The current parentage clause which forbids Zambians with foreign parents to stand for president in Zambia should not be tempered with as it didn’t come from late president Dr Fredrick Chiluba, but from the majority Zambians at large which included Sata himself, and Dr Kaunda just happened to be a victim. It was a cry of many Zambians for too long that Zambia like any other sovereign state should be ruled by indigenous Zambians and that’s why when MMD came into power, they enacted the law accordingly.

They were not targeting KK as such as his sympathisers are trying to portray, as he was no longer a factor after he left office in the manna he did, very embarrassing indeed. Was it going to make sense for the country to fail to heed the cries of the people because of one person?

I believe it was going to be utter stupidity on our part, as it is going to be if we go ahead and amend this clause in order to please a few people like Mr Simon Zuka, Dipak Patel and Dr Guy Scot among others just because they are friends to the Post News Paper and Sata.

As a matter of facts even if you say that it was targeted at KK, so what? He did his part for 27 years and it was going to be foolishness on the part of us Zambian if we had allowed him to bounce back, especially where he took us as a nation. At the same time as Zambia lacked people to lead? Please let us as Zambians not be brain washed by Sata and Post News Paper to amend this clause just in order to please the few Indians and Whites.

Time to worship Indians, Chines or Whites is over and indeed time of ascribing wamuyaya to any human being instead of God is over. I am sure if we go ahead and do it even in their hearts, the same Patel and Zukas will be laughing at us as being crazy because have you seen any black person with parents from say Africa who has ever been allowed to stand for president in India, China or anywhere in Europe? Even in the US, president Obama’s mother was indigenous white American. Come on let us be serious!

I repeat Zambians should not be brain washed by those who are enjoying honey moon like Sata, Post Newspaper and them. This is the problem of assuming office through the back door, as a president you will be forced to do even crazy things in order to please your supporters. I tell you fellow citizens, if you are expecting any meaningful development from Sata apart from rewarding his minions, you better think again.

Sata was part and parcel of the people, if not even in forefront of the people who convinced late Chiluba to come up with the same clause, but today because he is in power and he wants to please his supporters they are campaigning for the amendment of the parentage clause.

Is it not the same Michael Sata who has just fired the judges for just ordering Fred Membe to pay back the 14 billion loan which he got from the Development Bank of Zambia in unclear circumstances when the same punishment and even harsh ones has been given to others who failed to pay back the bank the small amounts they would have been owing?

People may be wondering as to why aim mentioning Sata here, it’s very simple. Am mentioning Sata because he was one of the people who brought this law into being and because today his supporters want it changed, he is quite. He wants it changed to please ba Mwenye. What a man mother Zambia has for president?

Anyway if they go ahead and amend this clause in order to please Zukas and Dipak Partel, when ZRP gets in power we will reverse it.

  1. Talking has been turned into an industry or sector in Zambia. If only it were productive we would not be wallowing in poverty. LT please bring developmental topics that will focus peoples mind on personsl or national progress not distractions like this one which FTJ did.     • I totally agree with you … this is not even news worth. The author debunks his own theory at the end. It is more like Charles Darwin trying to convince the entire world about evolution but on his death bed confesses creation has merits and admits could have been wrong.

      This author just wants to create classes of Zambians, that is not what good constitutions do, if I was in charge of LT, I would have asked my editor to delete and/or would not have published this article to start with.

      It appear in the other online new media yesterday and just because it created a lot of chaos does not warranty it being published again on LT just for publicity reasons. Give us something more inspirational, not this garbage.

  3. Elisha this clause has been widely seen to have specifically used to bar KK. Infact it is Sikota Wina who submitted it. Let what the majority Zambians want be included, not just accomodating you and your hatred.

  5. Leadership should not be confined to race, country of origin or creed in any instance. The thinking about the parentage clause should not be drawn from the few political elites like Simon Zukas, Guy Scott or Dipak Patel who presently happen to be victims. This should be about where we are going. It is apparent that in future generations leaders with parents not of Zambia origin will spring up and offer to contribute to the development of Zambia and address the deep economic concerns of many Zambians which some of you have failed to do over the years.Abrogate the parentage clause, let any Zambia who is willing to contribute contribute.If not the parentage clause is not adjusted then also forget about the “dual citizenship” clause because the two kind of go together.

  7. Is it Sata who made submissions or it was the people of Zambia through the the Mung’omba constitution review commission? Any analytical person would see that Mr. Musona has issues with the Post and Sata. I expected him to argue intelligently and objectively as to why the current parentage clause should be maintained in the constitution but he has not done. All he has done is bring out his hatred and racist remarks against the Post and Sata and the Indians.

This poorly written, poorly  reasoned and ultimately dogmatic article fails to take cognizance of the fact that there are several black, Zambian born Zambians with foreign parentage through no fault of their own. The current clause as it stands allows people born abroad but to Zambian parents to stand for the Presidency yet excludes Zambians born in Zambia but to foreign parents from standing. That is not logical. The only people that should be excluded from the Presidency are naturalised Zambian citizens.

    There is nothing wrong in retaining the close even if it was intended to bar KK from standing, as long as it has been found to be good.
    If medical profesionals are handling a patient with a certain condition and in the processes they discover and come up with new treatment as a result of that patient’s sickness, they dont have to throw away the discovery after the patient recovers. They will normally keep the formulate and adopt it for treatment of other patients with a similar condition. They will not say, no we wont embrace it because it was intended to cure that one person initially.
    We need to come out of the box and say, is this a good close for us as a people? If yes, embrace it; if no, throw it away – not because of its initial intension but its value now.

Mr Musona should not subject the readers to his hatred for Sata and Fred Membe, as if the two are ones who asked the Zambians to submit the clause.     SATA cheated the people of WP and robbed them of their valued votes by lying to them that he would honor the BLA.
    Of course, nobody wants SATA to honor the BLA, but of course noboday wanted him to lie in the first place either, that he would honor the BLA. SATA OBTAINED VOTES BY FALSE PRETENCE and that is a criminal offence by our laws. It is a corrupt act, that of dishonesty.
    Even his 90 day policy was pretence to dupe people of their precious votes.

Sata said he will honour the BLA which does not include barotseland breaking away, how then can you say someone lied when the demand that the BLA activists are making are not even part of the agreement. You think you are sharp but you can’t reason.

    Take time to read each judge’s ruling and then your head will open up

  19. I think Zambia should open up and be a cooking pot for ideas and genetic mix from people of whatever creed, provided they are christian and Zambian by birth. It is OK to have someone like Zukas, Dipak, Scott rule zambia if they show the love and passion for this country. Anything wrong with that? As long as they can campaign and be voted for based on a good programme. Remember, the majority of voters are black and indegenous Zambians. They can definately sieve what they would not like to happen in the country. The draft has said that Zambia is a multi-racial, multi-ethnic, multi-cultural, multi-religious and multi-party state. We want to be cosmopolitan but basically God fearing and basically christian as the majority Zambians would confess their faith.

But I don’t see how that makes them less Zambian than I am. My friend Janesh Naik one of the directors of Victoria hospital has a huge Zambia tattoo on his back. So you’re telling me, this learned patriot, lawyer by profession, extremely intelligent and focused cannot stand for public office?? Zambia is the only country that he has has ever known.

  24. Most of you bloggers are misgiuded. The constitution is clear and does not bar any one because of thier skin colour. Rather, the constitution bars those people whose parents were born outside Zambia. Most Indian Zambians qualify to be President of Zambia as most of them were born in Zambia just like thier parents. It is people loke Zukas who dont qualify , but his Children do qualify. Look at it closely, and you will notice that it does not talk about colour. Being Zambian is not just being black.

The fact that he chooses skin colour as the basis for making his point is destroyed by the fact that there are Zambians of different skin tones whose parents ARE ALSO Zambian born so are included in his ‘glorification’ which is then purely racist. What about those whose parents are from other African countries but also don’t have the desired skin tone and lastly those who look ‘black’ but have mixed genes which is common amongst people who have non black grand parents or great grandparents. Within the next generation you will see more non black looking people with Zambian or African surnames. Deal with the growing reality.

I can give him a long list of Malawians, Zimbabweans, Angolans who have integrated and contributed (more than those he mentioned)- why should they offer themselves for the highest office in the land? Arnold Schwartzenegger (Former Governor for California) elequently presents his case for being ineligible to stand for the US presidency when the Republican Party has a bunch of bakolwe like yourself!   37. Mr Alisha Musoma, I don’t know how much you know about our country. If you are honest, can you analyse the parentage of most key leaders who fought for the freedom of our motherland? Not just KK. Include, Kapwepwe, the Winas, Alexander Gray Zulu, Dingiswaayo Banda, Kamanga etc; atc. I can go on and on. They fought and fought until our motherland was free. Mr Musoma you want to reap where you did not saw. The truth infact lies in the fact that, in 1911 there was no Northern Rhodesia nor Zambia as we know it today. You can’t just go to the UK, USA, India, China, etc and try to run for the presidency without either or both of your parents having been born in those countries. So, what’s the problem with Zambia adopting or maintaining a similar clause in its constitution? Scott, Zukas, or Dipak can be government ministers, MPs or hold any other political office, but not the presidency. The U.S is a true melting pot, but one or both of your parents need to be U.S citizen(s) to run for presidency. And you call yourselves intellectuals?     You want to misled the audience here, I have never bothered to read the UK, Indian and Chinese constitution and frankly it is a waste of time for me but as for the USA, the parentage clause does not apply. As long as you are born on American soil, you are an American and can run for presidency. Please gentlemen, get your facts straight. Don’t stereotype and come around with half truths. I repeat, you have given us false information by including USA in your statement and goes against the essence of the very issue you are trying to defend … thanks a trillion

That means my nephew who is born in the US from my brother and sister in law both Zambians citizens can be candidate for President of the United States of America should he choose to and if he won would the first US President of Zambian parentage and descent assuming he is the first one to do so – my little nephew flies around with an American passport while his parents currently use Zambian ones by choice, of course.
