The Law Association of Zambia says it is wrong for Acting Chief Justice Lombe Chibesakunda to continue holding her position when she no longer qualifies to hold the highest judicial office.

Law Association of Zambia president James Banda Phiri has told Qfm news in an interview that his association is on record opposing Justice Chibesakunda’s continued occupancy of the Chief Justice’s office.

Mr. Banda adds that Justice Chibesakunda does not show concern over the many wrongs that have been going on in the judiciary from the time that she took up her position.

He notes that the general public will lose confidence in the judiciary, especially that Justice Chibesakunda is also related to people in the executive which makes it worse for her to execute her duties professionally.

    • LAZ should be able to apply sanctions to any of its members who defy their advice.Two cases come to mind and these are Mutembo Nchito who has continued to ignore LAZ summons to appear before their disciplinary committee and this Madam Chibesakunda saga.In both cases,why can LAZ NOT WITHDRAW their practicing certificates?If this is done,these two miscreants will be legally crippled.

    • PF GOVERNMENT IS A MOCKERY JUST LIKE EGYPT WAS, Why is winter Kabimba three in one(legislature,judiciary and EXECUTIVE) -Legislature(MP), JUDICIARY(JUSTICE MINISTER) and EXECUTIVE (cabinet minister). Same leadership faces isn’t this an extension of the executive in the other two arms of the state????? Isn’t the principle of separation of powers and the independence of the 3arms of the state a MOCKERY under PF. ??? In the absence of independent strong public institutions, Isn’t democracy a fancy???

  3. Chief Injustice Chibesakunda! An illegal person can only deliver illegal judgements. How do u defend a constitution when u are the first to break by illegal occupancy. She is an illegal tenant and should b evicted. From history only Mwanawasa has a record of resigning from a high profile position. This has no iota of courage to do that. She should b forced out like Kachingwe!

    • Our constitution is weak & has deficiencies as a result the government & the president take advantage. LAZ, opposition leaders, churches, individuals etc. are suppose to input in the new constitution which is being drafted. Opposition leaders are dancing to the current constitution. Opposition leaders and government leaders are just busy calling names & boasting at one another, doing absolutely nothing, but brag about while the country deepen in poverty. Either the opposition or the government has no solution for poverty in Zambia. At least the government is trying we can see what it is doing. The opposition is doing everything in it’s power to ensure that Zambia remains undeveloped. Both the govern. & opposition should be held accountable. Opposition has not given solution to…

The lady is a Zambian working in her own country and you expect her not have relatives in the executive. Just keep quite if you have nothing sensible to say. You not an ordinary lawyer but the current president of LAZ so ifya bu LUMPENI panse. Kuicindikako panono. Or is it your total hatred for the PF thats driving you insane. Too bad boss, they are not leaving just now. The sooner you accept that as a reality the better for you and the people you lead.

  12. This woman is our mother but she has falied the zambian family due to greed. We shouldnt allow her to destroy our country by raping the law of our land. Please step down even on moral grounds.She is just a disgrace and she knows this. She is only there to serve her personal interests without thinking of her grand children whose law structures their future depends on.What a shame.

  15. my i advise to chief justice chibesakunda is that, she must remember that what goes up it will one day go down. look at RB where is he, look at judge Musonda and others where are they. next time it wil be some top officials who are now frying high in the blue clouds they will be down to earth. so time has come for the madam to resign without force.

    In your field, integrity is paramount and sacrosanct, otherwise whatever judgment you will preside will lack credibility no matter how good it might be, because your integrity is so soiled. I think the best thing you can do now is quit.

  18. Acting Chief Justice Lombe Chibesakunda must go says LAZ. I can’t believe that LAZ is begging Justice Lombe to step down instead of asking the president to remove her from occupancy of the Chief Justice’s office. Option 2, LAZ can use it’s power invested in it to suspend Justice Lombe from LAZ so that she cannot practice law. In Canada to practice engineering you must belong to engineering association, and I think to practice law in Zambia you must belong to LAZ. Therefore, I find LAZ toothless, powerless and less useful to the public, although LAZ has valid points. No wonder why Mutembo Nchito can boast. So what action is LAZ taking to address these issues? Just talking is not enough. That’s why constitution must be overhauled & deficiencies removed to stop the gov from abuse of power

    • The reasoning by LAZ OPPOSITION PARTY PRESIDENTS AND INSULTING BLOGGERS HAVE NO SUBSTANCE.
      IF IT IS ONLY HER AGE, THEN, WE ARE PETTY.
      ANYONE CAN SHOUT RESIGN WITHOUT ACCUSING HER OF GROSS INCOMPETENCE, THEN LET HER GO NO WHERE.
      AGE IS AN INSIGIFICANT QUALIFICATION.

  19. Justice Lombe Chibesakunda is Competent we can all agree. She has performed very well since she was appointed as a judge in KK, Chiluba, Levy, RB & now Sata governments. Yes, she is competent. The only problem she has past retiring age which disqualifies her to be a judge. Hence, LAZ should tell the appointing authority to discharge Justice Lombe or LAZ should suspend her from being a member of LAZ so that she cannot perform duties. Mr. Banda adds that Justice Chibesakunda does not show concern over the many wrongs that have been going on in the judiciary from the time that she took up her position. LAZ should do everything in it’s power to have justice Lombe removed. We are tired listening to LAZ, it is time for LAZ to act. LAZ is letting down the Zambian people by just talking.

  20. Laws of Zambia Volume 1 Article 93,
    (6) A person may act as Chief Justice, Deputy Chief Justice or Supreme
    Court judge notwithstanding that he has attained the age prescribed by
    Article 98.

    98. (1) Subject to the provisions of this Article, a person holding the
    office of a judge of the Supreme Court or the office of a judge of the
    High Court shall vacate that office on attaining the age of sixty-five

  21. Constitutional positions must be held by eminent persons with upright morals and credible integrity in this nation. Retired members of TASINTHA must not serve high offices in Govt. Parliament was backed by well research points for rejecting Lombe as Chief Justice. However, my request is to seek media houses to publish a close-up photo of Lombe’s son called “Chita Chibesakunda” to enable us assess as to WHO IS THE REAL FATHER of this essentially fatherless child.
