AMNESTY International has called for the release of the two Kapiri Mposhi men, who have been arrested on charges of having sex against the order of nature.

In a separate interview, Government has described the calls by Amnesty International as unfortunate and said Zambia had its own laws through the Constitution which did not allow homosexual practices.

Home Affairs Deputy Minister Nixon Chilangwa said Zambian laws should be respected and that the country would not be compelled to recognise matters that were not embedded in the Constitution.

“Those practicing homosexuality will always be charged because Zambia has its own laws through the constitution. Our laws should be respected and are clear that we don’t recognise homosexuality. Issues of our governance should be left to us. People should not indulge in homosexuality when they know it’s against our laws,” he said.

He said people who abrogated the law such as those promoting homosexuality would always be charged by relevant authorities because the act was illegal.

Amnesty International Zambia’s researcher Simeon Mawanza said in a statement yesterday, that the arrest of the two men, Phillip Mubiana and James Mwansa, both aged 21, amounted to discrimination and a violation of their rights to freedom of conscience, expression and privacy.

“Sources have told Amnesty International that one of the men’s neighbours reported them to the police, resulting in the arrest, their second for alleged same-sex conduct, considered a crime under Zambia’s penal code,” he said.

He said laws criminalising homosexuality and gender identity criminalised the legitimate exercise of such human rights, which were protected in treaties ratified by Zambia.

He said according to its sources, the detained men had low literacy levels and a poor understanding of the Zambian legal system or their personal rights.

Amnesty alleged that authorities reportedly subjected the two men to anal examinations without their consent, and could have also forced them to make confessions to speed up the trial.

It said such examinations were in every case highly invasive, abusive, and profoundly humiliating saying the doctors who conducted the examinations forcibly, violated their ethical obligations towards people they examined.

“Amnesty International considers individuals imprisoned solely for their consensual sexual relationship in private as prisoners of conscience and calls for their immediate and unconditional release,” Mr Mawanza said.

  8. i do agree for the release of these poor guys,first people must understand that,been gay,lesbian or bisexual is not a personal choice,if i had choice,i could have chosen to be straight,i am bisexual and i had a sexual relationship with former radio phoenix dj miles who is also bisexual,we cant chose our sexual orientation,its the same as changing a staight man or waman to be homosexual,the same way you think you cant change is the samw way we also think,there is no medice for thia am sorry

  9. @bisexual zambian woman spot on….in south africa they now accept gay marrieges,we wont be give up ,we will continue fighting for our rights,people will say whatever they want but they will never change our sexual orientation…and what happened to dj miles?she got married to a man in uk and crooked him?i read that,anyway enjoy your freedom,we are all equal before the universe and are free to do whatever we want as long as it does not offend anyone,how can i offend someone when am having sex with a fellow woman in the privacy of my house?someone answer me please..

    • I for one do not really care what “holes” people choose to use for sexual satisifaction. Even without homosexuality Zambia has no morals…Nobody should judge anybody!

  10. But in USA if you marry more than 1 one wife they will jail you? Now compare this with homosexuality which no animal has ever practiced? Does it mean that you africans do not think but follow whatever the whites say? Sad indeed. Let these gays repent while there is time.

    • But your argument could be turned on its head…what is wrong with having both polygamy AND homosexual relationships recognised in Zambia? It sounds like you are only rebelling against the latter as long as the former is not recognised in the West which is unfortunate.

  11. According to the bible, God is the only one to judge men. There exist a contract between each and everyone of us and God. And l believe that it is no ones place to inflict their judgement on anyone. l don’t condone what these men have done but l only say that the more people talk about something, the more you tend to go towards it. there are agent issues which really need the same precious energy and time you are wasting such as the recent accommodation crisis at CBU were our children are still sleeping outside. Let us change and develop our own country other than concentrating on such issues. shame on our leaders

  12. Human rights iyi Koma yabwela hot, those men can live a better life somewhere where morals are talk of the past. Banamayo ukulanga ifitako panse ati ni human rights, careful with some of these global influences. Better die a poor man with dignity, than die with umusula wabongoloka.

  13. What a waste of police time and resources. The two adults have been engaging in consensual sex in the privacy of their home. I haven’t read anywhere that sexual violence, rape or coercion was involved – in which case it would have been a different matter. This all goes to show that Zambians still have a long way to go in understanding sexuality. The fact that a culture frowns upon the act, is not a justification to criminally pursue (persecute) and apply punitive sanctions on those engaged in the same. In this time and age, it is rather shameful that human beings should intrusively be subjected to an examination of their anal orifice in the pursuit of sexual activity evidence – especially when no one has been raped. This law is archaic. There is more pressing criminality out there to nab.
