Lameck Mangani asks High Court to submit report of corruption findings to ECZ

Losing Chipata Central PF candidate, Lameck Mangani has written to the Registrar of the High Court asking the court to submit a report to the Electoral Commission of Zambia (ECZ) on its findings of corrupt practices that led to the nullification of MMD’s Reuben Phiri’s parliamentary seat after the 2011 general elections.

This is in a matter in which Mr Mangani has petitioned the Chipata Central parliamentarian, Mr Phiri asking the court to declare his election null and void claiming he did not qualify to stand for the by election following the Supreme Court’s nullification of his 2011 election on account of corruption.

Mr Mangani has also asked the registrar to submit the same report to Director of Public Prosecutions (DPP) because he intends to use the report to support his evidence that Mr Phiri’s seat should be nullified and instead he should be declared winner of the July 25, 2013 by-elections as he came out second.

Mr Mangani said his request to the registrar was in line with Section 104 of the Electoral Act number 12 of 2006. The Electoral Act requires for the High Court to render a report of corrupt practices to ECZ against a candidate whose election had been nullified as a result of having engaged in corrupt practices.

Mr Mangani stated in his affidavit in support of summons for leave to apply for out of time for an order to vary or enlarge the period in which to comply with the orders for directions that the report by the registrar would help advance his arguments in his petition against Mr Phiri.

He said he was alive to the fact that High Court Judge, Evans Hamaundu who nullified Mr Phiri’s seat during the 2011 elections was presiding over criminal sessions in Chipata for the most part of September 2013 and as such he believed that the report would only be prepared after the sessions for Chipata towards the end of this month.

Mr Mangani said once the report had been submitted, he would rely on it.

He has also filed a request to Judge Mulenga Mungeni who is handling the matter, for the petition to be set for trial following the compliance of both parties with all orders set by the judge.

Hearing of the petition would commence on September 30, 2013.

    • True although he is my brother. It is the Supreme Court that over-ruled the High Court decision. So he should be asking the Supreme Court to adduce the evidence. And how did he know that the DPP wants to use the same information? He has just confirmed the suspicions that this is all a PF issue. He will not get the seat unless he contests another by-election and wins. There is no provision in the law for #2 to be automatically declared winner.

    • Mangani is offside in attempting to cause the court to produce a report of corrupt practices. A decision to produce a report solely lies with the judge, and it is not a must that a judge should issue a report after every nullification of an election. The report is only issued if the corruption leading the nullification of an election was caused by the election contestant. In most cases, an election nullification is caused by the conduct of the contestant’s party supporters. Sympathizers of a contestant could be found buying voters cards without knowledge of the contestant, such a case can lead to the nullification of an election but would not lead to a criminal prosecution or banning of the contestant because the offense would not have been committed by the contestant but his supporters.

Actually you were useless when you were at Science and Technology, you illegally grabbed a plot belonging to scientific research, in Chainda, shame on you.       This guys does not understand that no one can risk having him as an MP candidate or MP… He cant even risk fielding himself as an independent candidate because he is worthless

      thats why am considering offering him a job to be driving my grandmother`s fish and rice from mongu to soweto market in lusaka for sells.. maybe he can useful in that area NOT in ´mandahill`

      i checked ZWD, it’s kind of a funny write up, too much hear say and almost very funny it made me laugh, the personal issues the writer brought in about the mansion and the vehicle he bought for his mother made me laugh, that information has nothing to do with him being behind the Barotse issue alot of petty unneccessary statements in it i can write a much more convincing story if i had even just one fact, if they want the masses to believe their story, they should point out facts that pin him to it, otherwise, there is no smoke without fire, we await for more Drama from Zambia.

      yes the article was alittle bit over that top,,, subjective and not objective to an extent!! But it holds some truth..

      And you know what!! mmembe NEVER covered one bit of all of those baroste `fights` in his paper and the most baroste agreement references on ground being used today are the post extracts,,, hair raising and alarming to me…..! i stand to be proven right,,mmembe is the actual confusion behild their own PF confusions. lets wait and see!!

Who does he speak with before deciding to utter such nonsense any way too much comedy in Zambia maybe he is just acting, am embarrased for him though can Mr Sata tell him to accept that he will never ever be a minister, who can vote for him after showing such weakness?

I personally do not know the man but such desperation makes you think the man wants to become MP to purely serve his own interests. Politicians like to bury their heads in the sand. To them they do not accept defeat, either they win or they cite fraud. Someone described stupidity as doing the same thing over and over but expecting different results. Sir, you have been rejected by the people of Chipata, twice! Ultimately that is why we need to enhance our social security system in Zambia so that such old men can have some form of income to depend on. We are setting bad lessons to civics students that in a democracy when you lose just petition as many times as possible until the compromised judiciary rules in your favor.

    • Most appointments in successive Zambian governments are misplaced. What research does Mangani know? How then do you expect such a person who does not know what a conducive research environment needs to facilitate such an environment. Let him go back to Primary School teaching.

Next up, Dora Siliya will annihilate these monkeys and they’ll wish their bogus acting Chief Justice had never helped them cause unnecessary by-election’s. Even if that ugly Chibesakunda woman stops Dora from standing and a Lizard is nominated to stand against the PF candidate, MMD will carry the day in Eastern province.

  10. Through a well defined democratic electoral process Mangani has been defeated twice by Mtolo Phiri in Chipata constituency. This means that the people of Chipata do NOT like his political culture of amassing money at the expense of the people.

    If Mangani still desires to unscrupulously make tax payers money from Parliament, he should generate a devilish prayer and ask President Sata or President Kabimba to nominate him to Parliament within the provision of the Zambian Constitution. Exploiting Kabimba’s crude method of mutilating the law will just send Mangani to Chainama Mental Hospital.

  13. The fact is, people of Chipata Central have rejected Mangani. And Mangani knows this fact no wonder he has asked the court to declare him winner in case he wins the petition.

    Mangani should be commended for his courage though. His petition would help the courts to put its house in order in case of similar cases.

    • Very true Cindy.David Phiri was duly elected MP on MMD ticket in 2011.PF gave him a job as Deputy Minister.So he had it sweet both ways.MMD never threatened him with expulsion from the Party.With the help of Winter,greed crept into David’s head as he wanted to be a fully blended PF cadre hence his resignation from MMD.Unfortunately for David,the people who matter in Mkaika told him “UKAKHALA PA BWINO POIPA PAITANA”.So poor David has been benched all because of greed.This is also the story of Lameck Mangani.He detests the day he betrayed RB.

  18. Mangani reverted into behaving childishly, picking up Kabimba’s fragments of deaming the integrity of High Court Judges. Losing twice to the same opponent speaks volumes. The people of Chipata have rejected him. Let him go farming or get a part-time teaching job in a private Primary School.

RB attending the funeral of Chigaga during the bye election specifically said it privately that both had played against him behind his back, be doomed. As for Mangani, the people of Chipata don’t even like seeing you, move on as we, yes we the residents of Chipata, don’t want you! F*** OFF! Get employed by those indians who supported you so you pay back your nkhongole.
