Chanda Chimba and others appeal order restraining them from Broadcasting ‘Stand up for Zambia’

Stand up for Zambia producer Chanda Chimba (III) captured when collecting footage for his series that has launched scanthing attacks on PF leader Michael Sata.

LUSAKA freelance journalist Chanda Chimba and the Zambia National Broadcasting Corporation (ZNBC) have filed a notice of appeal in the Supreme Court to appeal against the Lusaka High Court’s decision to restrain them from broadcasting the ‘Stand up for Zambia’ television programme.

Other interested parties in the case are two television stations Muvi TV Limited and Mobi International Limited.

“Take notice that the appellants herein being dissatisfied with the ruling of Honourable Justice Dr Patrick Matibini given in the High Court under Cause number 2010/HP/1282 at Lusaka on the 2nd day of August 2011, intend to appeal to the Supreme Court against the whole ruling,” the notice, which was filed by SBN Legal Practitioners yesterday, reads in part.

This is in a case in which Patriotic Front (PF) president Michael Sata applied for an injunction to restrain Mr Chimba and the three stations from airing the programme.

Delivering ruling on Tuesday this week, Dr Justice Matibini said:

“Accordingly, I hereby grant an interim injunction restraining the defendants, each one of them either by themselves, their agents, or servants from publishing or broadcasting or causing to be broadcast the programme ‘Stand up for Zambia’ until after trial of this action.

“Further, the first defendant (Mr Chimba) is restrained by himself, his agents, servants, or whomsoever from producing, distributing or in any other form of transmission the said ‘Stand up for Zambia’ programme.”

Dr Justice Matibini said it is contempt of court for any person notified of the order to knowingly assist in or permit a breach of the order.

“A person doing so may be fined, or sent to prison. Should I later find that this order has caused loss to the defendants, and decide that the defendants should be compensated for that loss, the plaintiff (Mr Sata) shall comply with the order I will make. Costs follow the event, and leave to appeal is hereby granted,” he said.

  5. Why appealing the ruling? I expected the same appeal in FTJ’s case when he was dubiously acquitted. I have never seen such enthusiasm by the media to appeal in a matter which would only please the state. I guess the instructions to appeal must have come from Shikapwasha or Dickson Jere. Our justice is on trial. Let us wait and see. RB restrained the Post from publishing negative articles against him in the 2008 elections. Sata’s actions should therefore not be criticized unless one is trying to be myopic. RB set the precedence by rushing to the court to stop the Post from writing editorials and articles which were injurious to his political campaign in the presidential elections.

  16. I’m not a fan of CC3 but let him freely broadcast his MMD propaganda. The Post daily publishes pro PF propaganda and no one ever seeks an injunction to stop them. Besides, CC3 is not committing slander/libel, he’s just using historical media archives to show that cobra is an inconsistent politician (chameleon). PF should just focus on selling themselves; they’re even free to launch their own version of ‘stand up zambia’, which they can broadcast on muvi. Cobra and his cohorts simply have no plan and are headed for a major defeat this time around.

  22. What is ZNBC’s interest in appealing the injunction?? ZNBC is a public institution which should leave the problem to Chimba as per their own disclaimer. Save public money and concentrate on improving your constant technical failures.

  23. I have never personally seen or heard this so called “Stand up for Zambia” program. But it sounds like Mr. Sata is not accorded the chance on this same program to refute, clarify, dispute, respond, or correct what these so called “facts” from the past. What if these so called “facts” from old editions of THE POST editorials are being taken out of context by Chanda Chimba, isn’t it only fair that Chimba and his sponsors gave Sata the chance to respond?

    Just because something was written about him in the past does not make those things facts. Mind you THE POST at the time they were editorialising about Mr. Sata things were not as friendly between them. So we cannot take what THE POST wrote about him as Gospel truth. If we want to be fair, give the man an equal platform to respond!

    • There is a challenge on the floor, saying that the PF leader should also come up with a similar version of “Stand up for Zambia” to refute, disown, deny, counter attack or defend against the allegations on Mr. Sata perpetrated by Chanda Chimba III.
      If the order is stayed, I too feel Mwadya Mweka Daddy (MMD) should also file an injunction on the Post newspaper.

The difference between the Post and Chanda Chimba;s program is that while the later is highly unprofessional the Post has certainly endorsed PF as its preferred party. The Post makes an effort to get comments from those they criticize their actions. This is one of the requirement of journalism profession. Propaganda does not resemble journalism but gutter journalism which manifests in authoritarian regimes. In big democracies like USA newspapers and media houses do openly endorse presidential candidates and write positive articles about their preferred candidates.   82. I have missed stand up for Zambia, I was not aware of the court injunction. People of Zambia let us be fair; the Post has been running provocative commentaries on RB and the MMD. They use inflammatory terms but the government has accepted it out of principle of protecting democracy. Chanda Chimba is doing the right thing to inform us of who Sata is . He does not add or substrate anything at all. Sata has damaged himself by what he says and nothing else. The appeal should quickly be heard in the supreme court because I am missing the program.   96. I have missed the Stand Up for Zambia TV program. I want it back on the air, I want a speed hearing at the supreme Court. Without it, I would not have known that Sata has been making secret deals with the immoral Europeans on homosexuality. That is why the judge says that if at trial CCIII and the other appelants are found to have suffered damages due to the injunction by Mr Sata, then he will penalise Mr Sata. However those of us who enjoy the programme support the appeal and we know that the appellants stand a very good chance of winning, because Mr Sata should have sued the source of the material i.e. the Post. Especially if they point out in their arguments that their material is from the Post and Mr Sata’s own words at his rallies, and that this judgment denies the Zambian public their right to freedom of information.   148. It is interesting to note what we argue about. We are busy arguing about who will win or lose instead of looking at the real issues. Whether Chanda Chimba writes or attacks PF leader, the truth is this country has alot of poverty despite having all that it takes to develop including enough money.
    Just take a serious look at the Auditor General Reports for 2009 and 2010, Ministry by Ministry and you will see how our funds are mismanaged. What we need in Zambia are people with integrity and iam not so sure any political party in Zambia can boast of such people. We have alot of dihonest people both in the ruling and the opposition parties. Zambia will not move forward as long as we keep voting for people who have a vision for their pockets.
