‘Government should have listened to people on the constitution’

Citizens Forum Executive Secretary Simon Kabanda

The Citizens Forum says government should have listened to the Zambians when they called for the enactment of the Mun’gomba draft constitution.

This follows the failure of the Constitution Bill to go through second reading in parliament yesterday bringing to an abrupt end the lengthy constitution making process.

Mr. Kabanda says government exhibited arrogance throughout the constitution making process by taking advantage of its victory in the 1996 constitution amendment process whose out come was in its favour.

He says the end of the constitution making process at the second reading stage is an indication that the Zambian government cannot fool Zambians all the time and have monopoly on all matters of national interest.

Mr. Kabanda has since urged Zambians not to give up hope but continue demanding for a new constitution that will take their concerns into consideration.

Speaker of the National Assembly Amusa Mwanamwamba explained to the Members of Parliament yesterday that the failure of the Constitution Bill to go through the second reading stage meant that the 1991 constitution as amended substantially in 1996 will remain in place in its current form.

  6. The draft failed to address the clauses which had been submitted by the Mungomba Commission. Maybe that’s why

  7. Why can’t we amend the constitution piecemeal.I’m sure there are some aspects that all parties agree on eg. Dual citizenship,promotion of women,youth and disabled etc.The Mps can then vote on those aspects and those that pass go through.The controversial ones go back to the drawing board instead of redoing the whole thing again and wasting time and money.

  8. What government should have done is a better job of explaining the constitution and building support for its key provisions. How many us here (…who are presumably some of the best read and most well-informed people around) truly know what the new constitution provided for?

    Yesterday on this site we read that George Kunda told the house that “the Constitution of Zambia bill sought to preserve laws in existence before the coming into effect of the constitution as amended.”

    Say what, George? A constitution is for everyone and if this draft was only understood or there to serve the interests of a few people in suits and fancy dresses then I say well done on parliament for rejecting the bill.

  14. An exercise in futility. We need to get rid of the selfish lot calling themselves politicians; both opposition and ruling. To start with, the exercise was doomed from day one because people like Michael Chilufya Sata made it a point to throw in whatever spanners they could to make it fail. When that did not work, he threw out of PF all MPs that supported it. When you count the number of MPs that did not attend the NCC, the number is less than a third. Therefore the document before the MPs in parliament yesterday had been supported by the majority. However, because people want to hold GRZ to ransom, it has been shot down; which is why the basic needs will always elude us. We fight over anything and cannot unite to fight for what is right.

Billions of kwacha drained, Zambians thrown further in the abyss of poverty and RB wants another term what a nutter. 47 years of independence we are still failing to draft a constitution that favours the development of the Zambian people?

  18. I am seeing a gross misunderstanding of matters. I note how it is perceived that MMD was making a constitution and PF was opposed to it. If democracy serves me right, MPs were representing the wishes of the electorate. So those who participated were instructed by their representatives, as much as those who refused to participate. The culmination of course is that the process died as a result of the will of both those who sent their representatives, and those who decided not to. Let us transcend party lines in national matters like this. Otherwise it appears as though we must all be subservient to the executive, which is an affront to the separation of powers.

  19. Iwe #19 you must be one of the beneficiaries who looted the national coffers in the name of NCC. Sata rejected the whole thing right from onset because it was a circus. Who did not know what the outcome would be? All the important clauses which people wanted included in the constitution were rejected by MMD and only came up with the crap for status quo? What was rejected is the MMD constitution and not the Mung’omba people’s driven draft constitution which was heavily doctored by thes thieves in the name of NCC. They must made to pay back the loot from the national coffers. We shall reject them all at polls. Watch this space.

  20. I don’t see any winner in this situation. If anything it suits the MMD as they have always won elections under the current constitution. What all the loud mouthed greedy MPs should have done is try and make an imperfect draft into a good one. How? By sensible free debates and deliberations in the house. Our current MPs are to say the least quite dull. As for these NGOs, to them it is an opportunity to ask for more money from their funders in the guise of helping come up with a good constitution. No country has a perfect constitution.

    What I do not understand is why some MPs were allowed to abstain. On a matter of such importance, every MP should have been given only two choices i.e voting for or against. Surely, The MPs who abstained owe the people of Zambia an explanation as to why they voted the way they did. They had had ample time to make up their minds. Abstaining is behaving like a chicken. The speaker should have applied the 75% requirement to the votes cast! Abstaining is neither ‘YES’ nor ‘NO’. They had disenfranchised themselves. That is how we vote for the President and MP’s. The same should apply in the parliament!

  23. The MMD has 95 MPs. Shikapwasha should have said that the betrayal came from the Rebel PF MPs from which MMD would have sort support. With their support 2rds would have been reached.
    MMD should be aware that if they had Chilanga, Mufumbwe, Solwezi Central, Bwacha, Isoka and Dr. Musonda’s (the shooter) consituencey, support from Mulongoti, support from Shakas, support from Mpombo; the bill could have gone through!

MMD and some surrogate opposition MPs wanted to find a legal way of chewing tax payers money and that legal way was found by scheming and pretending to be working on the constitution. If they can not chew Zambian money, what kind of money do you want them to chew? Money from donors? No, chewing money from donors is too risk. Please just give MMD another 5 year mandate this year so that they continue chewing. Mind you they have to complete their programs. What programs? CHEWING.

The few good things this draft had also included a set election date, not depending on RB or other pipo, to the advantage of the opposition. It included many other items that had little to do with the party in power but to do with the marginalised youth and women. If anything, MMD would have stood to lose if the bill had gone thru.   27. Kabanda and his group should live above partisan politics. This was a national agenda and coined in this way by the person they always support now late i.e Levy now today they are saying we have been vindicated my foot! Most of the clauses were good in the draft and all we needed is to pass it and continue refining it. Our MPs and some NGOs wanted a perfect constitution which i believe can not be achieved in one go.The biggest problem is that people like Kabanda and opposition were looking at the draft in relation with the elections. This is the biggest problem coz the document was not about elections. It tells me that the opposition do not really oppose for the sake of Zambians but just opposing.   39. I would suggest we seek help from experienced organizations such as the UN in the constitution making process. Our constitution as it stands now undermines basic human rights and is geared to serve the interests of the political players. I assert that the average MP does not even understand the reason why a constitution exists, which is to protect the individual against abuse by others, including governments. That being said, there is need to engage more stakeholders, including those that are not well represented politically, if the document is to stand the test of time.

But despite camping in Mutaba for four days together with his vice-president Richard Kapita and his entire national executive committee, he lost the election.   42. Mpombo said if UPND wanted to come back into political limelight, they should ditch Hichilema’s blunder-prone stewardship. He said Hichilema had failed to provide inspiring leadership as seen by his recent pathetic union with APC.
    Mpombo said had Hichilema been a humble person, he would currently be president of Zambia.

    “That chap without his misplaced pride and arrogance he should have been in State House now.     Yesterday, Hichilema was quoted in the Times of Zambia as having said that Mpombo had no influence in Kafulafuta and among the Lambas in general.

    Hichilema claimed that he assisted Mpombo with cash but refused to disclose further details on the matter. He advised Mpombo to be grateful to people that assist him when he is facing…

Example is the law governing the Pension scheme for Civil servants which needed change. To tell you the truth my blood leaks when i think of these fools. My own sister worked in the ministry of health as a nurse for 16 years, died in 2005 after saving at Mansa, Chipata and Mazabuka District Hospital. Myself and the Doughter had to make several trips to Livingstone to get papers together and after spending on transport to Mansa, Chipata and Livingstone all we got was K8m which was far below what we used on these trips. After all this nonsence the clerk at the counter of the Pension House produced the Act enacted by th fedral Gvt

    The bill totally ignored pertinent issues that the Zambian people wanted included in the constitution. If MMD cared for its people why did they throw out the Bill of Rights article? Why would any serious govt not recognize shelter, water, health, education etc as basic human Rights?

    The constitution was more than just 50+1, voting date, dual citizenship and delimitation.

    The opportunity for making a good constitution was missed at NCC. We spend colossal sums of money on a futile exercise.

    Govt is being disingenuous by blaming the opposition for defeating this MMD constitution. Despite the cost involved, I am glad the bill failed to go forward

  59. #10 valid point. in fact the current constitution allows for amendment of some provisions of the Constitution by parliamentarians e.g the Budget cycle change, save for those provisions that require an amendment through a referendum. The only problem is that constitutional making process in Zed is and has always been a money making venture for delegates/commissioners and as such we are made to believe that the whole constitution has to be amended when it is not necessary.

    1)-PF desertion has killed hope for proportional representation.

    2)-PF desertion has killed hope of increasing the number of constituencies citizens asked for.

    3)-PF desertion has killed RB’s endorsed clause of Zambians in the Diaspora earning dual citizenship.

    4)-PF desertion has refused the reinforcement of the declaration of Zambia as a Christian nation.

    5)-Instead the PF would rather have the recognition of homosexuality and lesbianism before supporting the Constitution of Zambia Bill.

  61. Empirical evidence has surfaced that Sata ordered his MPs to kill the constitutional bills in preference for his sponsored 1996 constitution. Zambians know very well that the 1996 was a Sata sponsored constitution. Like he killed people’s aspirations in 1996, he has killed it again through orders on his MP to be AWOL in the chamber.     your view that we need to look at the big picture is right. But do not agree that we can setup an NCC just to push MMD’s agenda and ignore the major factors that would have revolunized this country’s constitution.

    There is no MMD victory here at this stage. The MMD got its victory when they managed to hoodwink the zambian people that NCC participation was representative of all stakeholders when infact it was an MMD agenda by design. HOW, they made it impossible for well meaning guys to participate by not addressing the contentious issues. Rememeber the proposal for the Constituent Assebly, compositin of NCC debate, appointment of participants, etc…

  77. The way i look at this issue of the bill flopping, i think it doesnt mean the vote is representative of the wishes of the lectorate. Rather, I think the electorate have been used as political pawns by the parliamentarians. If you are analytical, to a larger extent, the bill flopping is advantageous to the MMD. And when you look at it, actually the majority voted for it but the two-thirds majority could not be garnered. In all honesty, the UPND MPs should not have chosen to abstain. This was a matter of national importance and their voices needed to be heard as representatives of their electorate, they should have let their no be no formally, not to be cowards and indecisive. I do believe there is no perfect constitution anywhere in the world, just like there is no perfect president, hello?

  78. Hey people i wonder if we understand why people go to Parliament. 82 & 83 outline a few matters which are of concerns. Parliamenterian go to parliament to represent the people and not there president. If some one stands up and says Sata said – then there must something wrong with his or her mind. The NCC was constituted to overhaul the entire constitution Article by article and not only the 50+1. The majority of zambian submited to the Constitution review process because they did not want the repeat of 1996 stuation where the review was targeted at individuals.

The draft constitution and the process arrived at may not have been the best of what we wanted but at least it had some clauses that were good and progressive and the majority were going to benefit. Yes the 50+1 was important but it was not the only thing we wanted in the constitution. so for me I think the Zambian people have lost out on some of the good things contained. if we are expecting to have all the good things in the constitution at one go, then it will take us another century. lets look at the good things in the draft and not condemn it completely. some have never even read the draft and are just following blind debates!!!
