Woman faints in court after Dagga possession conviction

A 35 year old woman of new Mushili compound in Ndola, yesterday fainted in Serenje magistrate court when magistrate Philip Chisenga sentenced her to two years simple imprisonment for unlawful possession of psychotropic substance namely, dagga.

Before Mr. Chisenga were Loveness Nyama 44 of house number 1976 new Mushili compound who was charged with one count of unlawful possession of government trophy and Marjory Chibale also of Mushili compound who was charged with two counts.

Chibale was charged with unlawful possession of government trophy and in the second count was charged with unlawful possession of dagga.[quote]

The two were arrested on Monday this week by Zambia wildlife authority (ZAWA) officers at Kanona check point along great North Road in Serenje when they were traveling from Mpika to Ndola on Checha bus registration number ABC 7292.

According to the facts ready by ZAWA prosecutor Henry Munalula, Nyama and Chibale were found with seven pieces of buffalo meat each in their traveler’s bags.

Chibale, who tried holding back her tears throughout the session, had also 3.4kg of dagga wrapped in a transparent plastic bag in the second count which she told the court she was to use it to treat her hair.

In mitigation, Nyama pleaded for leniency because she had eight children including two orphans and that all of them were school going and if she was jailed nobody would take care of them.

He fined both K900,000 in default six months simple imprisonment in the first count of unlawful possession of government trophy.

Mr. Chisenga sentenced Chibale to two years imprisonment for being found in possession of psycho tropical substance.

Just upon pronouncement of the sentence, Chibale fell on to the chair that was behind and shouted “My Jesus” and openly wept before Mr. Chisenga.

Chibale, who later gained strength, was picked by Nyama and a DEC officer who helped her walk up to the police inquiries.

  1. Am back haven’t posted in a while. Anyway back to the topic, this is where I find our justice system so anti-poor people. The poor get arrested and convicted all in one week. It takes real criminals like Regina almost 7 years to get a conviction and on top of that they have bail for life. Maybe FTJ’s case should have gone to this court in Serenje. They are fast for sure, could help us save some state cash

  2. She has 8 children to feed, no husband, jobs are scarce and kuli global recession. Courts should be a bit more lenient. Giver her a suspended sentence.

  3. She had 5 on it ! yeah # 1, i concur with you on the fact that the law is quick and effective on the less privildeged citizens while real criminal are still on bail and still living large. what a shame !

  4. that is so unfair!!!!!!! the real culprits are out there walkin majestically whilst the poor woman with all those kids to feed gets jailed…i wonder if there is any justice in the world!!!!!!!!!! she should have been fined or better yet given community service so that she learns from her mistake and be able to take care of the kids…shame really….

  5. #1,true.poor woman to spend 2yrs in prison fo 2kgs of ganja.few yrs ago a some of us was found growing tons and tons of weed under green-house and was equally given 2yrs and is now a free man in the streets of lsk.these magitrates shud be using their wisdom to charge pipo accordingly.
    plunderers walk away with 4yrs after found guilty involving billions of kwacha,while poor citizens like this woman with ganja worth 100pin is harshly punished!…animal farm pa zed kaleza!

  6. All poor man’s cases are easily dealt with pa Zed. I have seen many people jailed over land issues while our national plunderers of our resources continuel to enjoy. I sugest that some of you blogers should change your professions to law, this would change our zed. Am always amazed with your contributions here, hope its not all about talk talk but also action.

    Seriously the govt is not fare the plunderers who are suposed to be getting life sentences are just roming around. Bane chalo chabonse.

  8. Dealing in stuff like that you would expect she would strong of heart. Couldn’t help notice how swift the the whole case was. Whats happening to kapoko i thought his offence was bigger?

Injustice at its highest level.These so-called drugs are now classified as less dangerous in developed countries and possesion of small amounts only warrants a caution.Repeated offenders or mass commercial dealers get stiffer punishment.The poor have no proper legal representation and thus fill up our jails for minor crimes whilst the rich and affluent continue to flaunt their wealth and influence with impunity.What happens to those 8 kids…More crime and prostitution as their bread winner in gone.Common sense must prevail in our courts!

  10. I dont see why the long sentnce if the Daga not for selling but for personal use . This is not fair.
    She only had less than 5kg , but why the long sentence. This only shows that If you are poor , you pay a higher price for a crime.

  11. This is what happens when the judiciary is corrupt. Obviously this lady had nothing to put in a brown envelop, she ends up mu jele and Kapoko with plenty to fill a lot of these envelpes is still enjoying life

I think there is a bit of a difference in that in Regina’s case the State has had to dig for more evidence whereas for the woman in this article the evidence was just balls of ibange/icibbalu nenama yampanga. I think that was enough because she did not even plead not guilty for the State to build on the case further by gathering more evidence to incriminate her. #24 another of the wrong translations happened at a funeral where a friend,s uncle was the translator. It was the usual “May his soul rest in peace” which he translated as “bushe, umubili wakwe ulale mucibote?”. I guess he was thinking of the “may I leave the room” request which we used to make to our teachers in primary school.

  18. What kind of Justice is there in Zambia? Regina, FJT,Rev Nyirongo, Dora Siliya and others it seems to me have a separate way that the Zambian Justice dispensation looks at them! What a Christian Country, Zambia we chalo chesu iyee. Iam not in support of the offences, nomba fye speedy trial na extent ya sentencing. Where are the women organisations?

    Never head of “Security of Data” in Zambia? Probably the constitution allows such publications.

  20. Jails are overcrowded. The woman is a first offender. There’s got to be an alternative to prison such as community service or a supervision order. Is there no provision for that in the Zambian judicial system?

  22. The only problem i have with all these cases and sentencing is that poor people are always being sent to prison while the likes of Chiluba and Regina are still enjoying their freedom. Where is equal justice for all? It seems Chiluba will never go to prison in this time.
