Police want to arrest HH for issuing disparaging remarks against President Michael Sata

Zambia police have continued their pursuit for opposition United Party for National Development (UPND) leader Hakainde Hichilema to institute an arrest. Mr Hichilema is wanted for allegedly issuing disparaging remarks against President Michael Sata during his tour at Lusaka’s Kalikiliki market.

Police spokesperson Elizabeth Kanjela could neither deny nor confirm whether Mr Hichilema was facing arrest.

“I am still waiting for a full report. So at the moment I cannot give you a comment,” Ms Kanjela said.

But police sources said some officers yesterday visited Mr Hichilema’s residence in Lusaka’s Kabulonga area to effect, an arrest but he was not available.

On Tuesday, officers approached Mr Hichilema who was appearing in a courtroom to serve him with the callout but their attempt was stopped.

Mr Hichilema’s lawyers protested against Police presence in the courtroom to issue the callout, which raised an exchange of words between the parties.

Mr Hichilema was at the time appearing for charges of conveying false news.

Meanwhile, the Lusaka magistrate’s court has officially temporarily halted the criminal proceedings against opposition United Party for National Development (UPND) leader Hakainde Hichilema following an order granted to him by the Supreme Court.

In the criminal matters Hichilema is facing one count of publication of false news with intent to cause fear and alarm to the public.

When the matter came up for continued trial yesterday before chief resident magistrate Joshua Banda, defense lawyers applied to have the matter stayed in view of the order by the Supreme Court which stated that their client’s criminal proceedings be stayed.

“I now halt the criminal matters against the accused person following the order by the Supreme Court to do so pending further determination by the higher court,” said the chief resident magistrate.

Supreme Court judge, Munyinda Wanki during the week directed that the criminal proceedings against Hachilema be stayed pending determination of the Constitutional issues currently before the High Court.

Judge Wanki has since set January 24 this year as the date for hearing of the application on behalf of Mr Hichilema to set aside judgment.

Through his lawyers, Hichilema had applied before Chief Resident Magistrate Joshua Banda for Constitutional reference of the indictment for the determination of the Constitutionality of the said provision of the penal code but magistrate Banda refused the application.

Hichilema on January 11, 2013 however appealed to the High Court asking it to stay the criminal proceedings against him but the High Court declined the application without stating reasons.

Hichilema further decided to take his matter to the Supreme Court where he now had been granted an injunction.

The matter was adjourned to February 15, 2013 for continued trial.

    Can you please open an occurence book at the secretariat here all these ubuses will be recorded as well as the perpetrators.all policemen involved in this stupid actions must have their names written down.the hour to reckon will soon dawn.their will be nothing like we were working under instructions.each one knows his bounderies of his duties.this book should also extend to ordinary people who are being abused by the cadres in their locations.please take this advise seriously.we have no police to protect us so it`s only after we rediscover our freedoms are we going to prosecute our abusers

    We had one of the best President under our party MMD to ever occupy State House. He put cadres in their place and brought sanity to governance and application of rule of law in Zambia.

    Some people who are in privileged positions today persistently and consistently called him Cabbage or vegetable. They even went to the extent of taking cabbages to political rallies and slicing them.

    Did our great president ever unleash the police on them? No
    Is the constitution under which he operated in different from the current one? No

    I’ll l leave it at that

      You are right, Mwanawasa was the best Zambian president to date. He understood democracy and the rule of law. He never abused the police like these kaponyas. It is only once that he lost his cool at Ndola airport when he warned Sata with the words, “nga utumpe apa pene fyalakubipila ifintu”. He never unleashed the police on to the opposition leaders despite the foul mouths of some of them. Zambia should have made positive strides had he not left us to be with the Lord. We miss you LPM.

    Much as we agree that there is a law on defaming the President, there is absolutely no need to presistently persue hamless HH for a one-off contemptuos remark.
    We must cultivate a higher sense of tolerance for our political system to mature and flourish or we forget about multi-partism.
    Govt is better off ignoring such rantings from HH. He has no political clout to cause any worry to any govt.
    Our country is faced with huge challenges to waste resources on such trivialities.

    Zambia consists of 65% rural population and 35% urbanized population. The majority of our leaders have a rural orientation. Theres is world where they are subjects and not citizens, without rights and responsibilities. Service by the state is a gift to them from some god or earthly government gods. To me its a basic right as i pay taxes.

    Perhaps the inventors of democracy(Greeks) where correct in restricting voting to landowners. unlike this universal suffrage that allows pipo to vote on the whims of their stomachs.

    As soon as Zambias discover the identity of the person(s) who are directing the Police Service to malfunction with the aim of terrorising the people, the fate of such mischievious politicians will spell life-long misery after 2016. It is strange that when the rest of the world is striving to perfect ways of improving civilized welfare of the people, Zambia is being seen to be reverting barbarism.     2016 am seeing no proper arranged elections bcoz SATA will never accept defeat as RB did, am appealing to UPND, MMD, NAREP, ULP, ZDDM and these other political parties unity and make one political force scare SATA now, as long these parties remains fragmated like there are now, SATA will take advantage and manipulate the whole electoral system in 2016, plz especially UPND should swallow its pride and come on board with other parties otherwise am seeing Zimbabwe elections in Zambia WITH sata on helm of power, bcoz this man does not respect the rule of law, he is the worst dictator

Your demented leaders should concentrate on providing for the people such as ensuring fertiliser under FISP reaches farmers than on propaganda.     Our Memories are indeed short, Sata insulted Kk with the un printable words at woodlands stadium during the MMD(1989) rally and no one arrested him, he has in the past called LPM a cabbage he called Masebo a lady who had no brains at all, he held countless dark corner meetings with his fellow worshipers during both LPM and RB’s rule and no one touched him. His colleagues in the opposition holding party meetings are arrested, he has imprisoned all his opponents except his XXXX lickers The question is who does Sata think he is? Is he bigger than Zambia? When did this man become a saint? Even if he was one he should not drag this country into arnarch. Dictatorship will only tear our lovely country into pieces. His heirs will be hunted like wild foxes if he is not careful.

    I have read with sadness how you dogs can insult the head of state. You are just a bunch of dull envious lot who can NEVER ascend to the position of president. If you think you are intelligent, why are you not in state house? The answer is clear, you cannot be equated to Mr Sata. You will insult him morning, day and night but you will not remove him from state house. You can pray dangerous prayers, God will not hear you because He is the one who appointed him using the electorate. Please don’t even bring in the Man of God TBJ. The prophecy was not pointed to anyone or Africa. It was general. Even if Mr Sata died today, HH, Nevers, etc would not be the ones to take over state house. So keep dreaming and hoping. RB, RB, we are slowly closing in and very soon we will show you.

    THIS IS INTERESTING. A PERSON WHO IS EDUCATED SHOULD DESIST FROM INSULTING. SATA IS SAID TO BE UNEDUCATED, AND YET THE MAN SEEMS TO BE MORE KNOWLEDGEABLE THAN THE ONES WHO THINK THEY ARE EDUCATED. IF HH INSULTED THE PRESIDENT , LET HIM PAY FOR HIS SINS. THERE IS NO ONE PERSECUTING HIM. IF SATA GOT AWAY WITH IT, THATS NO EXCUSE. ARE WE GOING TO DO WRONG SIMPLY BECAUSE ANOTHER PERSON DID SOMETHING WRONG AND HE WAS NOT ARRESTED?
