The Law Association of Zambia has maintained that Justice Lombe Chibesakunda is not qualified to hold the office of Chief Justice.
According to resolutions from the LAZ Extraordinary General Meeting held at the Mulungushi International Conference in Lusaka Saturday morning, the meeting unanimously resolved that Justice Chibesakunda was not qualified to work as Chief Justice.
The meeting resolved that the resolution of the LAZ AGM of 4th May 2013 that Justice Chibesakunda is not qualified to hold the office of Chief Justice stands.
It said the mandate by the AGM to the Council of LAZ to litigate on this issue shall be preceded by engagement with the relevant authorities within a reasonable period of time, not exceeding one month, with a view to ensuring that the vacancy in the substantive office of the Chief Justice of the Republic of Zambia is filled.
The Association resolved that in the event that the engagement with the relevant authorities fails, the Council of LAZ shall proceed in accordance with the mandate given by the past AGM to litigate this matter.
It said the litigation will be undertaken along with other forms of dignified and affirmative action by the members of the Association until the substantive position of the office of the Chief Justice is filled.
This is according to resolutions of the extraordinary AGM released by LAZ Council Honorary Secretary Linda Kasonde.
Well said. An arrogant and stubborn attitude by Government on this important matter in certainly not in the best interest of the nation.
The gist here is that Justice Chibesakunda is not qualified to serve as CJ. This fact has become clear in the recent past. Her presence in the drainage dwells is as a result of nepotism by the president who has decided to lend a deaf ear. Chibesakunda herself could resolve this by opting to step down. Should the president proceed with confirmation, LAZ and the citizenry will put her under scrutiny, and in some instances make it difficult for her to function. She could, if not careful, go down as the worst CJ in our history. Blame it on Sata. From the real Nostradamus not the impostor with the American flag.

@Nostradamus like you I have followed Saulosi’s arguments. At some point he was challenging why people were up in arms challenging the continued occupancy of Judge Chibesakunda in the office of Chief Justice. My observation is that at times Saulosi would do well to argue issues on it merits without bringing in his political affiliations into the equation as that distorts facts as they tend to be biased.

The net is closing in on Madam Chibesakunda’s integrity. It is at this point that a wise person will consider the options and subsequent implications. I am no lawyer but the constitution is very clear and if madam Chibesakunda believes that LAZ is erring on this, she needs to state what she believes the constitution says/means. Holding on to that office illegally can only ruin the little, if any, integrity she may have. Holding on to the office simply because the President said I should will mean she is complicit in eroding the very LAW and office she is supposed to be safeguarding on our behalf and renders her a political cadre. In her shoes, I would no doubt save my interity rather than be discredited for being a cadre of a failed political party.

Where is John Sangwa, a prominent Lawyer who spear-headed the ousting of Chief Justice Sakala on account of old age? Did John Sangwa attend LAZ’s important Indaba where the removal of Judge Lombe Chibesakunda from her illegal clinging to the position of Acting Chief Justice was arrived at?
LAZ is a very respectable legal Institution whose wisdom cannot be doubted. If Madam Lombe Chibesakunda prefers to ignore voices of reason, then her being recruited to ruin the Judicial System for political expediency can be confirmed. This behaviour is not expected of a woman had been graced with a respected marital status. This can only come from a staunch member of Tasintha Association.

For the president, who ever is advising I’m on this case, it’s denting on his image. He must know that the nature of office (CJ) is not just attracting Zambians but the international as well. To every sane being, how does someone act for almost two years, its no longer acting but full time. Am sure if the LAZ kept quiet, this woman would finish the Sata term ‘acting’, even get another retirement.

Is the problem that chibesakunda is over age or LAZ is not saying what the real issues are. He, himself james banda is a minor who cannot sue or be sued and cannot stand before the courts of law, how did he become LAZ president? It shows credible lawyers are longer interested in time wasting affairs of LAZ hence leaving it for the hungers around and those who dont win cases to run LAZ. LAZ has always behaved as an armed wing of the opposition. If the author of the above response followed events, LAZ acted and campaigned for PF and some lawyers (Sangwa) helped the newly formed PF govt in 2012 to remove then Chief Justice Ernest Sakala on no credible grounds. The committee of Musa Mwenye attacked LP heavily before he passed-on. The acting CJ clearly does not qualify according to the constitution to be given first appointment as CJ becuse she is past or she is post retirement. Justice Ireen Mambilima, the substantive deputy CJ?? is available for appointment but for reasons of political expediency, Sata and his clique have decided to stick to the current illegal acting CJ, Chibesakunda.

i really dont know the reasons why madam chibesakunda does not qualify but i have all the trust in LAZ,which means i join all those calling for her removal as CJ of zedland.
All those supporting the continued stay of Chibesakunda, it really would be nice to have your clear reasons as to why she should continue to act when:
i. Parliament refused to ratify her
ii. She is not eligible under the Constitution with regards her age and the tenure of being in an acting position.

Two things here. First, abusing or chasing innocent acting officials is the lowest of LAZ priorities; completion of Constitution is more urgent. Next, putting acting officials in certain positions is not necessarily breaking rules and regulations. Adherence to and respect for best practices was achieved the moment PF government withdrew confirmation. It is better to use elections to resolve political correctness than litigation or such other drama.

Firstly, Let LAZ tell us if Chibesa Kunda does not qualify to Act as CJ. Secondly, what does the law say about acting period of the CJ? Coz to me it seems the problem is on legal technicalities. I dont see hw the PF govt can insist on allowing Lombe to continue acting if they dont have a base of arguement. I think we need straight answers here coz we seem to be fed half truths. Let us be exhaustive in all the issues against the acting CJ. Lets not stick to age only because if it was tht clear, I dont think this arguement can persist

This issue of the acting chief justice has been a forgone conclusion. All sectors of society are saying she should go. In all honesty, she should go… Soem of thsoe questionable rulings that raised alot of eyebrows should be reviewed by a panel of supreme court judges and were appropriate reversed. We need dignity to return to tte judiciary and..
