Elias Chipimo calls for the resignation of the Director for Public Prosecutions Mutembo Nchito

National Restoration party president Elias Chipimo junior has joined fellow opposition leaders in calling for the resignation of the Director for Public Prosecutions Mutembo Nchito.

Mr Chipimo says it will only be moral for Mr. Nchito to resign as DPP to pave way for further investigations into the unpaid Development bank of Zambia loan which the defunct Zambian Airways acquired.

He says he is making the call not because he has personal fights with Mr. Nchito or the Post newspapers but because he is a citizen who is ready to stand for what he believes in.

Mr. Chipimo says it is a clear that Mr. Nchito, JNC holdings- a company which he owned jointly with his brother Nchima, and the post newspapers arranged finance from the Development bank of Zambia to shore up an airline they had invested in and of which the money has not yet been paid back.

Speaking at a media briefing in Lusaka this morning, Mr. Chipimo says the appointment of a tribunal by President Michael Sata to look into the action of the three suspended Judges is based upon a complaint from persons considered publicly to be close associates of the President.

He says the big question that should surround the move by the President is not whether he acted within the law or not but whether he used his powers appropriately.

Mr. Chipimo notes that if the president did not use his powers appropriately, the implications of such an action would be considered abuse of his power.

He says whatever the background of the President’s decision, certain questions surrounding the sourcing of finances involving Mr. Nchito, the Post newspapers and the Development bank of Zambia need to be answered if the matter is to be resolved amicably.

“Suspending Justice”

Nearly 4 years ago, I made the choice to enter the political arena. At that time, I made a commitment to myself and to the Zambian  people that neither I nor the party I helped to establish (as long as I would lead it) would succumb to playing “politics as usual”.

There are enough politicians on the scene that are prepared to play by the same old rules and use the same tried, tested and failed approaches of the past and my intention was certainly not to add to their number.

I committed myself to being a new type of politician for our nation – a leader that would not focus on personality, vindictiveness or envy, but a leader that would base his politics on issues; a leader that would always be ready to listen, learn and grow.

I committed our movement, the National Restoration Party, to offering constructive criticism to whichever government would be in power. We set out to do this by acknowledging the positive actions of the incumbent administration and pointing out the things that they tend to do wrong while always offering an alternative approach whenever we criticise them.

4 years and one general election later, I remain as committed to these ideals today as I was then, if not more so.

It is with that same conviction that I speak to you today on a matter that I believe could, if not handled correctly, result in the slow but steady erosion of a vital arm responsible for protecting our hard won democracy: Our Judiciary.

The appointment by president Michael Sata of a judicial tribunal to look into the actions of a judge of the supreme court and 2 judges of the High court coupled with his decision to suspend these Judges pending the outcome of the tribunal hearings, is based upon a complaint from persons considered publicly to be close Associates of the president.

Let me say at this point that contrary to what they or any other person may believe or think, I have no personal fight or any kind of score to settle with Mutembo Nchíto or the Post Newspapers. I am simply a son of the soil who is ready to stand up for the things that I believe in.

My intention is not to grab headlines for the sake of publicity but to touch hearts and help people to see that the change they need lies within themselves; Within each and every one of us that is willing to make a positive difference in the communities in which we live.

From the correspondence made public to date, there can be little doubt that the previous administration (indeed some of the very people seeking to censure Mr. Sata’s actions today) attempted to use the courts and our system of justice to settle political scores With their perceived enemies and political detractors.

To clear some of the confusion surrounding this issue, we can ask a few questions:

Did mutembo nchito, JNC holdings (a company owned by Mutembo and Nchima Nchito) and the Post Newspapers arrange finance from the Development Bank of Zambia (DBZ) – a Government-owned institution – to shore up an airline they had invested in and which money has remained unpaid to date? Yes.

Were they the victims of a plot by the previous administration to discredit them for political ends using this debt obligation? The Evidence made available so far would suggest so.

Does this justify the use of Presidential powers under the constitution to unearth the plot? Probably not.

But if the tribunal is able to clear the air on possible corruption within the judiciary, the ends may justify the means. The long-term implications, however, may be the effect this has on the ability of the judiciary to dispense justice without fear or favour.

We must remember that this is not about whether the president has acted within the law. This is about whether he has used his powers appropriately and if he has not, the implications of such action.

For example, the president clearly has power to forgive any person of any crime. But if he was to exercise these powers to forgive a relative of the crime of multiple murder, this would be considered an abuse of his power.

So barring a legal challenge, the tribunal will sit. Through the tribunal hearings, the public will have a chance to determine if the President has used the law to protect political friends or acted in The interest of removing a strain of corruption within the Judiciary. It is possible that both of these issues are at play (namely that the alleged corruption has justified the protection of the president’s political allies).

Whatever the background to the president’s decision, in order to complete the matrix of facts, certain questions need to be answered:

(1) Did any senior government minister or high ranking Judicial officer issue any directives to the Development Bank of Zambia to stay or suspend proceedings against the DPP (in his personal capacity), Post Newspapers and JNC holdings – persons (or Entities owned by persons) publicly seen as being close to the President?;

(2) If the people lodging the complaint had not been close associates of the president, would he have taken this action?;

(3) Should a person embroiled in such a controversy not be considering his position to continue to act as DPP, especially when the agency responsible for criminal prosecutions and over which he presides has been discontinuing matters against the proprietor of a bank that he or entities in which he has shareholding owe money; money connected to the very case that has prompted the tribunal hearings?

The invocation of the powers of the president to convene a tribunal under article 98 of the constitution is a serious undertaking that should not be embarked upon lightly. In the scheme of things, however, it is probably better to weed out any perceived corruption in the judiciary even if this coincides with the protection of political friends of the president.

We must not Lose sight, however, of the outstanding obligation of the debt owed to DBZ and the need for an impartial conclusion of this Matter.

In the final analysis, if this is the case that helps zambia to begin to cleanse a troubled judiciary, then something positive may yet emerge from this sorry saga.

We just need to be clear that in the cleansing process we do not end up creating such fear in the Judiciary that we damage the parts of it that do uphold justice with integrity and competence.

An inescapable conclusion, whatever the outcome of the tribunal hearings, is that the current DPP cannot in the light of the conflicting position he finds himself in, continue his daily responsibilities in office.

Whether now or in the future, he must resign. At this stage the Very least he should do is stand aside and take leave pending the findings of the tribunal

    • I love Elias, he is a great lawyer and leader of a very promising and upcoming political party. I have met with him and I respect him very much but here is how I see this. This was a business deal between JNC Fimofimo/Post and DBZ. In this business deal, debt was converted to equity even though as reluctant as the DBZ Board might have been. From a risk management perspective, the moment the debt was converted to equity, the same capital infusion became an active at-risk investment and that’s where DBZ ends up losing the case and the trio can easily go scot free. Business is a risky enterprise and the devil is always in the details. If my above assumption holds true during the tribunal, the trio walk and my friend Chipimo’s judgment becomes questionable … hate it but highly feasible.

    • Based on the above and if it happens to hold true, the assumption of the President having abused his power becomes nullified and those calling for DPP to resign are seen in a different light however genuine and/or disingenuous their initial motives were in the first place. If I was an adviser to Elias, I would have asked him to stay away from this all because the pretext is more of a business deal gone bad even if JNC Fimofimo & the Post had ulterior motives during their bail out so their golden parachutes allowed them to land safely.

    • And even if they really had ulterior motives, it would be very hard to prove in the court of public opinion. I may be wrong, I have been wrong before and I am always open to new pieces of info for my deductive and inductive analyses to hold true but from a business perspective, that’s the way I see it … anyway that’s just my two cents as per usual.

    Mutembo’s appointment was rather contentious and it will not go away quietly. Best provide some equally sound answers. Government spokesperson, where are you?

  3. He is saying exactly what the other opposition parties said last week. Why did he want to stand alone? Whilst his intervention is welcome, he should not have undermined the other opposition parties by agreeing to make a joint statement with them and then abandoning them at the last minute.

    • Maybe his thoughts on the matter had not evolved this far. And it is likely the stuff he had to read on behalf of that brainless bunch did not resonate with him or would have stolen his thunder.

  5. One wonders whether the office of the DPP has any code of ethics? If at all such a code exists, it is imperative that members of the public are told the minimum standards of ethical conduct.

  6. This is where I dearly miss our George Kunda and this is a great step up from Mr Chipimo to fill this void.

    George Kunda clearly did state that the current DPP did not qualify to hold that office and people thought he was vindictive and bitter and as democracy would have it, he was out voted and Nchito became the DPP and this is the result.

    Having said that, I still stick to my earlier prediction. This case is President Sata’s ticket to get the POST Newspaper off his back. And I repeat. they don’t call him KING COBRA for nothing. Just watch the space. There is more drama to unfold and make sure you stock up your popcorns.

    • My prediction is Mutembo Nchito will be either asked to resign or will be dismissed. Post will remain intact, probably come out stronger.

      The tribunal against the three musketeers, sorry judges, has dug up a lot of dirt and they will be dismissed as well.

      We have a new day dawning for the legal community in Zambia. Better and regular peer review of judges. Hopefully this purge will translate to better legal services for Zambian regardless of status.

  8. One would have thought a lawyer that he is would know better that Zambian Airways had a separate legal identity from it’s directors. I was the company that borrowed the money not Nchitos or Fred. Besides, was it not the MMD under Dora who closed the airline at a time it’s balance sheet still showed it was a viable ongoing business entity? The MMD did the same with Zambia Airways when Chiluba declared them bankrupt when their asserts were clearly still more than their liabilities. Maybe instead of asking Nchito to resign, this silly lumpen Chipimo should ask Sata to set up another CM to investigate Dora’s role in the illegal closure of Zambian Airways!

    • Mutembo made personal guarantees for the loan and Mmembe ‘s post made a guarantee as well. Mutembo is appearing in the case also in his person as a guarantor.

Here in JHB, the equivalent of the DPP was forced from office (thru opposition court action) bcoz of his questionable past. But in Zed, some1 with questions hang over his head re LAZ disciplinary action and a pending court case can b a DDP – can an accused prosecute itself, what happened to ethics and morality!!

And the out spoken lawyers who think that they are mature at law have been exposed and they should feel ashamed for not being first to come up with such erudite thoughts. In short the president is wrong to act in the manner he did just to redeem his defaulting associates. This is nepotism which is another form of corruption. Indeed it is not easy to govern a country of zambia’ magnitude. You can fool some people some times but you can’t fool all the people all the time…..

I do not agree with chipimo.While it may be true that those two guy owe DBZ money, it does not justify that procedures should be ignored. Definitely at one time or another they have to pay but that does not mean judges should deliberately disregard procedures within the Judiciary. Try to put yourself in the position of Judge Wood.How would you feel if the case you have been handling for years is taken away from you without following procedures. That will bring anarchy in the Judiciary, judges will be grabbing cases from one another depending on ones interest.

  16. Take all these questions and what ever evidence to Judge Chikopa’s tribunal. That is where THE FIGHT WILL BE FOUGHT and decisions will be made not on LT or QFM.

  17. Muchinga Member of parliament who is also former vice President George Kunda indicated from the onset of his debate that opposition MPs were opposed to the appointment of Mr Nchito as DPP stating that there is a negative perception and dark crowd hovering over the character of the nominee.
    Mr Kunda wondered how parliament could go ahead and ratify the appointment of Mr Nchito when investigations into the allegations against the defunct Zambian Airways of which he was Chief Executive officer have not been completed.
    He said the danger with going ahead with the ratification is that the PF government might in future reopen the inconclusive cases against Mr Nchito to blackmail him as DPP.

  20. I am a bit dissapointed with Elias Chipimo’s bias here. Why does he keep mentioning Nchinto as owing DBZ as if he was a sole trader. If a company owes money it does not mean that the directors owe money directly. He should really dwell on the cleanness of suspended judges.

    • But then you can personally guarantee a loan on behalf of the company. As a guarantor you are liable the company fails to pay the loan!

Now, a word of advice…don’t just ‘click’ with the learned, find a fomular to click with the grass root, the Kaponyaz and the uneducated. Unfortunately, these are in majority and are comitted vorters. The educated analyst sits on his chair and analyses isues in a sober manner, but has no time to vote.

  32. My dissapointment is with the whole system of governance in Zambia. How does a guy with a big dark cloud over his head get appointed to be DPP? Only in a banana republic. That is why people need to be vetted before their appointments are finalized! In many countries one can not even get a job or any contract with such baggage.
    Coming to the President. As Chipimo has ponted out, he misapplied the law although the letter of the constitution may seem to be in support. Laws are supposed to be the last resort after corrective measures have been put in place. In other words, they are the limit of what the President can do and thus the action of the President suggests that he lacks competence on how to govern. If using the constitution daily will be the norm, then why have a President?

Though invoking legalities, his rhetoric comes as an afterthought; leading from behind; waiting for others to do the heavy lifting.  If the object for his unilateralism was to make him stand out from the rest, then the act stands out as a failure. E Chip J is devoid of the real political leadership niche. Basking in his dad’s glory alone isn’t enough. Most of his positions on controversial issues by the government, have been nuanced to say the least. He is devoid of the real political knockout speech-punch to push him above the fray.

What circumstances lead to Judge Wood to recuse himself from the case? Do we have mafias running our judicially in the pretext of Honourable Judges. DBZ sued the Directors than the Company, Why? Then why was the Corporate Veil not lifted before judgment, if DBZ sued the Directors than the Company? These are the circumstances that have left us wondering whether our Judicially is not curtled by Mafia arrangment and how did the President act swiftly when his acquaintances were ruled againsti the judgment in the pretext of Complaints from the Public?

    Sometimes its better to shut up when u do not know anything. The company borrowed the money… the directors stood surety for the loans. If the company can not pay the directors become liable for the loan.  You do not need a law degree.

    Thirdly, Chipimo has stated that though in the case of Judge Mutuna, the parties involved are allies of the president the outcome of the tribunal may justify the president using his powers. Then, how about Judge Philip Musondas’ cantakerous behaviour of dismissing Judge Dennis Chirwas findings against Dora Siliya despite the tribunal clearly stating that she should have been prosecuted? Finally what was Judge Musonda doing at Chimbokaila with Mohan?

Nonetheless this is good and for me, I will follow this party with Keen interest. You may have just recruited a member here. However, I have to seek clarity on the point he makes suggesting that there is evidence of the previous administration using this case to discredit M’membe and Nchito. What evidence is there? From my point of view, any interest from the administration in matters where loans to a magnitude of K14billion of public funds should be a welcome intervention and should not be viewed as political interference.

Did the three judges take away the case from Wood without the consent of the CJ? In any case, I thought the High Court of Zambia has an officer responsible for assigning judges cases? If Zambian juges have to fight for cases to handle like sharks in a frenzy for a piece of flesh then the Zambian judiciary is in a state of utter confusion.

  52. Its not just the loans that Mutembo Nchito borrowed… its the departure fees that he collected on behalf of the GOVERNMENT, that he never paid up. If this is not criminal I dont know what is. Mr Sata where is the money that Zambian Airways collected on behalf of the people of Zambia…? Where is it?

  53. Some people say “Friends have regrouped” others still say something else about these guys that have regrouped. They called others thieves etc, but then what they did to DBZ is daylight robbery by using their third force power to obtain tax payers money from DBZ which they want to protect so that they don’t pay back. Clearly this is daylight robbery. Mr Sata should rise above all this and show the people of Zambia that he means business when he declares that he wants to fight corruption. Some of his own close supporters, associates whose cases of corruption are a matter of public knowledge, would like to be shielded at any cost. This will be acid test for Sata’s genuine commitment to one of his commitments he made before going to plot 1.

The President HE MCS has provided an excellent forum for those with incriminating evidence to go and lay it bare. Whether it is for or againist the suspended judges or for/againist Nchito and membe. Wild innuendos on radion and websites WILL NOT PRODUCE ANY TANGIBLE RESULTS. VIVA PF. investigate more judgesand even magistrates actually corruption is rampant in subordinate courts

  56. Am inclined to agree with you Mumba Snr. 1. Former DPP refuses to allow for FTJ appeal by state, they call for his resignation, he did not. Precedence set. 2. Resignation of Mutembo is setback in convicting the plungderers, Sata was voted for that reason, opposition calling for resignation of DPP are protecting alleged corrupt judges and suspected plunderers hence decampaginng themselves, are they doing it for the love of Zambians or are just bad losers trying to make things hard for HE MCS? Ordinary Zambian voters are likely to see the later, mark my words non of these guys SHALL EVER ASCEND to PRESIDENCY, Zambians are watching. GOD BLESS ZAMBIA.

  57. This is a clear case of cronism and protectionism by the president. It is appreciated that the suspended judges may have cases to answer, but his support for the Mmembe and the Nchitos is suspect, warped and flawed. The “three muskuteers” have owed money and must pay. They must not use their relationship with the president to evade paying their dues. The president is being very naive by listening to the three men. He will end up with egg in his face if he continues on this trajectory.

  58. We informed Zambians of Mr Sata’s deficiency as an effective president of Zambia. A certain class of our nation hailed highly the going of Sata to plot 1. To them he was the saviour, more money in their pockets is mantra they believed. Others who had known the character of Sata simply warned fellow Zambians for hard times of coping up with 20 years back. So far Zambians have changed their perception of Sata as a leader but a dictator in plot 1. Currently he is destroying the judicial system started with questionable appointments in the legal system. Next Sata will have sweeping powers typical of any DICTATOR known in the world. We all know how a govt motel in Kasama was donated to the Catholics at his command. Donated fuel to Malawi as if his personal resources. Who will question Sata?

  61. The headline of the on-line post edition makes interesting if not worrying reading. The post is suggesting that they have access to the chair of a tribunal set up to investigate a complaint from their editor in chief. What questions does that raise? and how did the post manage to get hold of his contacts. Did it not occur to the post that it will be prudent for the not to interfere with the Chair of a tribunal set to investigate a matter where it’s owner is a key complainant? Equally some of the questions they have asked come across as a desperate attempt to calm those of us who rightly think that this Judge will not be impartial. what answer do you expect from anyone, if you asked them whether or not they will be impartial? Hope the three Judges have seen this and are able to question..

  63. Just have patience and wait for the outcome. It is too little, too late for all the rantings here either for or against. Believe me you a Pandora box is about to be opened and soon we shall come to know the dirty surrounding  the entire system. I can bet for sure that if the tribunal will be objective and free from interference no one will be vindicated. JUST WATCH.

  66. Yaaaa…. Awe mwwandi, pipo can talk! But let me be very sincere here. It’s a well known fact that our judiciary is corrupt. We’ve bn talking abt it for sometime now. Even the opp guys know that. What we need is to let the tribunal go on with or without mutembo resigning coz it’s independent and the result will show all those that were party to the scam. This time only we won’t allow the implementation of the Denis Chirwa tribunal. We need to ensure that the victims be shown the exit regardless of their relativity to the appointing realm. And it will show just like it did on Dora and that is where we shall act from….Ladies and gents, we wait for outcome
