Another By-Election as Mangani wins Chipata Central petition in the Supreme Court

Supreme Court Judge Marvin Mwanamwambwa has upheld the High Court’s decision to nullify the election victory of MMD’s Mtolo Phiri in the 2011 Chipata Central parliamentary election.

The election result was petitioned by losing PF candidate Lameck Mangani.

This means that another bye election will be held within 90 days.

Delivering judgement this morning, Judge Mwanamwambwa said the High Court’s decision to nullify Mr. Phiri’s election victory was not a misdirection at law.

He said there is credible evidence that the MMD candidate involved himself in activities that breached Section 93 sub section 2 C of the Electoral Act of 2006.

Judge Mwanamwambwa ruled that by making a cash donation to a Church organisation in Chipata where he also introduced as a candidate, Mr. Phiri involved himself in electoral corruption.

The other grounds for the nullification of the Chipata seat were that the MMD sunk boreholes in the constituency during the election campaign period which may have swayed the voters.

And Mr. Mangani’s jubilant supporters celebrated shortly after the judgement was delivered by honking their vehicles and dancing outside the court premises.

In interviews with Journalists, Mr. Mangani thanked his lawyer Nchima Nchito and all the witness that testified in the matter.

He said the matter had taken long but that he was happy with the decision because campaigns for Chipata Central in 2011 were full of electoral malpractices.

    • Ha ha ha.Ati used him like a condom.Despite the differences he has with the party i think we will do him a favour by adopting him.He really fought for it.

    • This is a treversty of Justice: incompetent investigators, prosecutors and judges! Mangani was the powerhouse of MMd politics in the Eastern Province. He used all of the MMD govt’s tools, weapons and resources to raise the profile of MMD in eastern province Including the lobbying for, planning and financing of those boreholes before he fell out of favour with the MMD. So, if one commits a crime as a member of one party and later defects to another they effectively LEAVE that crime in their old party? Ya… It’s the LOO OF LAW… As well as the RULE OF RAW !!!

  2. In all fairness, the PF should give Mangani a chance, whatever offences he is alleged to have committed, the Party should review its position, he has fought nail and tooth for this seat and I have a strong feeling he has been framed by local politics in Chipata!!!

    • Winter Kabimba was very clear when he said that Mangani has never been their member.It will be very foolish for Mangani himself to pretend and masquerade as a PF member.He should either stand as an independent or be adopted by one of the existing opposition parties.If PF discover that they do not have a strong candidate,they might once more use him as a “useful *****”.

    • WELL SAID. BUT IT SHOULD BE ABOUT WINNING THAT SEAT. IF MANGANI CAN DO IT. WELL AND GOOD. BUT IF HE CANNOT DO IT, THEN PF MUST PICK SOMEONE ELSE. OF COURSE THERE ARE OTHER WAYS OF REWARDING MANGANI. HE HAS FOUGHT FOR THIS SEAT.

  5. Good, this now sets a precedent to challenge any election where there is a hint of political malpractice, like bringing so called development right before the elections, but this effectively means nearly 90% of the seats during a general election….

  7. Mangani has to exercise wisdom on which Party to stand. With prices suddenly aiming for the heavens, courteous of PF, I would be careful if I were him.

  9. Mtolo should join the UPND winning team and recontest.But the problem is that they have registered their mobile electorates at show grounds continous voter registration process.
