Fr Bwalya pleads not guilty, Magistrate set March 31 as trial date

Executive Director for Change or Die Zambia, Father Frank Bwalya has pleaded not guilty to the charge of conduct likely to cause breach of peace and has since been granted bail.

Father Bwalya, 41, of 4843 Alma lick street, Riverside in Kitwe appeared today before Chief Principal Resident magistrate Mercy Makubelo.

The Priest who was clad in a red t-shirt and red bottom truck suite was represented by three defense councils, Richard Mandona, Leonard Kasuba and Terence Mwape Chabu while the state was represented by Martin Shula.

In granting bail Magistrate Mukubelo told the accused not to interfere with witnesses in the case and also told the defense to tell Fr Bwalya’s sympathisers to reduce noise during court proceedings.

She warned that the court may sign an order to re-arrest the accused if the supporters continued making noise at the court.

The court granted Fr Bwalya bail of K100, 000 on his own reconnaissance and with two working sureties.

The State earlier made no objection in Fr Bwalya being given bail but urged the court to caution him against interfering with witnesses and that he should not move out of Kitwe.

The State also feared that the accused may continue with his activities while on bail if the bail was granted without caution.

Facts of the offence are that Fr Bwalya on March 12, publicly conducted himself in a manner that was likely to cause breach of peace at city square in Kitwe contrary to section 1789 (f) of the penal code chapter 87 of the laws of Zambia.

But defense lawyers asked the court to squash the charge against Fr Bwalya urging that it lacked sufficient particulars of where the offence took place and was not specific with what manner constituted the conduct of a person likely to cause breach of peace.

The State however said the particulars were adequate and there was no need to amend the charge before the court.

Magistrate Makubelo said she agreed with the defense to have the charge amended and include at ‘city square’ as the particular place where the offence occurred.

Earlier the charge read that Fr Bwalya was charged with conduct likely to cause breach of peace in Kitwe on March 12 contrary to section 178 of the penal code chapter 87 of the laws of Zambia.

Magistrate Makubelo set March 31 as trial date.

Among the sympathizers’ who attended the court session were former Minister of defense George Mpombo, Roan Member of Parliament Chishimba Kambwili and his Nkana constituency counterparty Mwenya Musenge.

Fr Bwalya was arrested last Friday by police in Kitwe for allegedly distributing red cards during the youth day celebrations at city square in Kitwe.

NO. so he is basically narrating what happened when he was arrested.and that is he was getting a lift. If he distributed cards at some point that is another matter and the police should have arrested him then and not wait for later.     At the city Square where he was found distributing Red Cards, what was the nature of the function? Was it his meeting or what? All I know this was the venue for Youth Day cerebrations for all youths from different backgrounds, why was he then distributing Red cards at this Venue? Isn t this provacation which can lead to breach of peace? He has in the past called for meetings where he has addressed people and done whatever he wanted without the police having to arrest him.Why didn t he do the same this time around? Youth day is for anyone who considers themselves to be a youth,it doesnt say specifically who should attend and who shouldnt,in Zambia anyone between the ages of 15 to 35 is considered a youth,its called freedom of association,more over,he is a youth so he can do what any normal youth can do,,,even construct houses and expand his parents’s hse

    I hope you have been following the events of fr Bwalya, I do not want to be biast in my comments but give advice that is beneficial to all Zambians including me and my family. I listened to ZNBC news and radio icengelo over this particular matter, i took it as gospel truth, what was said by these media organisations. If the truth is that Fr Bwalya was arrested, while he was asking for a lift from a friend, then the law enforcement officers must be taken to task, We must be free Zambians who should enjoy our liberties, but enjoy the freedom with respect for other citizens.   40. I think Frank is embarassing us (catholics). We need him to be sober and angaging as opposed to the kind of things he is getting involved in. There are other critical voices in the land that have behaved themselves well and conducting their activities well, and govt has not taken them to court. He must introspect and change ways. Lets not be distracted by what is really happening – Rupiah Banda is a Tyrant who, given a chance, will intitutionalise dictatorship and political patronage and therefore take us to the Last of KK’s republics. That was the turning point to today’s politcal landscape. The Catholic Church stood out inthe crowd. The church stood up for the people.   46. Fr Bwalya’s NGO is called Change Life Zambia not Change or Die Zambia. Get it. It’s Change Life Zambia. Look in the story and you will see it’s Change Life Zambia not what you are portending. Don’t colour your submissions with ill-conceived emotions. Fr Bwalya has done nothing wrong, absolutely nothing wrong. What he is doing, in political science is called “civil disobedience”, which also happens in homes when children boycott even food because they are aggrived.

I am still very strong in the church and SCC. However, a wrong is a wrong. As a catholic I have an obligation to call for normalcy if I see that a priest is going wrong. The Church is bigger than any single clergyman including Fr (may be emeritus) Frank, as you in our church we believe that God is not a ‘respector of person’. Regardless of your status in society you are equal before God, and should you make a mistake you will be corrected.
