Ministry of Home Affairs accuses Prof Chirwa of attempting to sneak out of the country

Ministry of Home Affairs wishes to confirm that former Zambia Railways Limited Chief Executive Officer Professor Clive Chirwa was yesterday Tuesday 30th April 2013 in the morning seen at the Kenneth Kaunda where he wanted to leave the country but was intercepted by alert Immigration officers and advised to go back because the appointing authority or indeed the Anti-Corruption Commission (ACC) was not aware of his trip..

In the event that the ACC wants to interview him over the assets he was overseeing as CEO of the Zambia Railways Limited (ZRL) and he is out of the country, it will make investigations for the ACC very difficult. Hence he has been asked to stay around.

Professor Chirwa who is currently on suspension did not get clearance from the Anti-Corruption Commission (ACC) or permission from the appointing authority and hence could not be allowed to sneak out of the country as his intensions were not known.

In normal circumstances, he is supposed to get permission from the appointing authority who he knows very well because he is on suspension and there are investigations currently going on. The Ministry of Home affairs therefore wishes to advise prof Chirwa to get clearance from the ACC or relevant authorities if he so wishes to leave the country unlike sneaking out of the country.

I further wish to state that Prof Chirwa is not in any way being harassed or persecuted but instead we want him to follow correct procedures.

The Ministry of Home Affairs has a duty to protect asserts and property for the Zambian Masses.

      There is an ongoing investigation into your alleged corrupt practices during your short stay at the helm of ZRL for which you have not yet been cleared.

      you guys respect the rule of law,,, much as one of those who `pressured` for chirwa´s exit, i think the rule of law has to be respected here.. chirwa has not been charged whatsoever,, nothing against him has been brought forward formally!!!.. therefore he remains a free man,, PF government cannot run the country like they running intercity bus station or chifundo market…
      This is a lession to zambians outside if and when you offered a job by government be carefull ….now prof chirwa is messed up…..

    • Chirwa is very clean…..they are just frastarating him so he does not disaturb there transport businesses (trucks).
      he is the man who can revamp ZR…….If the president can intevain in this issue pliz!!

      better charge the man,, take you him to court, otherwise he is free, let him go and see his family in UK, after all he`s NOT zambian.

    • Feollow bloggers, you’ll remember that my first comment after Prof Chirwa’s suspention was announced was that the govt needed to confisicate his passport because he is a flight risk. This is a guy who has previously warned you that he’d FLY BACK to the UK if need be – and with these investigations a need has obviously arisen for him to keep away from trouble. And once he leaves Zambian authorities would have to battle to extradict him as he would relate with us as a British.

    • So now in Zambia even if you are not charged with a crime you are not free to move? This is the reason why we will always be poor!! We cannot distinguish between someone who is a suspect and someone found guilty of a crime. Oscar Pistorius a murder suspect in SA is allowed to travel to any part of the world until his case has been determined. Chirwa has not even been charged, why harass him like this?

This is so wrong on so many levels and discouraging to those of us Abroad who want to help Zambia.Prof Chirwa came at the Presidents invitation to help revamp Zambia railways.We need a railway line ,that will help reduce road accidents which have become the order of the day on Zambian roads.Now you treat this man like a criminal? I’m sure he regrets denouncing his British citizenship! why is the concept of stealing so ingrained in the minds of Zambians.You think Chirwa left the UK to steal in Zambia? You guys need a serious head examination.How on earth are we ever going to develop Zambia if you persecute people like this

    • It is a big lesson to all those who want to rush to Zambia because they have been enticed with offers of big jobs. Think long and hard before you accept. Your life can become a nightmare overnight. Ask Chirwa. He must be ruing the day he accepted that job in Zambia

    • Where ignorance is bliss, t’is folly to be wise. Be warned diasporans. Zambia is already steeped in cartels and syndicates. It is also the case with most African countries where taxpayers’ trust is the cash cow of a few. You try and do something right you are messing the status quo (trying to turn the abnormal back to normal). Be warned. It is small wonder Zambia is slipping on international ratings now. All the best with all your adhoc laws and so-called “courtesy to inform the appointing authority”. Such rubbish!

    • I have been blocked too. They do not like critical view to theirs. What a shame. Imagine then if UPND ruled what difference would they be to what they purport as PF dictatorship! They would be worse. A country being led by a minority group is far more viscious that one being led by a majority group. Think of Syria today. Its in tormoil because leadership is from minority grouping, ruling by decree. That how they protect their small numbers. What LWD is doing blocking those who merely post their views opposite to theirs must tell you of the obvious. They will rule by sidelining they majority tribe which would offer them a fierce opposition. Take note of this well in advance.

    • I am not happy about this thing. The man is being investigated and he is being portrayed like one who has been charged. Why not do it in the background rather than bringing unnecessary debates? Maybe there is more to the happenings at ZR than what we have been told. Better to advise/remind him in the background about procedure. Opposition will capitalise.

  5. He did a don’t Kubeba on PF. He never renounced his British Citizenship. The British cannot give u a visa within a few hours. So how was he going to make it OUT. shushushu on him. he has been put on radar and Chimbokaila awaits him. Sata knew and set traps to finish him off cause he was presidential contender in waiting.

    The Prof was heading to UK for GOOD!!!! Maybe he should try the DRC bus route in a truck, it is very porous. Or thru Luangwa into Mugabeland.

    • Renunciation in some countries does not strip you of permanent residency… It is only Zambia where renunciation is a punishment.

  6. Given what has been going on in the past few weeks about Pro Chirwa it is necessary for him to have the courtesy to inform the authorities about his intentions to leave the country.
    Pro Chirwa has only himself to blame for all this negative publicity, his image is tarnished. Let him first clear his name in Zambia. This is a good lesson especially for those of us in the diaspora, don’t be hoodwinked by political appointments. If he truly renounced his British citizenship then things will be even more difficult for him back here in the UK.

Any erring employee under investigation should seek clearance from his employers ,so that his whereabouts is known.that is the right procedure.of course it’s not necessary to make it news by the govt but the media is there to pick it up.this man has capitalist mentality.he is a white colar thief.

    • Not only erring employee but all employees are required to inform their employers in case of injury or death, the employer may deny you assistance, benefits / compensation because they are not aware of your whereabouts. Even when you reach your country of destination, it is important to notify your embassy or high commission in case you happen to require assistance like most countries with funds for such purposes. But for some Zambian high Commissions abroad you better be extra careful otherwise they will suspect you of finishing their sugar & coffee.

  13. As one living in the diaspora this is a lesson well learnt. However, if there was truly an ivestgation going on i would stay until cleared if i have nothing to hide or at least inform the authority. But if i was hiding some i would definately try sneak out. What prof Chirwa did just raises more i brows. Good luck tho..

  14. Is prof Chirwa facing any criminal charge or is there any court order barring him from travelling out of the country? If not then the Govt is abusing the law. If anything the use of the word ‘sneaking’ in reference to profs intention to travel out of the country is all wrong. Zambia is not a prison and a nation of free people. Chirwa does not have any obligation to announce to anyone his intentions to travel out of the country.

      if employers tell their employees of their whereabouts, who is chirwa not to.

  15. Well done alert Immigration once again as you did on RB. You don’t need instructions from the top on matters of public knowledge like this one. The man needs permission from his employers but not ACC unless they have written to him of their investigations & he can’t rely on press reports. However, he has a duty to clear his name since his issues are worldly public. ACC, investigations for what & are taking too long? Chirwa has confessed that he single sourced his company without declaring his interest which is fraud and insider trading & allocating himself 25% in a company owned 15 million Zambians. Immigration allow him to go but let him leave his resignation letter with you because he has failed to renovate his own official house in 4 months and how can he turn around huge ZRL?

  20. For those of you with a short memory or who are young..

    When Dr Kawimbe was Minister of Health, alot of Zambian specialist doctors even a well known Zambian specialist based in Canada were incited to come to work in Zambia. Alot of then came to UTH.

    In came Sata as minister after Chiluba fired Dr Kawimbi. Sata fired all the specialist from the UTH board so he could steal money. When junior doctors went on strike he fired all of them. Alot ended up in Botswana.

    The problem with Africans is you never read history… it tends to repeat itself

    • What exactly do you want to say? Your however seems to be contradicting what you have just pointed out in the early part of your post. There is what we call sentiment. If we see that happening to the better of us why shouldn’t we keep away on sentiment until we can read better signals? Keep away until all the useless politicians have passed is what I would say…

It is my understanding that high ranking government officials require permission from the government (or the authority they report to) before the can leave the country even if on personal business. I imagine it is the same for executives of parastatals or public institutions. Maybe it was on this basis that they refused to grant him permission…not to mention even the abuse of office charges he is facing.

  28. I believe prof really had the good of the country at heart when he decided to take up this position. However, he should have looked at the league and quality of players in the team that was asking him to play the role of a lone striker . Over and above that, he should have critically looked at the man who was coaching that particular team before arriving at a transfer fee.     • Native British citizens renounce their own passports every week when the immigrate to countries that do not allow dual citizenship…it doesn’t mean that when you renounce your citizenship the door is completely closed; its not a crime. You can simply reapply for it at no extra charge and you will be welcomed like a lost son.

  31. I am baffled by some of the bloggers supporting Professor Chirwa’s attempt to leave the country without informing the appointing authorities. At my work place, it is standard practice to get permission from the management if you are going outside Lusaka or Zambia. If you just leave without management’s knowledge, you can be disciplined – by being suspended, forfeiture of benefits, or even fired – for absconding from duty. Imagine a situation where employees in all institutions in Zambia can just leave their jobs and go anywhere at any time without informing their managements. That is a sure recipe for anarchy in the labour market! What makes Chirwa so special that he can just leave the country without informing the appointing authorities?

  35. Prof Chirwa has not been charged, only been suspended. Let him travel he not RB. President Sata is not the law. Lets limit presidential powers in the constitution. Why should diaspora Zambians ‘beg’ to contribute to Zambia’s development. Don’t be envious of diaspora experts, use them to develop. Stealing and Jealousy at micro and macro level is a poisonous mix for Zambia. Stealing and abuse have become part of our DNA.   38. Why do you need authority from DEC or ACC to travel out of the country if you are suspension ? What laws allows an ” alert immigration officer” to stop anyone from traveling out of the country?

    They should arrest and charge Chirwa and as part of his bail conditions , restrict him from traveling abroad. There are a lot of arbitrary decisions by immigration officers and the Home Affairs minister against innocent Zambians being made in this regard.

  39. Zambians know how to finish a person. they sweet talked Chirwa so he comes to Zambia in pretext of heading ZR and yet the ultimate mission was to come and finish him off.   40. I hate to say I told you so, but I still fail to understand what Chirwa was thinking of when he gave up his British citizenship and accepted this non-job. This happened to another chap who accepted the ZESCO job from Rupiah. In his case, he was not even allowed to start – he was fired before he even started. He disagreed with RB and Sons. They wanted someone who would not block their schemes. I was surprised when Chirwa said he had given up British citizenship. He was naive enough to mistake a job in a Zambian parastatal for a proper job!

  42. There is this notion by Zambians abroad claiming to help ZAMBIA. How? The British did not leave their country in order to usher in an industrial revolution which changed the world. Americans did not leave America to build the worlds most powerful nation. Even going back in history – the Romans did not leave Rome to create the Roman Empire. So I don’t get it where the so called Diaspora people get the notion that they are helping the country more than the people in Zambia.   43. I think next time Mr.Sata and his government visit the diaspora they should not ask Zambians to come back home. Looking at what is happening to Prof Chirwa which Zambian would want to be frustrated like this or even embarrassed like this. VERY SAD INDEED, DISAPPOINTING. TOO MUCH RED TAPE IN ZAMBIA that kills development. The acting CEO of Zambia seems to be speaking like he has been confirmed already. By the way if we want ZRL to look and work like in developed countries then Chirwa is the man and that Big dream will work. If we want it to be the way it is with old buildings and trains with at least a little profit we need the one acting as CEO right now. Prof Chirwa is a free man why this bad treatment Mr.President?

  45. Why are the so – called Diasporans so conceited and self-serving? A number of us also went abroad, spent many, many years in the US and Europe and acquired high level qualifications at doctoral level. But we still came back and are still here contributing to our beloved motherland. I know a lot of Zambians abroad – including some of my own relatives unfortunately – with lesser qualifications than some local Zambians here. But for some strange and unfathomable reasons, they have this chip on their shoulders – what I call the Messiah complex – and think they can just ride into this country on some white horse, wave a magic wand, and lo behold liberate us from the shackles of poverty. Come on you so – called Diasporans get off your imaginary pedestal and be real!!

  46. Zambia requires positive thinking. This is highly unacceptable in modern society. Prof Chirwa will never be limited by these challenges. He is an overcomer and Zambia may live to regret missing Prof Chirwa’s creative powers. Believe me what he is facing now is nothing compared to what he may attain after this challenge. Emotional intelligence is critical during tough times…Only the strong survive.

  49. @zambian, did you hear GBM/Kabimba say i will leave and go to uk if am pushed? what mr. chirwa was doing was corruption and he knows it. its not allowed in zambia to use your company to do work without tendering but he felt thats not a problem. he wants 25% of a company owned by 15 million zambians to him alone. and you diasporans are saying he should have been given? NONONONO pretending you are helping while you are amassing wealth is cheating.

  50. Prof Chirwa is innocent until proved guilty. The ministry of home affairs is very much aware of this. Anything else is a miscarriage of justice. People should not take law into their hands. This explains why in the end you hear of immunity being taken away after people leave office.
    Chirwa had an Indaba & Exhibitnion running from 30 April to 02 May at Earls Court in London. Please google Railtex. Over 500 railway related industries are there. If Zambia is missing one understands why the country is behind in new ideas, innovation and progress. Chirwa needed to be there. Chirwa is no ordinary professor and the world academia would not take him in if he run away from a case pending. Only laws of the jungle could stop him.
    The man is innocent until proved guilty. Zambia must show good…

    • @MWANA MUWEME, just as Prof Chirwa deserves the respect of a Professor so should he respect the rules and laws of the land. He is as ordinary as the most illiterate Zambian before the law. The fact that he has not been arrested is enough proof that he’s being regarded as innocent until proven guilty. We need to respect the fact that the only thing that will make him innocent is proof that he did not do what he’s being accused of, and NOT JUST THE FACT THAT HE’S FROM THE DIASPORA AND IS A PROF…

  51. @MWANA MUWEME: Does the ZRL turn-around-strategy state that everything needed to bring about the necessary changes shall only be done by Prof Chirwa alone? Could’nt he nominate anyone else to attend that exhibition you’re talking about?

  52. That is why we insist on people who can knock doors. People who can go and talk with those at No.10Downing Street. people who will be respected by the EU which parted with their money in the first place. People who can be invited. Not those who are going to get scared to argue Zambia’s corner. If Chirwa was invited that means he has what it takes to stand tall at the highest level.
    We should accept that Zambia needs new ideas to develop. More of the same recycled ideas will take us no where! Recycled professors, recycled politicians who jump from party to party, recycled and failed methods must go. That is even why some politician now hates the English language. At a time when even the Chinese want to learn it

    We need new ideas. Lets cross-pollinate our ideas. We need to change guys.

    Let’s not be mislead over this Prof. Chirwa’s issue, I know the Truckers in Zed and across the Boarders would not be happy once Zambia Railways is revamped. So let’s not investigate issues of corruption starting with cooked rice follow the direction, the smoke is coming from i.e. Transport. Remember no second hand imported Vehicles from any other countries are allowed to be driven on RSA land, but what’s our own policy of economic growth. “The Pull Him Down syndrome Policy”. Travel around RSA some of the Second Hand Vehicles from Japan are better than those used by the local South Africans.
