Court summons Mutembo Nchito for delaying Maxwell Mwale’s bicycles case

Director of public prosecutions-DPP-Mutembo Nchito has been ordered to appear in court and explain why he is holding on to a docket of a case involving former mines minster, Maxwell Mwale.

Lusaka chief resident magistrate, Joshua Banda ordered that Mr. Nchito appears in his court tomorrow after state prosecutors applied for a forth adjournment saying the docket was still with the DPP.

Magistrate Banda says adjournments are allowed for the sake of justice but that adjourning a matter four times on the same reason is way too much and unacceptable.

He says he needs an explanation from Mr. Nchito as to what is causing delay in expediting trial.

In this matter Mr. Mwale is facing one count of theft by public servant of 245 bicycles.

  1. this chap is just deliberately delaying these cases so he can have enough time to enjoy the office and the goodies that come with it

  2. Imwe, nchito is under the thumb of sata’s mentally disturbed synapse. He’s a lap dog doing the bidding of his master.

  3. This to me sounds like signs of a non performer. Remember the same thing happened to liato’s case. It took so long (after Court’s intervantion) for him to declare that Liato had a case to answer. Appalling performamnce so far.

No wonder RB disbanded the the Task force on corruption and removed the abuse of office clause from the ACC becoz in my view the cost of litigation for these cases is more than the benefits to the country. Money that could be used for development goes into the pockets of a few judges and lawyers who are also crooked in their dealings in most cases.

  5. Yes, justice must be seen to prevail – and delivered fairly expediciously too. On the other hand LAZ must keep a close legal eye on this crook (Mutembo Nchito) that has infested the Justice System. Just speculating: in the event that Sata’s physiological processes are rendered dormant and assume lethal proportions, the plunderers days are numbered.

  6. Common guys, the goodness of deomcracy is that it allows for accountability and transparency. Why has the justice not released remandees whose cases have been pending for more than 5 years? I smell a rat here. Non-theless the DPP must be level headed and not start crucifying perceived enermies for no good reason. He must grow up!

    • . The crooks in suits are riapdly invading every aspect of our lives, and we’re all allowing them to do it. I hate to use a slippery slope argument, but if they’re nationalizing banking now, what’s next?

Nchito is preoccupied with his own case, the Zambian Airways one where he is even walking out of court in protest for the judge’s refusal to receive directives from him in terms of how he should handle the case and the judgement he should give. How honestly can a lawyer ask the judge to talk with him in chambers before the case can start without the lawyers for the other camp? Is this DPP really serious with litigation or he was just forced in that office to protect only himself?  

    Charge him with disrespect to the court and then send him to six months imprisonment with hard labour maybe he can shade of some weight for him to start working and thinking properly. 

  8. I think this is riduculous. We were told MMD stole a lot. Even State House was found stinking with corruption. So Now why are we being treated to a challade of bicycles instead of big theft cses that happened as we were TOLD. Why? Even Liato will end up winning his case.

  9. We have the most corrupt, inept and compromised combinations ever in govt of dear Zambia. Just wait for the history to be wrtten. Only then, will people of this beautiful country wake up.

Dont complain,you allowed Fred Mmembe with his friend thieves to propagate lies about theft in previous Govt and yet he was simply campaigning for PF so that they can forgive his debt with DBZ.These are selfish people who are using their postmortem newspaper to cause hatrage in Zambia. I said it before that the post has brought more harm than good to this country as you can the result even with Barotse issue.

  11. Sata is the one to blame , of all learned lawyers in this country. How can pick mutembo for this job. The man has issue to protect. What will stop him from entering a nolle proseque in DBZ V Zambia Airways case. I think even Sata is not to blame but Zambians in general. We are very docile.

  12. Thats what happens when you persue cases on political pressure. Fortunately in court its evidence that speaks and not personal agendas.

  13. Mutembo was appointed DPP at the insistence of Mmembe so they could cover up their pending court cases. They owe DBZ and FBZ millions of dollars due to the personal guarantees they gave on behalf of the defunct Zambian Airways. Mahtani has forgiven them in exchange for his cases being dropped. These guys think they now control Govt but should anything ever happen to Cobra and we have by-elections, these boys will be running for their lives.

  14. Dear poor naive Zambians, has anyone from any party ever been successfully prosecuted and sentenced on corruption cases pa zed????. If not, then lets not expect anything out of this one either
