We are not ready to take RB immunity case to Parliament, MPs wont support it-Sakeni

Chief Government spokesperson, Kennedy Sakeni has said that Government is not ready to take former President Rupiah Banda case to parliament because the Government needs to put the facts  together, adding that MPs cannot support the motion unless they are given convincing reasons as to why Mr Banda’s immunity should be lifted

Mr Sakeni said that Government will will tread cautiously before it can recommend that former republican President Rupiah Banda’s immunity against prosecution should be lifted by Parliament.

Mr Sakeni said in an interview in Lusaka yesterday that although the public and concerned stakeholders were calling for the lifting of Mr Banda’s immunity, Government would deal with the matter cautiously.

Mr Sakeni said Government would ensure it puts facts together so that by the time it takes the recommendation to Parliament, it would have concrete facts to have Mr Banda’s immunity lifted.

He said Government had already indicated that it would take the matter to Parliament but it would not rush the process despite the pressure from the public and other concerned stakeholders.

He said Government would ensure all the necessary steps were followed in order for the move to yield tangible evidence.

Several stakeholders including civil societies have called for the lifting of Mr Banda’s immunity to accord him the chance to exculpate himself on alleged corrupt activities that he might have committed during his tenure of office.

Mr Banda recently snubbed summons from the Anti Corruption Commission (ACC) to interview him claiming that he was insulated against investigations.

  2. PF promised us that they will have a lean cabinet to cut down on government recurrent expenditure on salaries and allowances so that money is reserved for capital and social expenditure. These are the things that have an impact on the livelihoods of Zambians. Sata has increased the number of Ministeries. One such Ministry is the so called Ministry of Chiefs and Traditional Affairs. This is a waste of money. Now I see and
    understand why normal people are against these foolish appointments of oppsition MPs as Deputy Ministers? Deputy Ministers are not Cabinet Members! The president is busy swearing in people & has never had a press conference so we can ask him many question we have. The country is on auto pilot government is so much focused on by elections and the opposition.   3. The PF Government will do the country alot of good to drop this whole idea of lifting RB’s immunity if they have no evidence that will lead to a conviction. The Mwanawasa administration wasted millions of dollars at the expense of equipping hospitals, schools etc, only to recover less than what was spent on the task force. We still have the London judgement hanging in the balance. While we have heard about the Mpundu Trust and all these other allegations, is there any paper trail to lead them to any tangible evidence. PF may pursue Thandiwe for being on payroll and getting money not worked for. I suppose she may be sentenced for receiving money by false pretence the same charge which should be slapped on all NCC members who never delivered the constitution but got paid for it.

    • Mwanawasa’s lifting and subsequent prosecution of Chiluba is what won you debt cancellation, so don’t down grade it to “waste of resources” and no matter the cost, we should persue people who plunder national resources especially those in higher offices as long as this is not done vindictively. In RB’s case it appears to be more vindictive than a genuine attempt to bring to book a plunderer as evidenced by the satetement above.

  4. Ok. This is the time it’d best for Mr. Sakeni and his colleagues to keep quite whilst working on their case. Trial via the media is not only unfair but smacks of cheap politicking. If the case against President Banda is strong, then let us follow the process by seeking to remove immunity and make him have his day in court. There is nowehere he is running to. It’s embarrasing when the president can make such assumptions and even comment about things that need no commenting and will be dissproved in a few days time. Patience!

    • It is really amazing that Sakeni is claiming that there is a lot of “pressure” from the public and stakeholders to life RB’s immunity. And yet, it is clear that many people including the stakeholders are asking for the “evidence” and “due process” if this Govt is to attempt the lifting. It goes to show the kind of “misinformation” and twisting of facts for the benefit of Sata’s allies. No wonder Sata’s popularity is tumbling rather quickly if this is the kind of feedback he is getting in terms of the “mood” in the nation.

  12. The masses supported the removal of chiluba’s immunity and it was easy for parliament to do that. Today, the masses are not in support of that not because we are corrupt but because the people that are pushing for this (The Bwinjimfumu Cartel) are the most corrupt and want to use this opportunity to plunder RB’s assets as they did with Chiluba’s assets. Actually their main aim is to destroy RB’s percieved financial muscle so that the MMD and generally the opposition can be weakened further.

    What they don’t have is the numbers in parliament. We know that if they had the numbers, brainless PF MPs would support anything including a motion to have a Frog or Lizard as a life president after sata retires.

    (1) summoning RB to ACC when he enjoys immunity against such interrogations. (the clause that imminisez RB against prosecution is the same na Sana wine iimucita protect. if u cant summon Sata ba ACC for questioning why summon RB imwe ba Nkusa?)

    (2) calling for the removal of RB’s immunity before telling us Zambian the commited when he was our President. we are not saying he stole neither are saying he didnt. just give us details of his crimes and we will support it.

  24. Hon Sakeni’s public confession that Government has not assembled RB facts on corruption is embarrassing, in the eyes of the public and the international community. One would have expected that by the time ACC (wing of Government) summoned RB the full report would have been ready.
    RB’s refusal would have been used as a chance to release that report and convince parliament by saying, “look we didn’t want to reach this far, here is what he did blah, blah, blah……” but to hear that facts are not ready why did ACC summon him?
    According to my understanding, the same facts that ACC has compiled are the ones that Government should use.

  31. just wait the government is still working on the remains of the previous MMD government, such the floods in Lusaka, construction and rehabilitation of roads in all the districts and also revenging what MMD did by poaching PF MPs and made them deputy ministers after this is done. in the second term we start implementing the 2011 campaign promises. as you may be aware, we are behind by 2 years to catch up with the campaign promises. Fertilizer has been an issue, we want to start buying fertilizer for next year with this issue will catch up.     And why would any politician demand immunity from prosecution? If you look at Zambia’s history (and that of other African countries), the recent previous presidents have had “immunity” of some form after leaving Office (not sure if KK had any though), but were all hounded by incoming governments….possibly to deflect attention as they fill up their own pockets. What a disgrace. I guess they do not have long before the next set comes in to clean up national assets 🙁

    If the outgoing government abused office, charge them accordingly in courts of law. But let the Judiciary do its job.

  39. This immunity clause should be properly qualified in the new constitution. It should not cover thieving, self enrichment , corruption etc but only relate to matters of internal security, defence of soverienity etc. Look beyond RB and Sata. We may have some President worse than RB and Late FTJ (MHSRIP). There are many out there waiting in the wings and waiting for a chance!

    • We already have one serving now. We might as well remove it before he leaves office so that he can answer charges while he is on his legs. We don’t want people insulting the dead; it is an Zambian.

Its naivity of the highest condoour to take that Octopus Bwalya or children his children all things being equal would die first than Mr Sata who is sick and much older than Octopus and his children. Be realistic Mr Sata is seriously sick even if his sickness is being hidden to the nation. Octopus Bwalya’s opinion is being misinterprated. The wrong notion about Mr Sata and PF govt can be likened to a national religion, and questioning this religion is never polpular.   42. @42.1 Octopus Paul Bwanalya In medical field they don’t give PhD as this means Doctorate of Philosophy. But what they give is MD as this means Doctorate of Medicine. U are a student in neither of the mentioned fields.
    Actually, I can almost predict the levels of education in those that blog. Just the way the argument is put forwerd and the way the language is manipulated.

  43. Do you see these people in govnt? They have been preaching about removing Banda’s immunity when they dont have even a faintest clue as to whether he did any wrong whilst in power.
