Wynter Kabimba sued for falsely accusing UPND for causing the death of a PF cadre

THE United Party for National Development (UPND) has dragged Patriotic Front Secretary General, Wynter Kabimba to court demanding for damages for defamation over allegations that the opposition political party was responsible for the death of Central province minister Obvious Mwaliteta’s garden boy and PF cadre, Harison Chanda of Monze.

UPND deputy Secretary General Kuchunga Edwin Simuusamba who has sued the Post and the Times of Zambia, on behalf of the party, wants the Lusaka High Court to order Mr Kabimba award his party punitive, general and exemplary damages.

Mr Simuusamba wants the court to order that UPND be awarded damages for anguish and emotional turmoil suffered as a result of the said libelous publications, interest on the said damages and that the two newspapers offers public apologies in their papers.

He wants an injunction restraining Mr Kabimba and the newspapers from further publishing or causing to be published the said similar defamatory words.

Mr Kabimba has been sued along with the Post and Times of Newspapers as second and third respondents.

Mr Simuusamba has stated that on February 4, 2013, Mr Kabimba falsely, maliciously and wantonly caused to be printed defamatory information where he accused UPND of causing the death of Mr Mwaliteta’s garden boy Joana Liakoka which story was published in the Post newspaper under the headline “UPND behind death of houseboy-Kabimba.”

He said on February 27, 2013, Mr Kabimba caused to be published in the Times of Zambia another article headlined “UPND must take responsibility for the death of the PF cadre.”

Mr Simuusamba said the words were in their ordinary and natural meaning understood to mean that UPND members were responsible for the death of Mr Liakoka, Mr Chanda and were also responsible for the death of UPND member Menyani Zulu during the Chongwe by-elections.

He said the words were also understood to mean that UPND was a violent party and its members cultivated fear and intimidation in elections by instigating violence as its members were murderers and violent.

He claimed that the words were meant to mean that UPND secured blood stained votes in Livingstone and had a formula for terror, crime and murder.

He said because of the same articles, the party has been labeled violent on several occasions by the public while its members had been accused and arrested on trumped up charges of assault and murder.

Mr Simuusamba who said UPND has, as a result been greatly injured in its credit and reputation and that the articles were meant to gain increased sales and political mileage.

  1. Kabimba is unfit to be a Minister, suits him more being a cadre. With Sata back, I eargely await nears that he’s being relieved please.

    • Sata is back, nurses and pharmacists national wide are on strike. No one knows what our president is doing on this. Sata thinks Wynter and GBM fight will die out but it wont die out we all know that, this is round 2. Sue mwaliteta for assaulting Garry Nkombo aswell.

    • Mulenga Sata (irrelevant as he is) should tell his father to free himself from what ZWD describes as being “the cartel holding ailing dictator hostage”.

      Wynter wont take anyone anywhere. He’s too playful to be your, my or anyone’s leader.

      I pray the H.E. MCS will get rid of the “cartel”. IT MAKES ME SICK.

  2. UPND had to wait till he was at his weakest to attack,why didn’t they sue him at the time he said what he allegedly said? Alafwa na BP umuntu imwe sure,problem after problem,i wonder how much info his pillow gets at nite.

    • Timing ba zamcab, everything is about timing in life. Even pa bed if you have PE, your wife or girlfriend won’t be happy. Timing my brother. The dust settles, Wynter is at his weakest now, you pounce now!

    • UPND had to prove beyond reasonable doubt that they had a case against Kabimba, the Post and the Times of Zambia, that is why they took long to act. After all, mulandu siuola.

  4. Though this alienates embattled further from UPND a party he may be counting on to accommodate him and the cartel, UPND has initiated a very good fight. Kabimba, Masebo and the cartel league have no option, but to shove to Dr. Ludwic Sondashi’s party.

    • Still the UPND is his hope. The trend in Zambian politics is that one can insult a given political party and when they are shown the door from the one they are serving, they go back to their original Parties and all is “forgiven”, except the unlucky Richard Taima.

  6. Leave Kabimba for now and concentrate on building the party for 2016. It will be case to do so as this man is already in serious problems with his party. We can come back for him when his power is striped off.

    • Nice comment, though i think action should be taken now while the iron is still hot! Mobilize, dominate and attack like Bayern Munich FC, put them under pressure always, let them play in the own half, jokers!!

    • Kenji, this is part of party building. The party wants to remove the tag of violence PF slapped on them by making all the false accusations of murder. UPND want to go into the campaigns free from all such accusations!!

  7. The Livingstone elections saga was a sham and the worst in the history of zambian politics. The desperation which the pf regime showed even to the extent of assaults detention and wanton violence cannot be tolerated. It was truly a recipe for the downfall of the pf and nowonder that they have no other external enemies they have turned on each other. Zambia is not the same 1971 country

PF is the right party to drive this country at least two steps ahead in terms of development if the grudges precede their core vision the party had, they will painfully regret both winners and losers if/when they leave office in 2016….its sad the President is too prudent may be quiet but he quickly needs to address the nation and do some reshuffles both at cabinet level and party level… I love PF including President Sata but am let down and confused

    • I guess one would have to be seriously confused to think that anything good will ever come out of pf in 90 days or 90 years.

Although we all know that politics is a dirty game,when we seek elected office,(or are appointed by the powers that be),we need to exercise restraint and caution when we speak to the press,or issue public statements.Sometimes what public officials say and do can cause a breakdown of law and order or victimize their opponents or members of the public.
    In Zambia many politicians and senior civil servants are guilty of careless talk which harms innocent people.Let’s emulate what happens in the civilized countries in Western Europe,North America,Australia,New Zealand etc where public officials are dragged to courts of law for defamation and libel when they engage in character assassination activities.
    Wynter Kabimba’s problem must be avoided by others who hold public office.

Nobody is leaving PF alone to mess stuff up like mmd and unip did, no chance. I am not giving them room to scratch their collective arse. They f.uck up, they’ll be exposed with immediate effect.   15. Moving the country forward means clearing all cobwebs and other impeding factors if you are to have a smooth way forward. Doing things the correct way by PF govt means the opposition will have less grounds to criticise thereby allowing the PF govt to focus on development. It is as simple as that.

    In short good corporate governance is a prerequisite to development. Strife, hooliganism, kaponya language and behaviour and cheap politicking is counterproductive, including tribalism, which unfortunately has resurfaced after many years.

    Hope PF govt will now concentrate on creating a conducive environment for democracy, good corporate governance (esp. rule of law – control Zambia Police and lawless party cadres) and your effort to develop the country to will succeed. Please do this.

    • What PF and Zambia requires is a serious vote of no confidence followed by a lawful change in politics and politicians. These motherfu.ckers need to start being servants or the people and responsible chaps rather than this bull crap of them thinking they are God, Jesus and Michael Jordan wrapped up intom one ball.

  17. UPND is not going anywhere. MMD will emerge victorious in Eastern Province and Mansa by elections. By starting a war with newspapers UPND is alienating itself further from the news media. Winning a case and awarded K50,000 will not take it anywhere. Lawyers will make money while party will be distracted and busy going in and out of courts. Donot write off Kabimba. He will come out victorious in PF. UPND shall accept second fiddle to MMD to remain relevant in 2016 and beyond.

    • A normal party is not operated by one person, surely UPND has structures and they must have a Legal Department that will concentrate on this matter.
      BTW Kabimba had once challenged people who had supported PF and helped into power to name their price so that he pays; where are they this is the right time to ask for their refunds…..woooolalalalalala!!!!

    DATE: 17TH JUNE 2045
    (a) Due to the non availability of the complaint UPND, I hereby declare this case closed and Mr. Kabimba and others are now a free. JUDGE

    (1) You seem to be so exercited about this case of UPND taking Kabimba to court. In my views there is really nothing to worry kabimba.

    (2)These cases of defamatory take ages to despose 10 to 15years. We do not even know by then what UPND or Kabimba will be. So I see nothing here to break Kabimba. There are other bigger issues I think he can WORRY about than this cas.
    (3) Even if he was found guilty which I doubt what effect will it have on his political career. HH has a lot of such cases defaming president, issuing alarming statemnts, but the man is going on.
