Maxwell Mwale arrested over MMD bicycles and pleads not guilt

Former Mines Minister Maxwell Mwale has pleaded not guilty to one count of failing to account for property believed to have been stolen or unlawfully obtained.

Mr Mwale took plea this morning before Lusaka Chief Resident Magistrate, Joshua Banda.

It is alleged that on October, 18, 2011, Mr Mwale jointly with others had in their possession 261 bicycles which were reasonably suspected to have been obtained unlawfully.

Meanwhile, Mr Mwale has been released on bail.

Chief Resident Magistrate Joshua Banda has granted Mr Mwale a K30 million bail in his own recognition.

Mr Mwale has also been ordered to give two working sureties in their own recognisance.

Earlier, Defence Lawyer Sakwiba Sikota and Sunday Nkonde applied for the bail saying that their client is facing a bailable offence.

    How much is a bicycle, at factory prices, K110,000. every one know that the bicycles come from china as a donation to MMD what is the problem with bashichilufya. I am happy I never voted to him, while the ***** who voted are still on the streets still jobless and very poor indeed. No 90 days Miracle.

    I thought he was arrested over the Gold scam ?
    Wow, 261 Bicycles… Were they running a business of some sort? surely they have receipts for the bikes.
    On another note: Sakwiba Sikota ali mu money zoona… business is booming for him. It would seem as though he is representing the entire MMD camp and one wonders how much they are paying him.

    Sakwiba Sikota is making a killing. He is in the money. Business must be booming at his law firm. I’m sure every other lawyer would want to be Sakwiba Sikota right about now.

    Another serial of blunders. even the law enforcement agencies are behaving like HEMS. So its all trumped up charges leveled against MWale, Musokotwane and Zulu? And why did the prosecutors in the Zulu case run away and disappear in ‘thin air’ when bail money and sureties were presented?? have we gone back to the UNIP & Chiluba days combined? ZAmbia is slowly sliding into a dictatorship

    A bicycle cost about $100 dollars, not K110,000.00… If you fail to explain to the police how you obtained an item they’ll arrest on suspicion of fraud… So for Musokotwane and Mwale to end up in court it means there’s something they are fail to explain. And if it turns out that they got these items from RB but did not care to find out from RB how thes items were obtained then they too are an accessory to a criminal offence…

    Sakwiba knows that he is getting free money from the MMD bcoz they will lose 90% of all the cases taken to court. Zambians watch this space…Sakwiba will change camps on pretext that he helped PF win all their cases against the MMD.

    Republican Guard,dont show your ignorance of the law on public fora,its not for Mwale and Musokotwane to prove that they are innocent but for the prosecution to prove them guilty..which in this case will be difficult kaili takuli na complainant

    sakwiba should not hold us hostage,he can not be representing evry person suspected to have obtained money through dubious means,or all from the mmd regime,he will be asking the court to give him more time to study the cases and this can leand us to another seven years like the chiluba case.he should limit himself to atleast 3.as these are complicated cases.

    The so called GOLD SCAM is very unclear. I want some clarity regarding price at which it was sold. 118.897 kg is equal to 3 822.66 troy ounces. The price of gold on 8 july 2011, the date at which it was sold was US$1526.00/troy ounce opening and US$1541.5/ troy ounce closing. If the gold was sold at opening price it should have fetched US$5 833 375.26 and at closing US$ 5 892 630.39, assuming it complied with LME specifications. Now, how much was it sold at?. This has not come out clearly in all the arguements apart from saying it was sold at a lower price.
