The Lusaka high court has dismissed a petition to remove chief Justice Ernest Sakala and Supreme Court Judge Peter Chitengi from their offices.

High Court Judge Munalula Lisimba dismissed the petition by Lusaka lawyer John Sangwa after a two hour judgement on Thursday.

The Judge dismissed the petition on grounds that article 98 of the Zambian constitution does not provide for ratification of re-appointed judges.

He told the court that this is not with-standing that article 93 of the Zambian constitution requires judges appointed for the first time to be ratified by parliament.

Judge Lisimba said relying on article 98 of the constitution, a Supreme Court judge can be re-appointed under the president’s pleasure, without parliamentary ratification.

He further contended that Supreme Court judges cannot be subjected to the judicial service commission for scrutiny, before being re-appointed because they are members of the commission.

Judge Lisimba rejected the petitioners’ submission and contended that the petition was calculated to embarrass Justice Sakala and Judge Chitengi.

Recently Lusaka Lawyer John Sangwa petitioned Chief Justice Sakala and Judge Chitengi to vacate their offices.

Mr. Sangwa submitted that the two have attained retirement age and have not been ratified by parliament.

  11. The ruling sounded as if it has a legal basis up until the point where the judge accused Sangwa of being out to embarrass the two judges. On what basis does he make this assertion? We all know that beyond a certain age one once’s mental faculties begin to diminish. In the case of Zambia the law as set this age at 65 years. Sangwa did not write this law!

  29. I have to admit that I’m no lawyer and I don’t have full details of the judgement for me to form an informed analysis. Nevertheless, I believe that this judge erred in his judgement. It was expected anyway – what with all the political pressure from the appointing authority and the fact he had to rule on his own Supreme CJ, he had to do what he had to do.
    I did read the analysis by LAZ’s consultant in yesterday’s The Post by a lady called Eva Jhala (I suspect she is Indian descent by her name) – it was a very intelligent piece that even a layman like me could see facts in it. You have to give it Sangwa for standing up against all the bureaucracy. He has earned by respect despite he defends criminals. As for the CJ, he has lost people’s confidence in him and he should resign!

  32. What other outcome could we really have expected from this? This was an academic exercise and personally, even for people I do not like, I am not a big fun of cases that set a bad precedence. Case in point, was unhappy with Chiluba’s gift to ZAMBIA (Levy) but after he was sworn in, I was not for the idea of removing him using the courts. These are definitely political problems that need political resolution. It looks like the constitution is pretty unambiguous on these kinds of appointment and as much as I dislike RB’s direction, this only gives him ammo. Abash RB.   44. I think with all senses this judgment is very legal and professional. It should be noted that Sangwa and his minions accepted to have their cases by the same judges they are trying to embarrass until they lost their case. Should lawyers only seek that which favors them? This I believe defeats the very purpose upon which justice is sought. Anyway I am disgusted also by LAZ by being double tongued and now they find themselves in a very embarrassing position.

    If the law is silent on something, then the principles of justice remain that the verdict shall be passed in favor of a defendant period. The law does not expressly talk about ratification by parliament of reappointed judges and thats it.

  52. I read Lisimba’s full judgement and it makes sense, a lot of it! I hate to be on the same side as Kanitundila but this ruling, unlike Phllip Musonda’s masalamusi over Dora and Chinyama’s excrement over Chiluba seem to be backed by facts in law that all seem to be logical. I wonder where Sangwa’s two convicted criminals are going from here, Chimbokaila! As for Banda, we shall see how he will have Chiluba’s immunity reinstated.

  58. Well, I think all those who have delt with Justice Sakala will tell you that he has bollocks made of steal. In the Chiluba partenity case, he was the only judge who ruled that to meet the requirements of that constitutional requirement for all candidates there ought to be a paternity test in a case where paternity is contested like was the case with Chiluba and Kafupi. All the other judges tucked their tails clean over their dirty prats. I for one doubt Sakala would curl to anyone, worse still Kanitundila. It is Sangwa and his thieves afraid of this gallant judge registering our London verdict against Kafupi whence this embarrassing charade. To me, he should stay on the bench intil Chiluba is on the cross. Halleluiah!

Let us not forget that these judges are just human beings who have attained their status through training, studies and practical experience over the years and are not perfect in their judgements. Sometimes they may make mistakes but one may not question their actions other than thru an appeal. We dont live in a country where there is jungle laws. Survival of the Fittest.     #87 you are the best, it is amazing how biased the bulk of bloggers are. The only time they agree with any judgement is when it is against the state.While i may not agree with certain judgement, I do appreciate that there is always two sides to things and the role of the courts is to interpret. Trully and really I welcome Sangwa’s action on behalf oh hisconvict clients because it provides a chance to interpret the law. And if it is felt that the constitutiion if faulty in the topic at hand then we can talk of amending it. However my view is when someone is ratified by parliament my take is ant extension is administrative since he passed the first stage and this fits in well with the permanent nature of Judicial offices.
