Zambian to Adjudicate on China, US, EU & Japan ” Rare Earths” Trade Dispute

Former Zambia’s Permanent Representative to the United Nations World Trade Organisation (WTO) in Geneva, Ambassador Darlington Mwape, has been selected by Members of the World Trade Organisation WTO, to be part of a panel of three experts constituted with the mandate to assist in resolving the trade dispute between China on the one hand and US, EU and Japan on the other.

The panel has been constituted at the request of the US, EU and Japan. The three parties have complained to the WTO that china’s measures on export of rare earths, tungsten and molybdenum increase the burden and cost of export and constitute a violation of China’s commitments under WTO Agreements.

However, China contends that the measures introduced are aimed at protecting the environment and achieving sustainable economic development.

Rare earths are used mainly in the electronic industry and are becoming increasingly important in green technology such as hybrid and electronic vehicles.

The other two members of the panel are Mr. Nacer Benjelloun-Touimi of Morocco (a former WTO Ambassador) and Mr. Hugo Cayrus of Uruguay.

Panels of the WTO are the first adjudicative body to the cases, to assess the evidence and legal issues raised by the case and are required to reach decisions that often affect international trade between the parties concerned.
Ambassador Mwape, who is former legal Advisor to the late President Mwanawasa, is also currently presiding over negotiations on Copyright Law at the World Intellectual Property Organisation ( WIPO) in Geneva, Switzerland.

And Government, through a statement released by the Ministry of Information and Broadcasting Permanent Secretary Amos Malupenga to conveyed hearty congratulations to Ambassador Mwape on his recognition by the international community to undertake this high profile assignment.

Mr Malupenga said that this was a source of great honour and pride not only to Ambassador Mwape and his family, but the nation as whole.

  2. represent your country in good faith…you have been selected to be on the panel because of the peace that prevails in zambia and they expect an unbiased input…congrats man.

  3. Ambassador Mwape, Make us proud, congratulations, tho I am not surprised, Zambians usually excell in the international community adnwe easily take up leadership roles. Because of our likeability, other countries find it easy to accept Zambians in such sensitive assignments!!!

    Now to help our fellow PF cadres like number #2 who have a challenge to read, understand and later on research, let me break it down.

    China produces over 90 % of “rare earths”. Basically, this is  a group of 17 elements used in Defense, Electronics and Renewable-Energy industries.

    So what China has done is impose restriction on who can mine it in China and basically kicked out small miners in the industry. The consequence of this is that Production from the small efficient mines in  will be taken offline. In Economics , this can only mean one thing. Prices are going up.

    And Everybody is asking China to reverse decision so prices go down. China says,  hell no, we protecting our Environment, the rest you know.

  6. Ewaletoba kuli chi Maureen you, I am sure achili aletoba nanomba. Anyway this was an official arrangement since the big man was too ” busy” for the big job. And also that his heart could not be exposed to fast pumping under the big job, hence he was advised by the doctors to completely stay away from the big job, as a result Darling was tusked to do the big job on behalf of the Presido:)

Please lets be serious, infact the worst adjidcator is from zambia, morroco and ruguay are better and that Mwape is a drunkard, promiscous and un cultured, please Mwape u can do better by withdrawing

  9. Ya; Zambians make me laugh at times. Congratulations to Mwape; great!! But what have you been saying about the Malawian Judge? See!! All sorts of insults forgetting that the guy was brought to do his job as a professional. Insults can be directed at the person who appointed him; but not at the Judge!! What goes around comes around. Start respecting professionals, and you will see change in Zambia. Most of us professionals are called all sorts of names in Zambia; yet abroad people look at us with envy!! I guess such is life!!
