Opposition Movement for Multi-Party Democracy (MMD) president Nevers Mumba has described as shameful and retrogressive the move by the ruling Patriotic Front (PF) to have former republican President Rupiah Banda’s immunity removed.

Dr. Mumba said that the removal of Mr. Banda’s immunity has been done in disregard of the nation’s viewpoint as people in the country did not ask for such an action to take place.

Dr. Mumba has told Qfm in an interview that the removal of the immunity of the former president is only political retribution and not the fight against corruption.

He observed that it is cheap politics for the ruling PF to pass a motion of removal of immunity of the former head of state when Members of Parliament from the opposition had left the House in protest against such a motion.

Meanwhile, Chief Government Spokesperson Kennedy Sakeni has said that International Lawyer Robert Amsterdam is welcome to enter Zambia to defend his client the former president Rupiah Banda in court only if he meets the country’s immigration qualifications.

This follows Mr. Amsterdam’s affirmation on Friday that he will be ready to defend the former republic president in Zambian courts for any corruption allegations leveled against Mr. Banda if the Zambian government will be courageous enough to allow him enter the country.

Mr. Sakeni has told Qfm in an interview that if Mr. Amsterdam is to operate in Zambia as a lawyer, he also needs to be registered to practice in the country.

      Sakeni and his PF are scared of Amsterdam to their bones, they put conditions that he can’t go through drunken Edgar Lungu’s immigration, and then another short wall Kabimba to allow Amsterdam to practice as a Lawyer.

      No Sakeni is not scared of the so called “international lawyer”. To practice law in any country, you must be registered as a lawyer in that country. Since when was the so called international lawyer admitted to the bar in Zambia. Amsterdan is free to come to Zambia, but if he is coming to offer legal advice, for which he will be paid then the laws of Zambia, I am sure state that, he will need to obtain a temporary work permit. If the international lawyer does not know that then he must be avery dull lawyer.

      Let us not display ignorance here! Even Sakeni does not fully understand these things. Robert Amsterdam has practiced in several countries and does not do any complicated registration just as Judge Chikopa has been called in to practice as a judge. Elias Chipimo as a lawyer has done work in several countries including South Africa without a practising license. These matters can be done properly without politicising something which is just a legal case and not a political one. We could limit Robert Amsterdam’s representation/advice to RB but we should refer to the laws of Zambia not our fears. Give RB a fair trial and let him pay for his deeds if he has to. Otherwise, we end up looking like a kangaroo court. Sakeni did not need to comment until Amsterdam made approaches.

      Ba ZP, Judge Chikopa was invited to come and chair a commission of inquiry, and not to practice law in Zambia. Any one with the right attributes – not necessarily a lawyer – could chair that commission of inquiry, I believe.
      So, there is a difference!

    FTJ’s allegations were a dossier but still didn’t secure a conviction ! Kabimba’s allegation’s sound more like hearsay ,if people were generous to RB does that constitute a crime.many leaders in the world receive gifts and donations but are never prosecuted for that besides,the man who passed the motion to lift the immunity is also being investigated for similar things ?

      @Mungoma , No there’s no requirement for the declaration of gifts. Neither is there a law regulating campaign donations either from Zambians or foreigners. These are the issues the PF was supposed to address if they really were serious about change. But they cannot change these things because they are the ones profitting from them as a sitting government. This is the vicious cycle in which Zambia is trapped! Only an honest leader in state house committed to real governance and institutional reforms is going to change the status quo.

      we are not opposed to corruption fight but what we are saying is that it should not be selective. If the culprit is gulty he should be pushed accordingly but if he’s not then a can walk a free man or fly whatever will make him happy.     I want to ask Mumba why MMD MPs did not defend RB in parliament and why their friends in UPND decided to walk out instead of defending him? Actions speak louder than words. They knew what they were doing and probably did not want to be associated with him for future history. This looks like a donchi kubeba on RB by Mumba and HH after all RB is a threat to them because he is a possible MMD presidential candidate in 2016 and if this happened its them who would suffer.

      Don’t rely too much on history. The team that is dealing with the issue is different! Did you hear what the Justice Minister said? He said the investigation team has already concluded investigations and is READY to start prosecuting Banda. Doesn’t that indicate a departure from past inefficiency?
      So, it’s not nonsense! On the contrary, it’s full of sense, extremely important and very good for the nation. Those in positions of trust, no matter how high, must learn to respect that trust and to limit themselves strictly to what the law permits them to do.

And I’m certain many other Zambians – probably the majority – are also in agreement! The suspicion of his malfaisance is just to strong and glaring to be left alone! If Mr. Banda is innocent, there is really nothing to worry about, is there? Mr. Mumba, please understand that the people do not elect a man/woman to be their president just so he/she can defraud them. Since you aspire to be President, learn that lesson well!

    If the move was legal and not just political then there has to be a full disclosure of the budget of the commission or task force that will be set up to determine the cost benefit analysis, the wisest thing to do if this move is legal is for the ACC to carry out the investigation with no allowances because it is part of their job and they get salaries. Lastly as others have already indicated a clause should be amended in the new constitution that states that Presidents will lose immunity after their term that will ensure accountability and remove all unnecessary drama. Systems and processes must be clearly defined and enforced.

    RB should be prosecuted finish and klaa….as South Africans will say. Indeed no one is above the law….RB should cooperate with law enforcement procedures to determine whether he looted govt money or not. And if found wanting be jailed or seek restitution of some kind. The Speaker, in simple language said JUST AS PARLIAMENT CAN NOT DEBATE A MATTER THAT IS BEFORE THE COURTS OF LAW, THE COURTS CAN NOT ALSO DETERMINE WHAT PARLIAMENT SHOULD DEBATE ABOUT!     Firstly, Nevers you are a wrong person to condemn this move for sure you maybe a sympathizer because you have something in common. But as for Amsterdam he cannot practice in Zambia until he is registered, the same goes for priests, pastors, etc cannot just officiate marriages by virtue of their office…but they have to be registered, it also becomes a source of revenue for the country. Lastly, RB this is not the end of the world but a beginning of defence, and I hope you are clean….though non of us is.

      No they are not. But the term “First Lady” is a legal title that accrues budget allocation. The parliament which includes PF, UPND, MMD and FDD members of parliament decided to give her the money. So if it is abuse of office, then accuse all MPs and the legislature that ratified the allocation. Otherwise, stop pointing fingers at things that do not matter. Besides, this is RB’s time to account for his actions. It is childish to say because Kabimba, Nchito, Sata, GBM and others are not clean therefore we should let everybody go unchecked. Kabimba, Nchito, Sata, GBM and others cannot initiate investigations against themselves. If you have evidence about their corrupt practices, you have the right to take them to court.
