Why the Constitutional Panel Has No Discrimination

It has become fashion for people to cry “discrimination” in every decision the President makes. Riding on the adage that “there is no smoke without fire,” many people have made a habit of seeing their own smokes and accusing the President of causing the fire.

And Zambia being a democracy where freedom of speech reigns, the voices of these “false smokes” are getting louder as if the fire were real. Opportunists, alarmists and sensationalists are riding the wave, gaining political capital and publicity out of these false smokes.

Feeling “hated” or that another person is “jealous” of you is a pervasive illusion in the human psyche which has made others declare: “God hates me; what wrong have I done?” When you give a street kid K1,000 and another asks you and you say your money has finished, that street kid will feel “hated.” Some have even failed exams for what they believed was “hatred” from teachers.

Therefore, when somebody THINKS you hate them, often it helps to give some facts and figures, a kind of objectivity, to help explain your decision. It is not a guarantee that they will see that you truly do not hate them. For all intents and purposes, they have not seen God’s love for them despite the many facts and figures He has given in creation. But it helps to just put the facts and figures, which hate nobody, out there. You can only pray that reason will eventually prevail and they will see their false smokes for what they are and rise above them.

The latest example of the false smokes of discrimination is the constitutional panel of experts, where some have seen the smoke of hatred of non-catholics on the part of the President. They are arguing that having three Catholic bishops is discriminatory to other churches or religious groupings.

I would like to show why that is not the case, why the panel shows no hatred on the President’s part.

In terms of Christian groupings, who do you say has been left out? Who is hated? Is it SDAs, Jehovah’s Witnesses, Lutherans, Methodists, Baptists, Apostolics, Anglicans, Wesleyans, Reformed Church, Methodist Episcopals, Salvation Army, Presybeterians, Brethrens, Faith and Holy Tabernacles, or Pentecostals? The list is endless, exceeding even the 20 allowed on the panel. Do people expect all of them to be included? Or say he included SDAs, would that suddenly make him non-discriminatory? Or perhaps Baptists will cry foul still?

Some people are saying Protestants have been discriminated against. They think that because Protestants broke away from Catholicism and the term ‘protesting’ sounds acrimonious, people can easily believe that indeed Sata hates Protestants, like he “hates” opposition political parties.

First of all, who are Protestants? What is Protestantinism?

Wikipedia says, “Protestantism is one of the three major groupings (Catholicism, Orthodoxy, and Protestantism) within Christianity.” Religion facts at www.religionfacts.com further says that, it is “A general branch of Christianity encompassing numerous denominations and a wide theological spectrum ranging from conservative to liberal. It started in the 16th century.”

Examples of denominations given include: Presbyterians, Reformed, Church of Scotland, Anglicans, Episcopalians, Evangelicals, Lutherans, and Baptists.
So when somebody says, “Sata hates Protestants,” they mean he hates these churches. How possible is that when he was recently ridiculed in some sections of the media for acknowledging a Protestant leader in the traditional way of kneeling and kissing the leader’s ring?

And because the list of experts does not mention these denominations by name like it does catholic, all Protestants out there: Presbyterians, Baptists, Lutherans, Anglicans, etc will believe they are hated by the head of state, as a major branch of Christianity, when in actual fact they are not.

Other people are saying include the Evangelical Fellowship of Zambia (EFZ). What is EFZ?

EFZ is “A mother body of Christian denominations, local churches, para church organizations, mission agencies and individuals. EFZ was established in April 1964.” Their list of 225 members includes Pentecostals, Methodists, Baptists, Redeemed, Salvation Army, Apostolic, children care and HIV/AIDS help desk, and many other Pentecostal “ministries” and fellowships including ZAFES, scripture union, Campus crusade for Christ and Zambia Nurses Fellowship.

In actual fact however, most of the 225 members are one-man show Pentecostal ministries, headed by men of God who have enriched themselves from the offerings, tithes and gifts of their church members.

Yes they represent their various ministries, but those are the same ministries where they themselves are getting “blessed” while the larger majority of their congregations wallow in poverty. So if in their own congregations they are putting themselves first, can you then argue that at EFZ they will put others first?
“Charity begins at home,” they say.

The EFZ participated in the NCC where the nation lost money. Some of their members prophesied that God had allowed Chiluba a third term. If EFZ represent a coherent section of society, why these “errors” from their members? Or is it EFZ itself and not individual members making the errors?

Or if we say we are a Christian nation who must forgive, why then should we oppose Xavier Chungu’s appointment? Further more, if EFZ represent their various individualistic ministries, how then can we say ALL the 225 organizations have been represented when we put one individual from a certain ministry on the panel?

Of course there are other members in EFZ like Baptists, Lutherans, Methodists, Episcopals, Salvation Army, etc who do not have this tendency of “self enrichment” in God’s name, even to the extent of ripping off our national resources. But even under Council Churches of Zambia (CCZ), which is represented on the panel, there are Lutherans, Methodists, Episcopals, Salvation Army, etc.

Why should a Salvation Army, Methodist, Lutheran, etc under EFZ feel hated and discriminated against, while the same is represented under CCZ?

I personally think they do not. They feel they are one and the same in Christ and so they are represented, including by Catholics. So the people seeing discrimination are the ones who have something wrong with them.

CCZ is a 22 member, “ecumenical umbrella organization of mainline Christian churches that seeks to promote cooperation and fellowship between Christian churches and organizations in the nation. It was founded in 1914.”

This is where you find such churches as: UCZ, United Methodist Church, Anglican, Othordox, Presbyterian Church in southern Africa, etc. All these and others are represented on the panel in Rev Mutale from CCZ.

According to Wikipedia, quoting the International Religious Freedom Report – Zambia 2010, in terms of religion, 87% Zambians are Christians. On 20th April 2011, Times of Zambia quoted the Vatican Ambassador to Zambia, Nicola Girasoli, that, “The Catholic Church consisted of about 30% of the population in Zambia.”

So we can roughly say of the 87% Christians in Zambia, 30% of that is Catholic, 57% Protestant. One can therefore use a blanket statement and say, “Sata hates Protestants for giving 75% of church seats on the panel to Catholics.”

But that is being unreasonable and impractical.

We have seen above that Protestants are not one, two, three “coherent” sections of society. You have Protestants in both CCZ and EFZ. And obviously, the fact that we have two protestant mother bodies means even amongst them, there is more “protesting.” It is even possible that there are Protestants outside these mother bodies. Therefore it is practically not possible that Protestants can be “represented.” They are just way too wide, divided, varied and numerous.

In my view therefore, CCZ is enough representation. It has both Orthodox and Protestantinism, the other two major groupings of Christianity. It is a pity EFZ has been left out but I think it is irresponsible, alarming and sensationalism for anybody to say, “Sata hates non-catholics” because of that.

What about Muslims?

Wikipedia, quoting the International Religious Freedom Report – Zambia 2010, says, Muslims AND Hindus make 1% of our population. (The other 12% is indigenous Zambian beliefs).

The Islamic Supreme Council of Zambia, through its Council Secretary General, Sheik Shaban Phiri, said, “The Technical committee (on the constitution) is not representative of all religions, which may be a threat to national unity.”

Surely, what is 1%? If all 1%s must be represented on the panel, how many will be there. And we have to include a Hindu too, because Muslims are not Hindus. Besides we are a Bible-inclined nation; when we “leave out” Muslims, that is not hatred against them, it is majority rule. Christians are left out in Islamic countries like Iraq, Iran, Pakistan, Afghanistan, Indonesia, etc. They do not talk “threats” to national unity.

And is it only the exclusion of a religious 1% that is a threat to national unity? What about the other “1%s” in miners, students, youths, women, teachers, bus drivers, marketers, trade unions, etc? Why are they not talking threats?

Again these alarms are just false smokes being projected on the President. People are intolerant and they are blaming the President for it. That is not fair.
Sheik Phiri is already on record, in the Zambian Watchdog article of 20th November, 2010 of threatening to cut the nose of the Registrar of Societies for allegedly meddling in Islamic Affairs. These threats are not necessary.

Clearly, from the afore going, people are seeing their own smokes and accusing the President of causing the fire. This is irresponsible and uncalled for. It is contrary to the spirit of One Zambia One nation.

Zambia is our nation all of us. There is no need to feel “hated” or that others are “jealous” of you when you are left out of ONE opportunity to make a contribution. Everybody will have an opportunity for public submissions at a later stage.

You can express your disappointment for being left out yes, but it is totally irresponsible to go further and accuse the head of state of hating you. That is arrogant. We should not encourage such a culture among us, whether from religious brothers and sisters, tribesmen, gender mates, political party mates, age mates, etc.

I know the president did not go through all this bother of “facts and figures.” I am sure he does not think of EFZ the way I have put it here. He just used his wisdom and made his judgment. People have a right to disagree with that judgment, he is their president after all; and maybe he can reconsider. But let us all desist from sensationalized allegations of being “hated” by the head of state, when we disagree with his judgment. We do not need to issue threats.

I believe even in OUR disagreement, there can be unity, respect, peace and above all patriotism. We are disagreeing because we love our country; so let us not be the first to project hatred, anger and threats in our disagreements.

  2. According to Wikipedia…my good sir, no decent scholar quotes wikipedia…secondly you mentioned that we have twenty different Christian institutions…correct! But how lucid is it to have one Christian institution representing the other twenty? The appointment of three Bishops was wrong…the Catholics are known for their influence in African politics for the past hundreds of years and they are still doing the same today! The have successfully taken over PF…at the expense of Zambia…i still love Micheal Sata though! He made a mistake and am sure he knows it…

  3. Mr. Makulu, you should have read the post where a judge has given some advice. When you accuse EFZ of participating in the NCC, then put it also that PF participated cause the same way individual members from EFZ participated. EFZ opposed the NCC.

    Further if EFZ participated as you claim, why should be they be left out now if Prof. Mvunga, Ms. Zoloumis etc participated in the NCC and even chaired some of the committees. What new thing will the bring to the table which they didn’t 6 months ago? Did they also not receive the NCC payments as you allude to? Please, don’t just write but do some research. those 5 guys that participated in the NCC whether lawyers or not, let the people down and do not deserve to be part of this committee period. Find some other learned lawyers.

  4. HE President Sata is the head of state because he won the majority of the Zambian, he has the right to apoint his people into govt posts. Those in opposition will earn that privilage, if and when the people of Zambia vote you into power. Remember we are a democracy and majority rules in a democracy. No tribe can impose itself on us. Some people are complaining HE MCS has given important post to his own people, yes he has and rightly so, he has to give them to those he trust the most, if you don’t like it tough it’s hisPF govt and hires and fires as he sees fit. Why would he give his rivals vital posts? People will always moan if they try to bring disorder we use the police and army to bring order. The US, UK, German,Canadian,French govts are on our govt side

  7. BC, If he was appointing able and capable Bembas like Chikwanda, I will understand. But Kambwili, GBM, Mwamba and Xavier Chungu! If this is the best he has in his hood, he should have looked further because while it is his prerogative to hire and fire as you pointed out, he is also under an obligation to take due care in his governance of this country and I do not see how appointing Xavier Chungu, a convict, GBM, a notorious wife batterer, Panji, a declared bankrupt, Dr Miti, a suspect before the courts of this land, appointing 10 and not 8 MPs etc accord with the said obligation. Only time will tell but the injurious effect of this lunatic’s appointments to the fabric of Zambia could destroy this nation. Mark my word!

When the Times of Zambia, Daily Mail and ZNBC were pandering to the then Rupiah Banda’s government, all I did was not read the paper or listen to the ZNBC gabbage. Someone here has tried his best to educate the masses. If you dont like his writings, then give us another version instead of puking hatred. We all zambians first and tribal and religious partisans second.

    I agree with the author in almost all the points he has raised.

    We can’t spend all our time talking about denominations and tribes, which will only cause more divisions. In countries like Nigeria, this is what keeps bringing to the fore serious social and ethnic problems. We need to come to a situation where we say “We are ONE people!” And the future of the entire nation is more important than sorting out people according to different denominations or tribes.

    All presidents have appointments that do not work out and it is not, and never has been, a criteria of a successful presidency. Let’s be fair enough and give president Sata and his team an opportunity to make a contribution to Zambia without disrupting their agenda.

    • Where was Makalu when journalists were taking cheap shots at HH. This article in itself screams discrimination. Tribalism is just like racism. Ignoring it does not change the fact that it still exists. The only way you can fight ignorance is by exposing it. For instance Aids has taken so many lives because a lot of people tried to ignore the deadly disease. Since people became comfortable with confronting the issue, there’s been a lot of improvements in the fight against Aids. The only way we can develop our country is if we fight tribalism.

Those of us who have known President Sata for a very long time, know that he has something against non-Catholic Christianity. If you don’t believe this, check with ZNBC archives and re-watch his utterances against the likes of Nevers Mumba of NCC then and his views on Chiluba. In private, he has always ridiculed ‘ba bon agen.’ It is not hatred it is disdain.

There can not be so much smoke without fire and all these people cannot be wrong in their interpretation of Sata’s clearly regionally insensitive appointments. These stinking appointments are not playing out in an innocent presidential prerogative sphere, they are unfolding in a tribally hinged context very dangerous to the unitary state of this country.   16. The President just need to tough this one out. You cannot please all the people all the time. He must take the lead. We do not need NCC mark two. Submissions were collected from around the country already. Why do we need more tinkering?

  19. Maurice Makalu don’t speak too loudly. MCS is not even noticing you. Be mindful that today it is MCS, tomorrow it is somebody else. You could have written your article more objectively rather than making it so obvious that you are a PF and MCS vuvuzela even though MCS does not even know you. Be calm, there are people who are paid to watch others and you are in their scope. Why can’t people be just objective. I get the feeling that a lot of people just keep supporting MCS even when he has made a mistake, just because he comes from the same region. It is silly to reduce our national debates to blind loyalty on the basis of regionalism. MCS is making some really good decisions, but when he screws up he must be told he has screwed up. Himself MCS has emphasized that. Be real!

The president is consistently discriminating, probability does not favour the idea that ‘the people are consistently falsely accusing him’. Constable
    Sata’s advisors or admirers need to get this fact on board very quickly before its too late. he can not be right all the time and the people wrong all the time…..he is descriminating, he needs to change and no amount of defending him will silence complaints from his victims.

  25. @ 5 BC. Sata PF govt is not noticed in Europe or America. Signals so far indicate another dictator in the offing. Mature democracy can not fanthom what is emerging in Zambia. It was reported during RB’s reign that Zambia’s economy in Southern Africa was one of the fastest growing economy. Against that they look for political stability and consistency to sustain that growth. Signals so far are persimistic.

  26. I only browsed the article, not so inspiring. Nevertheless, I am compelled to comment on the comment @ 13, by THE SAINT. Next time, digress and comment on science only if you are well armed on that topic. Religion is a human creation. Nearly all peoples have developed their own creation myth, and the genesis story eg is just one that happened to have been adopted by one particular tribe of the Middle Eastern herders. It has no more special status than the belief of a particular West African tribe that the world was created form the excrement of ants, or our own now decanted traditional beliefs, a consequence of Christian brainwashing.  Even some modern sophisticated theologians have given up on instantaneous creation because evidence about evolution has become overwhelming.

    • Dildo the best way to put it is that nobody knows. Science itself will continue to evolve, to me it just brings up more questions than answers. It has failed terribly to answer the big questions. I don’t see anything wrong with one believing in something that they cannot prove in a lab. The only thing that is true, is that we live in a mysterious world. For the most part the laws of science are man made, that to me means that they are limited. Its only a matter of time before we discover something that is going to alter all these laws that we now know as absolute truths.

As for now its president Sata and PF in control. Don’t think for him bakabwa imwe, who do you think you are? Always complaining about a party less than 3 months in government. You may look down on him, but he is infinitely wealthier than you will ever be. Sata had to be pragmatic. I am not sure what the justification is for Kambwili. I suppose he brought in a lot of votes from Luanshya. Chungu was supposed to be the price for the support from Luapula province. In politics you cannot afford to be snooty. Unfortunately, most Zambians would rather live under Apartheid than under a Bemba president, judging by what I read on this blog. Reminds me of how some Scots view the English.

    3 000 000 registered voters cast their votes
    President Sata scored around = 987 000
    RB got about 868 000, while HH had came 3rd with 350 000 votes! President Sata had the biggest vote which makes him the majority winner. Now PF is the govt in charge he has the privilege to hire and fire as he says fit. And with Zambian politics of hunger l see alot of mps defecting soon, thus handing the PF majority in the house. What is need is for us to work together and challenge these old school politics and have a modern govt! To achieve that we need to stop being tribal and work together regardless of tribe

     Thank you I have taken your  very good and valid points on board and how l wish more could come with your kind of wisdom than just insults. Having said that as you well know to win an election is like going to battle you reward those that fought with you shoulder to shoulder and Sata had to do that, in any given govt defence, finance, information and home affairs ministries have to go to your most trusted comrades. As for GBM it’s not only money he sent, he devoted alot of time to PF, the president could not leave him out. As for Chungu l do not how far true it is that he got a job, because if that were true then it’s a very bad move

    1. The president does not hate non-catholics
    2. People that feel not represented should not feel hated
    3. People that feel left out should not talk ‘threats to national security’ – how?
    4. The president can not satisfy everybody, he can only try
    5. The committee of experts is not meant to represent everybody, it is supposed to be composed of experts
    6. Zambians have become too talkative and less action!!!

  36. Zambia needs prayers more than ever. Lord grant wisdom to our leaders and Zambians and help everyone to be sensitive to those that are hurting. We refuse that a legacy of division should be passed on to the future generations. Lord bless KK for the good legacy of unity that he has passed on to Zambia.   37. Relax ba Maurice. People are saying it is not a fair and balanced representation. I hope in you subsequent article you will qoute the following 1 – Tribe 2 Province 3 Religion 4 Nepotism. Kindly note that the general complaint is that most of the appointees are bemba(bemba related), From Northern,Luapula or Eastern, or friends. Is Chief Luchembe a true represenative of the Chiefs in Zambia or the appointment is connected toLT Mwamba Luchembe?

My conclusion is this: everyone would like to be represented but that is just not possible. Rastafarians have been left out, so has the witch doctors and medical doctors association. The President should just ignore such outcries and soldier on in his job.

I will tell you that he can do whatever he wants in as far as appointing a cabinet is concerened, he can even appoint all his relative but when it comes to the constitution, am afraid there are no two ways about it- The first thing to a successful constitution is consesus, fair represetation from all those who matter and ofcourse cost, all in their right prportions.   45. Please leave all these religious bodies out of the constitution and politics(I don’t care what, or who thinks what). Its either all religious forms are included or every one of them left out. You have already compromised here by including only one religious body, deal with it and sort it out.

    On the tribal part i however think its just serous attention seeking and it should not be encouraged at all for the sake of “All Zambians” and not just that one or two tribes that feels left out.

  49. A team of experts indeed. The president means well with most of his intentions. The list of people going by names is good and these experts will rise above all criticism we are showering to ourselves now, let alone time come for them to start sitting and analyze the past commissions. Despite the above article, One still wants to know how the president could have just thought of appointing three Catholic Bishops. Since it is deemed that they have always spoken for the poor; even one of them could have represented the poor. Something still can be reversed and a correction be made. If not we stay put and support what is already in place.

  52. Countrymen, if the Committee is supposed to be made up of “experts”, do we need THREE “expert” Bishops from the Catholic Church? What expertise is Chief Luchembe bringing to the Committee that eg Chief Mwinilunga or something would not bring? We dont want to spend k300 billion and then the Constitution is rejected at referendum or parliament level. This why people need to feel or perceive to be part of the process i.e. CONSENSUS is critical to a successful constition making process. It starts with such committees. It is not about “pleasing everyone” just as much as it should not be about “displeasing” anyone. Is this HARD TO UNDERSTAND????

  54. I know the writter of the artcle was trying hard to cover a wrong with words. He is the one who has a problem with protestants or non catholics. His writting as though all things from Catholics are correct. Is it not the catholic fathers who have been found wanting with abuse of children? Could that be the reason for removing them from the committee? I do not think so. If this is what Sata thinks of the other churches other than Catholic, then we are in trouble. I know of prists who have children with catholic sisters and things have been kept under carpet. Stop this catholization of Zambia. recall you are only 30% and the remaining 70% we are not and they shall not be catholic. No amount of justification can remove this baisness towards catholics and Bemba.
