Court yet to determine PF injunction application

Patriotic Front-PF- Leader, Michael Sata’s scheduled filing of Presidential nomination papers before Chief Justice, Enerst Sakala, suffered a set back, Tuesday morning.

The High Court is yet to determine an injunction application filed against Mr. Sata by his Kasama Member of Parliament, Saviour Chishimba.

Until this is done, Mr. Sata can not proceed to file his nomination papers.

Lusaka High Court Judge, Philip Musonda, was scheduled to deliver the ruling at 08:30 hours but is still locked in an inter-party hearing with lawyers representing Dr. Chishimba and Mr. Sata.

Mr. Sata was scheduled to file his nomination papers for the October 30 presidential election at 09:00 hours.

Dr. Chishimba is seeking an injunction to restrain Mr. Sata from filing his nomination papers arguing that he has been disadvantaged as an interested person in the PF presidential candidature.

He claims Mr. sata contravened the PF constitution provision which stipulates the holding of a convention to elect the PF presidential candidate.

And Mr. Sata’s lawyers, Bonaventure Mutale and Edgar Lungu, have filed a preliminary application to challenge Dr. Chishimba’s injunction application which they claim does not disclose the reason for the court action against their client.

The Lawyers also argue that the injunction application has not disclosed the capacity in which Mr. Sata has been sued.

They where due to have the convetion but short notice elections came up i personally hink they should have made it a democratic process to pick Sata even if it meant just for shows since he was always going to be the candidate until the day he will say Napelako umwaiche or when he is evacuted to SA(France) Pf cadres will only vote for a person that there god Sata will annoint hence he should picked someone and ruled indirectly at the moment he is not going to win come rain or shine

    Lesson number 1. Try to respect those that are your fellow leaders.

  21. Charity begins at home but SATA has no home from where charity should begin. Let him put his DEMOCRATIC tendencies to test in PF and then subject himself to the DEMOCRATIC forces at national level. Dr. Chishimba is absolutely right!! Its his democratic right also to aspire to contest on the PF ticket.

  25. This should not be encouraged in Zambia where people like Chishimba files injunction on the nomination date. This injunction is a display of immorality of the highest order. You don’t need to be a Judge to rule against Chishimba with cost.
    While this may serve as a lesson to less democratic leaders like Sata, it is detrimental to peace of Zambia as Sata comands a lot of following. Doing this on nomination day, is directly inciting violence and bleach of peace by aggrieve supporters who may see this as persecution.
    This is really a sign of Rupiah Banda’s low belt tactics, and the list is growing.
    Banning of live in Phone in programs, Sugar Daddy promotions, Tribalism, populism.

  33. This is an under-hand method by MMD and Chishimba as their surrogate to undermine the democratic process – ensuring that Sata does not file nomination. If the courts rule in favour of Chishimba, then all contestants for the Presidency will not qualify as non of them were elected at their respective party conventions. This was an unplanned election and the conventional wisdom would be for parties to field incumbent party presidents or vice presidents (in the absence of party president). The MMD did not have a vice president and therefore subjected the party to an undemocratic but ‘transparent’ process.

  70. U pipo sata didn’t stop any1 frm contesting. A meeting was held by the PF Central Committee and Central Committee on August 30, 2008 and SATA was appointed as the PF Presidential Candidate. SATA is not even an inch close to a dictator. Yes he doesn’t entertain laziness and wants all of us to work for our bread and butter. But that doesn’t make him a dictator. He is such a good man, a charismatic leader. We have heard enough of theories but now we need ACTION.

  71. I have had look at both the MMD and PF constiution, and the republican. Points to ponder
    1. There is no legal requirement for any political party to hold a convention, different parties can choose different frequencies. The PF consitution does not say PF should hold a convention, hence the court rthrowing out Chishimba’s injunction.

    2. MMD consitution says a presendt must be elected at a convention heald every five years, RB is not the president of the party but the sponsored candidate, so no anolaies there.

    3. The republican consitution does not require a candidate to be the president of the party but should be sponsored by the party, so both Sata and RB are withing the confines of

  73. Dr. Chishimba is right. PF has never held a convention to elect people to its party hierarchy. People were appointed in an interim capacity way back in 2001. Sata, therefore has no basis for contesting the presidency on the PF ticket without consulting the rest of the membership, who we now know also aspire to stir the party to new heights.PF should demonstrate democracy within their own party ranks before trying to convince the rest of the country that that is what they stand for.

    Time for kaponyary politics is over.

    The issue is this, Dr. Chishimba as a member of PF believes he has the right to challenge SATA for the PARTY normination as stipulated in PF constitution.

    Separate other parties from this issue because though it is in court, it is non the less an internal PARTY (PF) issue.

    It would be a good precedence for DEMOCRACY if the right judgement is reached. There is no harm at all to Democracy in this case.

    All they want is the commedy that SATA provides with his team.
    “Tom & Jerry” is their style of governance.
    They love to fight and quarrel, each one not knowing what the other’s next move will be.
