Calls for Chief Justice to go tantamount to anarchy – Mtesa

Zambians for Empowerment and Development (ZED) president Frederick Mtesa has warned that calls to have Chief Justice Ernest Sakala resign are tantamount to promoting anarchy in the country.

Dr. Mtesa says he is against the calls for the resignation of Justice Sakala because he believes in the rule of law.

He has since challenged individuals calling for the resignation of Justice Sakala to produce tangible evidence against him and follow the right procedure with the appropriate institutions.

Dr. Mtesa says it will not be beneficial for the country if people just wake up and make demands without following the right channel stating this will only promote confusion.

Speaking to QFM News, Dr. Mtesa says character assassination will not help in achieving the desired judicial reforms.

A number of stakeholders, with the latest being the Judicial and Allied workers Union of Zambia, are calling for the immediate resignation of the Chief Justice to pave way for the long awaited judicial reforms.

  1. But views to be aired must be divergent not in support of the ruling party only, the others you threatened with arrest of something. It will not support the freedom of speech.

  2. There is nothing one gets from Mmembe and his Post plus tandem of crooks other than character assassination. Mmembe is paying all these so called organizations calling for CJ’s resignation, recall that he started it soon after Sata won the elections and has been saying over and over again. Mmembe is the devil himself in our midst.

    • Post-Mmembe and DPP NCHITO are becoming so dangerous to Zambia&society…. When it suited them they used Justice Sakala after influencing Mwanawasa to sort out Chiluba after removing Justice Ngulube who refused to sort out Chiluba.Now that Justice Sakala has stood his ground after discovering how Mmembe&company blackmail authorities, Justice Sakala has now become an enemy of these crooks especially after the 14billion DBZ JUDGEMENT that has gone against them. They want him out so that they bring in Justice Mambilima as CHIEF JUSTICE and Judge katenekwa(copper belt) or their hitch men to rape this country Zambia with resistance from Legal minds. More especially that parliament has their friend-Matibini,so is the Executive, DPP and now they want Judiciary in Mmembe-Nchito’s hands….

  3. I totally agree with Mtesa. Leave the honorable chief justice alone for he has don enothing wrong to deserve such partisan calls.Any meaningful reforms should carter for the entire government wings of Executive, Judiciary and parliament and be extended to trade unions, Unzasu, , NGOs, MISA and LAZ. The arttoney general, solicitor general, DPP, ZP, Army, Airforce etc must all be reformed. partisan calls by UNZASU, Sylvia masebo and others is not only shameful but dangerous.

    • Problem you seem to miss is that WHAT NEEDS CHANGING IS THE ZAMBIAN MENTALITY!! If we want anything reformed, we should have a yard-stick!! In this case the Constitution! YOU CAN’T REFORM THE JUDICIARY BY USING SHORT-CUTS!!! We have been let down by the AG, SG, Min of Judiciary, LAZ etc!! IF WE DON’T FOLLOW LAID DOWN PROCEDURES, even the most crooked judges will get away by FINDING FAULT in their process of PROSECUTION! SO FAR,the LEGAL FRATERNITY IS IN DISARRAY – the law is there in black & white, BUT they seem so miserable in making heads or tail of what right PROCEDURE IS!!We really have to be totally st.upid to believe that we can prosecute these judges on a whim if WE CANT INTERPRET THE LAW – talk of trying to corner an expert in Law – THEY SPEND MORE TIME INTERPRETING IT!

  4. I need to be educated by anybody. Isn’t the Chief Justice cerrently serving at the President’s pleasure since he is on extended contract beyond retirement age limit? Hasn’t President Sata got the power to terminate an extended contract?

    • He has the power to abrogate his contract…but on what grounds? has he been involved in anything scandal? Any evidence out there?

    • @Sharp Shooter – That is the whole pint @Mbo Sam is making. He is serving at the pleasure of the President and he is beyond retirement age, Therefore, he does not have to do anything wrong for the contract to be terminated.

  5. THE CJ MUST GO. THAT IS THE ONLY SURE WAY OF GETTING RID OF CORRUPT JUDGES. YOU SEE THEY HAVE ALREADY APPEALED AGAINST THEIR PROBE AND SUSPENSION USING A JUDGE WHO IS PROBABLY ALSO CORRUPTED. THEY MAY HAVE WARNED HER THAT “WE WILL NOT GO ALONE”. OR THAT ” WE WILL SPILL THE BEANS”. HENCE THE FEAR. THE SYSTEM IS SO ROTTEN THAT YOU HAVE TO CHOP OFF THE ROTTING HEAD. EVENTUALLY THE ZAMBIAN PEOPLE WILL WIN. LETS PRAY FOR THE PRESIDENT AND THE COURAGE HE HAS SHOWN TO ROUTE OUT CORRUPTION AMONG THE MEN HIDING BEHIND THE WIGS.
    THE BATTLE IS NOW BETWEEN THE OPPOSITION WITH THEIR CORRUPT JUDGES VERSUS THE ZAMBIANS WITH THE PF.

  6. @CHISENGA You need to bring facts up when blogging of specific currupt practives by the Judges and not just blowing the trumpet with no specific facts. You urgument sounds empty and a case of going with the wind…just because someone said so then it is true….same as me saying you are also corrupt without facts. We need to be specific then it will easy for zambinas to support you otherwise some people simply think all is retoric.

No one is against judicial reforms but to initiate reforms because of friends in the name of mmembe and nchito is what alot of us are failing to swallow. Moreover these guys owe a govt institution alot of money that they got by false pretence that their air was viable when in actual fact it was insolvent

Why are people suggesting of the vacation of CJ from office?Is their suggestion based on vindictiveness or out of vengence?I have heard others who are saying he has to vacate because he did not greet Sata,by then an opposition leader.I have liked the maturity of HEMCS.He has not taken any stand concerning the judiciary.He has just appointed a tribunal within the confines of constitution.The man is not vindictive like his precedessor.As people are advocating for the transformation of judiciary,we expect maturity in place of puerile thoughts.If one does not have anything to say,he/she should keep quiet.People want ideas of transforming the judiciary so that it dispenses fairy.Those who want fortification of judicial services, should come up with better ideas and solutions.

  10. If Judiciary reforms are intended to improve performance of Judicial Officers then the objective will not be achieved by the anarchy currently orchestrated by those with hidden motives. The hullabaloo being witnessed now is driven by people who want to divert public attention from the DBZ loan to Zambian Airways over which Mr. Justice Mutuna passed a verdict against those who are able to pull strings. As far as I know the Chief Justice’s extended contract of service ends in August this year. What will be achieved by hounding him out of office now? Clearly, this latest maneuver can only be aimed at intimidating the judge(s) presiding over the DBZ loan matter and associated cases, ie, the Judicial review and tribunal. Zambians should be wary of master puppeteers.

  12. the call for CJ to go is part of a long term plan to have the justice system under control by powers which be and invested in Mmembe by defaulty. All the names in these key institution should be in line of Nchito, Mwenye, a Bwalya or so for CJ will make the plan complete.

  13. The truth is in Zambia today with these current judges you can get away with murder as long as you have a brown envelope to pass on the judge hearing your case. Remember Sydney Chileshe the Chamba growing guy who was director at ZEGA, he nearly got away with growing acres and acres of Chamba in Makeni and yet a time and time again we hear of the common man on the street being slapped ten years for having just a few grams for his own use..Sydney Chileshe was initially given a 5 million fine but for public outcry and pressure from Levy he was eventually given ten years. Shouldn’t we all be subject to the same laws.. The Mark Mushili judgement was also not right, community service for fraud . How many odinary people areslapped with heavy sentences coz they cant bribe the judge..

  14. People the reason why the CJ must go is because he presides over a corrupt judiciary. He has failed lamentably to exert any sort of decency and justice I the way the judiciary conducts itself. I think Mtesa has it all twisted. Keeping the current CJ is what will bring anarchy.

    • Finally, somebody who gets it! Nobody needs to provide proof of what he did wrong. By virtue of him being CJ, he has to take responsibility for a corrupt judiciary and resign on principle.

MCS be warned, you will go down in disgrace as the first President to cause a civil war in Zambia!! No one has a monopoly of intelligence and there is more than one tribe in Zambia!

    • Looking at the speck in your brother’s eye when you have a tree growing out of your own. First get rid of your own tribalistic attitude that is evident in your comment before you can start accusing others of tribalism. The CJ issue has nothing to do with tribalism, so where did you get that from?

  17. These monkeys just want to bastardise the country. With these monkeys things will get worse before they get better. I am quite confident that their day of reckoning is just around the corner. Karma is a great leveller. The world is littered with dictators who thought nothing could stop them until they were undressed and disgraced!

  18. The corrupt from the executive and legislature are taken before a Judge. The next constitution should be explicit on what to do with a corrupt Judge. Any suggestions since currently it depends on who is talking for or against.

    • Rational Man.
      This is indeed rational. We are to uphold democracy – of the people, for the people, by the people. The President is elected, MPs are elected, judges are not. Judges are supposed to be independent?!!! Where did this “Power to the judges” come from? The constitution? Something should be done about this in the new constitution, otherwise some quarters will continue to think only non-judicial powers can be corrupt.

It started with Chiluba, bring evidence until corruption reached unprecedent level and hard to control, Mwanawasa tried but only few cases were prosecuted successfully the rest were deliberately delayed by the judiciary. Take for eg. the case of former fugitive Xavier Chuungu who was nearly appointed by Sata by mistake because of delayed justice,who do we blame CJ being the head.So Mtesa people of Zambia are not silly for demandig the resignation of CJ Sakala.

If this process of cleansing the Judiciary of undesirable elements is genuine, then the DPP should be the first one to go…His record is TAINTED in the light of his pending case vis DBZ vs JNC & POST. Its ridiculous to expect an individual of his standing to dispense his duties without hidden selfish agendas…

  21. Last I checked accusations have been flying left, right centre on the Judges being corrupt and yet no one has even been found guity. Allegations based on hatred and the fact that Judges once appointed ultimately they stay as such until retirement or death – rarely as a result of being fired. Accusation of corruption based on previous judgements not going the Public views way is utter nonsense. If anything the Prosecutors of which the current DPP was the main prosecutor with his brother, failed lamentably to prove the cases beyond reasonable doubt and yet some of you expect the Judges to just follow public cries!!! Count to 10 and absorb and understand my contribution without rushing to name calling

      I counted up to 30.
      1. Judges are not immune to corruption. 2. Judges being appointed for life is based on some deception on The People by lawyers (Sorry guys). This comment is not based on hatred. Lawyers basically put in the constitution what is good for themselves. 3. Judges here have convicted a wife for receiving stolen items from her husband and later acquitted the husband of theft. 4. If there are measures to check everybody, who checks the checkers (Judges)? I guess … judges!!!

  22. Mutesa and some of the bloggers have short memories or are perhaps just plain st-u-pid. Why support the most corrupt judiciary that Zambia has ever seen? If I had the opportunity I would kick the mother F***  CJ’s  a-r-s–e to kingdom come. I cant stand this MF of a CJ. he is so f–u–c–king arrogant. anyway the consolation is all the F–U–c–kers will go whether they like it or not. 

  23. Insulting is a sign of reduced capacity to reason. We are aware of the targeted end result of having a justice system which is Muchinganized. Ask RB he did the same and it did not settle well with the public. Even when one tribe is happy and vocal, what about the rest? They Should just contribute to the tax for only a certain tribal line to benefit?

  24. That other people have realized what a liability CJ Sakala is speaks volumes about how tolerant MCS. The president has every reason to kick out the CJ who had no problems dinning with convicts (Regina) but had problems shaking hands with opposition leaders. If it was ka under five HH who was snubbed at the Cathedral by refusing to shake hands the way Sakala did to Sata, would he be in office today?? People are calling on CJ to go, because they have seen how toothless he is in managing the affairs of the the judiciary. So much dirty has been swept under the carpet in the judiciary over which he is the CEO

This country is in trouble because there is a clique that wants to take over the country.President Sata is just a proxy the man does not know he is being used,the have already taken over the executive the DPP is in their pocket what remains is the judiciary.when the take over the judiciary the they will run the country as they want.They will accuse you of corruption and the will arrest you and they will take you to court and you will be convicted because everything will be in their hands.Any one who crosses their path they will deal with and a lot of you don’t see the matrix playing out here because you are consumed with blind loyalty.

    • I dont think anyone can call “ngoshe” a proxy. Push the spitting cobra to far, it will bite like hell. Anyone who wishfully think Micheal Sata can be played with, do not know the man. He has allowed the CJ to continue out of goodwill and because he does not want to seem to be vindictive by undoing everything RB did who by the way extended the CJ’s contract. But it would be wrong for anyone even for a second to take his/her eyes off the cobra, for it will strike so fast.

  27. CJ is not OWING the state, how come he is the one to resign yet the same characters are mute about the one owing the state. If the judiciary headed by the CJ acts to protect public property is being accused of being “corrupt” in doing so then I wonder who is corrupt. Should the judiciary act carelessly about our tax money? When did getting away with public funds ceased to be wrong?

  28. How FREE do you think the CJ was under MMD when he refused a simple greeting from MCS while in opposition? Most would have resigned by now. What is wrong with our CJ?

  33. Countrymen, let us be sober. Security of tenure is critical for the judiciary. There is a process to remove a CJ – let’s not repeat Ngulube mode. Handshake refusal is not corruption, by the way. A politically scared judiciary is as bad as a corrupt one.

  36. Typical symptoms of grandiosity that can be observed in your typical autocratic ruler/megalomaniac like Micheal Sata are:
    • Through his friend, Mmembe, Sata is continually claiming for attention and admiration
    • Typical of snakes, Sata is cold and uncaring behavior toward others
    • Other people are seen only as an extension of the self to be manipulated and/or eliminated as needed e.g. nevers mumba ; an inability to relate to people as people or separate from oneself
    • Inflated/exaggerated sense of self-importance.

  37. The real disappointment in PF government is Guy Scott because he has failed to advise his illiterate friend that in Great Britain no British Prime Minister has suspended or recommended for any judge to be sacked in over 100 years.

There is plain evidence that DPP-Nchito abused public funds,can those calling for CJ resignation give me one plain evidence of his corrupt activiites.You can not wholly attribute indecent behaviour of children to the father.The judiciary has now come at cross roads,and this time around we are going to have the most compromised Judiciary in our history, and history will judge us.Lekeni Ukwa ateke.
