Ruling on the quashing of Andrew Banda’s case postponed

The Lusaka magistrate court has deferred to September 7, the ruling on whether or not to quash Andrew Banda and Italian businessman Antonello Locci indictment.

This follows the absence of Lusaka chief resident magistrate Joshua Banda who was earmarked to deliver the ruling on Tuesday.

Magistrate Banda is said to be attending a meeting in Siavonga.

The defense has applied that Andrew Banda and Antonello Locci’s indictment be quashed.

The defense lawyers have argued that the indictment is illegal as it was effected under a repealed law.

The defense has also described the indictment as illegal but Director of Public Prosecutions Mutembo Nchito has dismissed the contention by the defense lawyers.

Mr. Nchito says it is settled that investigations cannot be discontinued on grounds of repealing the law on which the accused were charged.

  1. Saki, you are also becoming an accomplice too. If he didn’t steal or whether the law that applied has been repelled, umulandu taubola even if governments change. I take it just like the removal of the abuse of office, this was also done to protect the MMD and their offsprings. Kuja mwaja, there’s a new sheriff in town. Nga tadumine “sagan” Andulu, let him prove his innocence instead of running to quash the case. At the end of it all Saki, the money that you have made and keep making defending all kinds of criminals, will come to haunt you. And don’t blame the zambian people for your greedy when the time comes. You are a disease to the practice of law.

  2. so Magistrate Banda didnt know that he would attend a meeting in siavonga when the hearing date was set. thats waste of tax payers money. i would expect learned people to be proffessional.
