Courts contributing to congestion in prisons- Mwale

Northwestern Province Prisons Deputy Commanding Officer has observed that delays by some subordinate courts to dispose off cases is contributing to congestion in prison.

Robert Katawa Mwale made the observation in Solwezi during the official opening of the High Court session for Northwestern Province before Kitwe High Court based Judge, Raidah Kaoma.

Mr Mwale said most cases by subordinate courts in the area take as long as six months to three years causing congestion in prisons.
He told Justice Kaoma that cases involving juveniles were also taking too long and hence contributing to the increase in juvenile population in prisons.

The Deputy Prisons Commanding Officer further noted that confirmation of reformatory school orders for convicted juveniles were also delayed frustrating quick transfer to reformatory schools.

Mr Mwale informed the court that Solwezi State Prison has 332, Kabompo 117, Zambezi 106, Mwinilunga 97, Kasempa 79 and Mufumbwe 19 inmates respectively.

  2. Surely courts needs to do something in disposing off criminal cases expeditiously as justice delayed is justice denied. Its unbelievable that Chiluba’s case has taken 8 years to be concluded.

  3. Well, they just saved some space, one FTJ is smiling and daring Parliament to have his immunity restored, next he will be asking for the unreconciled and untraced 8m dollars still in the Zamtrop account to be given to him so he can share with RB, maybe this was the whole crux of the judgment.

  5. The problem is not the just the courts but the police as well. Uzakamba kusogolo has become the official policy. They do not take time to build a case but will arrest you first and start gathering the evidence. This is retrogressive and an infringement of people’s human rights. A trial should not last more than one month. But with the kind of jokes around here, it’s unbelievable. How can a case drag on for 7 years? 7 years!!!! How many cases will be tried then? Let us reform our legal system and put a stop to the nonsense of adjournments. An adjournment should not last more than one day. Lawyers should have a cap on the number of cases they take one or be penalised for asking for unnecessary adjournments. It’s sickening what is going on right now

  6. Well if the law itself allows that to happen, then it is the law to blame and not the courts. In some countries if the culprint is not prosecuted after a certain period of time he automatically becomes a free person. So maybe we should look at the laws. Peace!

  7. The other reson is because pipo dont know their constitutional rights, they just go with the flow. Thats why its good to know your rights and understand the law, if not you will rot in prison.
    Pipo need to be taught about their constutional right from an early age.

  9. Just give every inmate an AQUITTAL to join FTJ on the streets. This may create room for others like Teta, Mulongoti,RB and Thandiwe who is still getting the little Pre School Teachers’ Salary.lol
