Church condemns calls for compulsory testing for HIV/AIDS

THE Church has condemned calls by Health Minister, Kapembwa Simbao to introduce compulsory testing for HIV/AIDS saying the move is an infringement on the rights of the citizens.

Council of Churches in Zambia (CCZ) general secretary, Suzanne Matale and International Fellowship of Christian Churches (IFCC) president, Simon Chihana said in separate interviews that introducing mandatory tests would be against people’s rights.

Reverend Matale said that as much as there was need for concerted efforts in the fight against HIV/AIDS, people should be at liberty to either test or not to.

She said that the Government, Church and civil society organisations should join hands in fighting the AIDS scourge and not to introduce mandatory tests.

“It is much profitable and workable for people to go when they are emotionally prepared. People must be counselled before going so that their minds are prepared. They should not be policed,” Rev Matale said.

She said what was needed was an aggressive sensitisation campaign on the need to go for voluntary testing.

Bishop Chihana said it would not be appropriate to introduce mandatory testing as issues to do with health were personal.

He said that what the Government could do was to encourage as many people as possible to undergo voluntary counselling and testing (VCT) as opposed to mandatory testing.

He said that before somebody could undergo a test, such an individual should be mentally prepared.
Bishop Chihana said that it was up to an individual to decide whether to go for a test or not and the Government should not infringe on the rights of citizens by introducing mandatory tests for HIV.

“Mandatory testing will be an infringement on people’s rights because everybody is a private citizen and therefore has the right to health status which he can decide to keep as confidential.

“What the Government should do is to sensitise people on the dangers of AIDS and it should be up to people to decide just like I cannot say you should stop drinking beer but I can only preach about the consequences of drinking,” Bishop Chihana said.

He expressed hope that the Government would think twice and allow citizens to voluntarily undergo the tests.

    As a country within the global village, we need to look at both the pros and cons of such a policy and also see which other countries within the village have implemented this policy.

  6. the church has always been opposive to certain aspects of science,ask galileo and he will attest to that.this idea of the minister is ok,just that the media is potraying a picture like pipo will be forced from the streets to go and test fo hiv.no one will be forced to do that.however,in certain cases such as in hospital setting or in cases where innocent minors are defiled or when one wants to be employed in such fields like catering etc,testing shud be done without undue opposition.currently there is no law to force sexual offenders esp defillers to undergo hiv tests,this is definitely bad.

The bible doesn’t even say obey or listen to churches it says follow the heavenly father and him only. In our time and age, it is not necessary for people to die needlessly because help in the form of ARVs and counselling on diet and way of life is available. For issues that are of such importance as HIV/AIDS, it is expected that contributors will do so soberly and with the best interest of our mother Zambia and for our brothers and sisters. Please have compassion on others. Most of us have had close relatives dying from AIDS and it is an emotionally draining experience which a normal can not turn into a joke.

  14. Mandatory testing is indeed an infringement on people’s rights. It would feel like animals who have no choice when humans subject them to a lot of things. This would be interesting, suppose somebody still refuses to undergo the testing despite it being mandatory, are they going to be expelled to another country or jailed? The police I suppose would be there to ensure everyone complied or else!!! Oh perhaps the order is coming from
    Donors or what? I concur with the church. Better everyone goes for mandatory counseling, thereafter it is up to them to decide whether to take the test or not. Apofye God does not force people to worship Him – He has given us the freedom of choice. Who is man?

  19. The idea may be both positive and negative. So individuals should weigh the costs/benefits of such a decision. At the right time one can decide to take the test.

    I would propose that it is applied on the basis of circumstances. For defilers, let them be tested,or for the sake of PMTCT. But this should not be done for selfish interest, for e.g those accessing the data base to start targeting negative individuals for sexual entertainment. This should not be a tool for promiscuity because pipo can now start a higher level of affairs like it was before AIDS.

  22. I really don’t know on this issue. Didn’t cuba test most of it’s nation when SIDA hit? Sp far as I know they have negigable AIDS rate because once they know your status you are quarantined. Can someone in Cuba confirm for me? Castro had the right idea. He knew that sex is a natural thing that you can’t force people to abstain from. Better then to control the spread into society. After all, when someone has TB or Leprosy or even Ebola, they are quarantined. Its not because that person is an animal, but sometimes we have to think of the greater good of society. Zambia has lost to many shining lights to this bad disease!!

  23. Compulsory testing is indeed a very expensive venture. Our govt. needs to set its priorities first. So what if they find out their status?is it ready to increase the number of people on ARV treatment? what about the health facilities?are they ready to undertake this screening exercise if they cant even treat a common flu or headache.However,it has one advantage,i.e we can vote into govt. people who are redy to serve zambians & not just to cushion their health bills & consequently finance an expensive state funeral.

  24. The second time beacuse of my now husband. I told him, no test, no love babes…….he got the picture, but after a lot of talking. I don’t know what the problem is for men going to be tested. But a person can’t trust too easily, that’s how people die. I can assure you, if he decided to play around, we go for another test. I have kids to think of and I don’t intend for them to watch their mother die in such a bad way. Lets all get tested mewbantu, it’s the only way to ensure you know what the story is.
    I only wish so many of my now departed relatives had gone for testing, instead of blaming “witchcraft” or some other nonsense.
    But at 14-15%, we are not too bad in Zed. I am in hope!!

    The only opposition to this is should from HIV+ve people who are afraid to divulge their status. We need to know who is sick and some of you continue to spread the virus because of your social or financial status.

    Maybe those in the church who are against this are also HIV +ve, take the test, show it to the world and then condemn compulsory testing. Don’t hide behind this blog

I lost a very close relative to this thing and I still feel bad because that person could have gone on ARVs if they had just gotten the test!! Number 54, my main fear all along is those people who suspect they are sick but do nothing to confirm their status. As far as I am concerned it should be criminal to knowingly spread this disease when you know you are HIV+ve. I don’t know how someone can do such a thing, but they are there. I am actually related to VJ, although distant. That man is not healthy! And it really pains me to see him running after young girls who should know better!   32. #59.Unza Mojo, this is the thing, even if we know people’s status, our govt has no capacity to support such a large-scale project. Yes, there is sure a possibility of abuse by some ngos, but a good health policy would go some ways to mitigate that. As for stigma, it is my belief that things are changing. Last time I was home, I found most people are quite open about being on ARVs. It was very encouraging. I really believe the more people are open, the more society will accept. Right now, there is still a fear of dying badly with noone to take care of you that is holding people back. Instead of getting these dodgy loans for “development”, givt needs to pump money into health.

Whilst knowing one’s status is very important and vital( BTW #14 you are wrong, every sexual offender is tested for the virus and if they are positive then their victim is also tested, this is non-negotiable) what is paramount is the action after the testing. Is Simbao today telling us that those who test + will be on a robust ARV programme for the rest of their lives? What about the nutrition that is needed to go with the taking of ARVs? Is he willing to make food affordable despite the recent trends of mealie meal? What about the loss of income that is coming with the loss of jobs?   42. Gelogelo, in as much as i would like to agree with you, i feel that compulsory testing is simply a costly exercise,sighting its feasibility as a solution to the disease. Instead:
    1. ministry of education should review its curicular & include courses dealing with morals and health living (social science)
    2.ministry of health should work hand in hand with traditional leaders to promote healthy cultures and values. I believe african tradition has a lot to offer in terms of morals.
    3. the judiciary together with the leguislature should review sentences against hiv related offenses.
    4. Community should be ready to change its mindset on the disease.

Cancer is one other condition that has claimed alot of lives. the reasons for this move are not straight. health is a responsility of an individual. HIV is just like any other stabborn illness.     I am for compulsory testing. Like No.65 said where are the human rights for those people that get infected with HIV through someone who knows (or someone who suspects but is to scared to go for testing)???
    I have seen young people dying just because they did not go for testing. Had they known and taken the medicine they could still be alive. It’s all about knowing your status. I know people that are on ARV’s and doing well. Zambia is losing its young generation – think about this before you oppose compulsory testing! The US and other countries are pumping a lot of money into Zambia trying to help the people here. What do you think how long this will go on???

  58. I have been there 3 times and negative, no one forced me so why force people after all there is a way in which they can know even from a malaria test whether you re + or -. They already do it with expectant mothers and those with TB, Am not advocating for it but they already do they dont have to make it law as ministry of health they can do it without anyone knowing. If anything these days they dont even counsel you good example is New Start they got my blood before my consent and when I asked was told would be counseled in the next room which didnt happen. All those who citing human rights violation as a reason not to enfoce compulsory HIV testing shud rethink, many people unknowingly infect others because they have never heard of testing or no-one has challenged them to declare their status, if people who want to join certain institutions are compelled to undergo medical examinations including HIV, I for one would advocate compulsory testing, for all, this way we can at least know for sure how many of our people are infected, and drugs can be procured accordingly.

  65. Voluntary testing is there for some time now and what is the result?

    How many people who are positive have not gone for voluntary testing and are infecting others or dying because they are not taking ARV’s? Think about this. Of course even if it is mandatory it will be confidental! I know some very educated people that have not gone for testing – but rather died and left their families, especially the kids suffer!

    DESCRIPTION
    Triomune is a combination of 3 drugs commonly used in the management of Human Immunodeficiency Virus (HIV) infection. Both stavudine and lamivudine belong to the nucleoside analogue class of antiretroviral drugs. Both drugs act by terminating the growth of the DNA chain and inhibiting the reverse transcriptase of HIV. Nevirapine is a non-nucleoside reverse transcriptase inhibitor. It acts by directly inhibiting reverse transcriptase.
    Each tablet of Triomune contains half of the commonly prescribed daily doses of stavudine, lamivudine and nevirapine. All three drugs are to be administered twice daily, permitting a fixed-dose combination to be formulated.
