Itezh-itezhi boys in court for unlawful sex with under 16 girls

An 18-year-old boy of Luchena area in chief Shezongo’s area in Itezhi Tezhi district in Central Province has appeared in the Itezhi Tezhi magistrate’s court for having consensual sex with an underage girl.

The named juvenile, who was accompanied by his guardians in court, readily admitted the charge of defilement of a child when he appeared before magistrates Mubita Munalula of Itezhi Tezhi district.

The allegations against the juvenile are that on a date unknown but in December, last year, in Itezhi Tezhi at Itezhi Tezhi district, the named juvenile had unlawful carnal knowledge of a girl under the age of 16 years contrary to Section 138 Cap 87 as amended by Act 15 of 2005 of the Laws of Zambia.

When asked by the court why he had carnal knowledge of the underage girl, the named boy said the act was consensual because he proposed love to her and she readily accepted his proposal.

But magistrate Munalula reminded the juvenile that the Zambian Law prohibits sexual intercourse with a girl under the age of 16 years regardless of whether she consents or not.

The matter has been adjourned to September 3, 2013, for the social welfare report and sentencing.

And a 15-year-old boy of Kasaka in chief Shimbizhi’s area in Itezhi Tezhi, who appeared for defiling an underage girl has denied the charge before magistrate Mubita Munalula.

Facts before the court are that on July 13, 2013, in Itezhi Tezhi district area of Central Province, the named juvenile did have carnal knowledge of the minor.

State prosecutors applied for adjournment of the case to September 9 before commencement of trial.

In the same court two juvenile offenders of Lilanda area in Chief Shimbizhi’s chiefdom in Itezhi Tezhi have also appeared before magistrates Munalula Mubita for allegedly stealing metal bars valued at K400, property of John Chungu.

The duo has denied the charge and the case has been adjourned to tomorrow for commencement of trial.

Meanwhile, a 43-year-old man of Shinyama village in chief Shimbizhi’s area in Itezhi Tezhi district appeared in court for allegedly stealing an ox.

Clement Shinyama was arrested on August 15, 2013 and charged with one count of stock theft, contrary to Section 275 (1) of the Penal Code Chapter 87 of the Laws of Zambia.

Particulars of the offence are that on dates unknown but in August, 2013, Shinyama did steal an ox valued at K2, 000, property of Shakata Shapeela. He pleaded not guilty to the offence.

The matter has been adjourned to 10th September 10 for commencement of trial.

  1. I want clarification from the Magistrate, do the same law allows to have sex with an under aged boy? The two of them were under age at the time, so who defiled who in actual sense? This is simply case for social welfare and counseling but definitely not sentencing. We all had sex when we were of ages below 18 and I guess we could have all ended up in jail.

  2. Now if the Girl wants to have sex, boys should just run away, they way i used to do until I finished my secondary School. I was told that Girls have fire and any attempt Kupya

  3. Keller, wakamba zoona although it sounds savagish. The fact is children under the age of 16 do make sex experiments becoz they are just discovering themselves. No wonder some girls get pregnant at the age of 12 or 13.

    • We do know boss they do have sex but the law is to safe guide them for them fully dont understand like a mature person what they do…so there i am in support of the current law…. I have seen girls as young as 10 pregnant but not by someone above sixteen but by younger boys too yes the world is crazy we cant stop all but where we can we regulate

    • My argument is that the same law must protect the underage boy and if two minors have committed an offence, not only one should be punished. I am made to understand that a minor is he that cannot make an independent decision and so was the boy but counseled.

  4. he hasn’t killed why sentence him just give him the girl to finish up then charge him after the girl is pregnant. Moreover they were proving love.

  5. I believe most of the people in the rural areas have commited a crime, they are either married to children or have had intercourse with one or more under age girls. The civil society organisations must set up work shops in these areas to educate men and women, girls and boys concerning this topic. These folks think a girl becomes a woman when her physical features begins to change to that of a woman, it doesnt matter how old she may be, this doesnt add up well on the radar as regards a healthy society.

  6. I support the current law too but I have a problem when being implemented. The two minors don’t know what they do really and both need protection but what happens is that the oldest of the two culprits is punished. If a girl is say 10 and the girl 9, then they will conclude that its the girl who defiled the boy and if its a boy as in this case then its a boy who is in trouble. Looking at the whole thing the two are just minors that need protection and not capital punishment for such cases.

    • Ba Keller I totally agree but think about it also if a 15 old boy impregnates a 17 year girl should the girl at 17 years be punished because the law states its statutory rape….realistically speaking who knows at that age even that such a law exists of course we claim ignorance is no excuse but I think its not fair hence other countries have moved restrictive age to 18
