve an antibiotic blamed for at least 10 deaths and other substandard medicines. Cao was given a death sentence last month with a two-year reprieve for accepting bribes and dereliction of duty.
    Such suspended death sentences usually are commuted to life in prison if the convict is deemed to have reformed.
    Zheng’s death sentence was unusually heavy even for China, believed to carry out more court-ordered executions than all other nations combined, and likely indicates the leadership’s determination to confront the country’s dire product safety record.
    Yan said the food and drug administration was working to tighten its safety procedures and create a more transparent operating environment. But the administration acknowledged that its supervision of food and drug safety is unsatisfactory and that it has been slow to tackle the problem, but vowed to improve.
    “As a developing country, China’s current food and drug safety situation is not very satisfactory because supervision of food and drug safety started late. Its foundation is weak so the supervision of food and drug safety is not easy,” it said in a statement at the start of the news conference.
    China has been under pressure domestically and internationally to improve its quality controls after a series of health scares attributed to substandard Chinese products, including exported tainted food and fake drugs.
    Chinese officials already have said the country faces social unrest and a further tarnished image abroad unless it improves the quality and safety of its food and medicine.
    The industry regulator, the State Food and Drug Administration, has announced a series of measures to tighten safety controls and closed factories where illegal chemicals or other problems were found.

Two weeks after the government ordered price cuts in response to the country’s rampant inflation, the economy is coming to a standstill.
    More than 30 company executives have been arrested for hoarding goods and flouting the price cuts, and several have been fined up to $6,600, court officials said Monday. Among those rounded up were executives of a leading clothing retailer, two directors of Zimbabwe’s main food distributor and fast-food chain, and the chief executive of the largest producer of pork products.
    The sudden drop in prices had led to panic buying, stampedes and near-riots, leaving shelves bare of staple foods. Witnesses said many shops and suppliers were cleaned out by convoys of ruling party supporters who came in after police and inspectors enforcing the price cuts.
    Factories, stores and gas stations have been unable to replace goods sold at below cost.
    Gas stations have run dry, putting an end to the long lines of cars. On Monday, the government ordered private commuter buses to cut fares by three-fourths, promising bus owners they would be able to buy subsidized fuel from the state oil procurement agency.
    But many ignored the directive and simply abandoned their routes. Businesses reported higher numbers of workers failing to arrive at their jobs.
    “We are incurring huge losses. We can’t go on like this for much longer,” said one industrialist. “We’ll have to lay off quite a number of our people very soon,” he said. “We’ve shot ourselves in the foot this time.”
    He asked not to be identified for fear of retaliation. President Robert Mugabe warned Friday that the government would target uncooperative managers and seize factories that scaled down their operations. His government accuses business leaders of being part of a campaign to bring him down.
    More than 1,300 businesses have been charged and fined over the past two weeks, police said.
    Economist John Robertson warned shortages would worsen.
    “The crunch can’t be far off,” he said. “Retailers who can’t recover the money they spent on their goods are not going to carry them anymore, and manufacturers who are not allowed to charge more than their production costs are going to stop making them.”
    By the end of next week, as gas stations go out of business, “we won’t have much mobility anywhere and we will have run out of options,” he added.
    Last week, the government announced it was reviving the long-defunct State Trading Corp. to run businesses that had collapsed or were seized. The corporation itself collapsed in the 1980s through mismanagement.
    Police spokesman Oliver Mandipaka said the crackdown was “not a gimmick and will be sustained at all costs to stop consumers being ripped off,” state radio said.
    He appealed to rural villagers and farmers “to complement government efforts by reducing prices of cattle so butcheries can operate viably,” radio said.
    Beef, a favorite in the diet of Zimbabweans, disappeared from shops more than a week ago.
    Cattle herds already have shrunk drastically since the seizures of thousands of white-owned farms disrupted Zimbabwe’s agriculture-based economy in 2000.
    Cattle are a status symbol in rural communities and often are used as a dowry. It was unlikely villagers who have resettled on former white-owned land would heed Mandipaka’s appeal.
    Live goats were being sold in Harare, but goat meat has not appeared in slaughterhouses or supermarkets. Women snapped up cabbages at one open air market.
    “It’s something to put on the table anyway,” said one woman who only gave her name as Olivia. She said two large cabbages could be made to last about a week.
    Official inflation is running at 4,500 percent — the highest in the world — though independent financial institutions estimate real inflation is closer to 9,000 percent.
    The government has admitted to printing extra money — seen as a main cause of inflation and an obstacle to South Africa’s reported offer to shore up Zimbabwe’s collapsing dollar by pegging it to the South African currency.
    As the crisis worsens, Zimbabweans may resort to looting, Robertson said.
    “I think the government will finally unleash the impatience and the anger of our normally agreeable and passive population,” he said

  66. I Think the lesson to learn from the FTJ LPM fiasco is that our justice system is in shambles. I know Half backed Malila was in a harry to please his appointing officers by coming up with London civil case.What is suprising is that FTJ’s case has been going on for more than 5 years. Even if HBM (AG)started reading the Zambian law from page 1 he could have finished by now. Folks a case of such magnitude which will raise sovereignty issues should have been well reaserched. HBM should have turned the law books upside down just to make sure there was a legal precedence in what he was doing. How can the AG claim to be ambushed? I still maintain HBM must go. I think the call for adjournment was designed to twist the judges arm. But this is an issue of legality and if Sangwa is right, we still have another 5 years before the issue is settled. Ms Daka friday 13th. Lets revisit the issue.

  72. Ba Jose #83, Is it likely that once Maila thinks through he will argue that the registration process is NOT for the interest of the accused. And that what matter (to him) is whether the high court registered the judgement and it bears the seal of the high court of zambia.
    My view is that Sangwa and his friends have a point but they are actually questioning the integrity of the high court which accepted to register without proper procedure.The onus was on them to reject Mailas request…in which case he could have come back with the necessary papers.
    Lets wait and see…..

The law of Zambia clearly stipulates that for a foreign judgement to be registered in the high court of Zambia there has to be a mutual agreement between Zambia and the adjudicating court country of jurisdiction. Such an agreement should be enfoced in both countries. Which means Margaratt Thatcher can be sued in Zambia and if found guity the case can be registered in UK for enforcement. That my friends is a pipe dream. We all know our judicial system has been brough into disrepute by such acts. Malila should be fired regardless of the judgement. He is inept to the core. One would think his job is to understand the law of Zambia.
