MMD leader Nevers Mumba has unreservedly apologized for alleged assaulting the integrity of the judiciary.

Mumba has submitted to the court that his statements were not in any way intended to ridicule or bring the much-revered Supreme Court into dispute but were merely fair comments on matters of public interest.

This is in a matter where Petauke central constituency losing candidate Leonard Banda has sued Mumba for contempt of court.

This was after Mumba attacked the judiciary through the media over its decision to nullify Dora Siliya’s seat.

But Dr Mumba who admitted to having issued the statements complained of said he was apologizing and withdrawing the statements if in its ordinary sense they amounted to contempt of court.

“Should the statements in their ordinary sense insinuate or indeed amount to contempt, I unreservedly apologies and withdraw to the extent of the contempt” Mumba submitted in his three paged statement to the court.

Mumba however told the court that the language he used in the issuance of the statements was mild as he had used words like “may” and posing questions for debate.

He said that he recalled making the statements complained of but the same were issued for and on behalf of the MMD party as a party that was injured by the numerous nullifications.

Mumba said that because of the same, MMD was grieving as a party in the face of taunts from the ruling party which included a statement from Justice Minister Wynter Kabimba that the ruling party would “engage’ the court in relation to the same.

He further said that following the announcement by Mr Kabimba, a press statement was issued purportedly for and on behalf of the Supreme Court affecting the MMD in relation to its candidate Siliya.

Mumba said that the statements generated public discussions that were in public domain and became matters of public interest.

“The statements complained of were intended to be fair comments on matter of public interest. Necessary caution was taken in the issuance of the statements in that the same were posed as questions for public debate. Further I used the word “may” in most of my statements” Mumba said.

Mumba said that the statements were not conclusive of any fact in issue but speculative on a matter of public interest that was enjoying diverse comments from the general public.

The panel of five Supreme Court judges namely acting deputy chief justice Florence Mumba, Mervin Mwanamwambwa, Hildah Chibomba , Gregory Phiri and Munyinda Wanki have since wondered whether it would be necessary for the court to proceed in hearing the alleged contempt of court in an event that Mumba had apologized.

Meanwhile, trial in the same matter failed to takeoff because Mumba’s lawyer Ireen Kunda was unwell.

Donald Kasote from George Kunda and company who applied for an adjournment on behalf of Ms Kunda told the court that Ms Kunda had been advised by medical experts to be on bed rest for five days because her blood pressure was high.

Ms Justice Mwanamwambwa who adjourned the case to November 13, 2013 ordered Mr Kasote to study the case in case Ms Kunda would not have recovered by then and that he should concentrate on Mumba’s issue of apologizing to the court.

  1. this man called mumba is a let down. day in day out apologising? he does not calculate his utterances before issuing them? then there is no difference between him and sata other than the names. I do not think he is presidential material by far. let him leave the position to kaingu or chituwo. these two are more credible

      I will disagree with you on the assertion that mumba is a servant of God. no sir, he abandoned the work of God to take up the work of Satan.(earthly kingdom). its not the number of sorry s you give that can make you a servant of God but what you say and do. you can say sorry for looking at someone?

    • Only a gentle man can come down to earth and apologise, i can foresee Zambias next head of state, to be honest with you guys, i have been worried and searching who could be the one, i have no doubt it is Dr Mumba, i wish i can say more to support my point, unfortunately not now but i will certainly do.

    • I agree Mumba is fast losing credibility it seems he has been compromised, he says he is willing to work with the Government, the other day he was apologising over KK, today this what next? This is not the type of opposition we want that is constantly apologetic!

    • Ba Matipa,Dr Mumba has never abandoned the work of God.Let me educate you:’Politics comes from a Greek word “POLITIK”.Polik or simply say,Politics,means “HUMAN GOVERNANCE”.In this case you definately need a person who is godly and has a heart for the pipo.not just after making money using human beings as mear tools of production.You don’t abandone God,especialy if you want to lead them.That’s why the Bible says:”When the Godly pipo are in autority pipo rejoice,but when the ungodly are in authority pipo mourn/weep/cry.VIVA NEVERS,VIVA MMD.

    No words may was used but instead was within 90 days, reduced taxes and more money your pocket

  5. Nevers apologising to KK, to court, everyday apologising. Tomorow he will apologise to Sata and then to MMD for joining PF.

      I dont think Dr Nervous will join PF, am suspecting the president will do a Kafupi turn around which saw the late Mwanawasa on the sit.

  6. Why are Zambian leaders so apologetic? No wonder this country will never develop.Mumba has even apologized to KK who we all know is not only a senile retiree but also a st.u.pid I.d.iot. Now he is apologizing to the corrupt supreme court.Nevers the bible which I know you have memorized states that an eye for an eye tooth for tooth,this means that insult for insult,so why apologize to KK.KK’s own children are enjoying the insults being hurled at their father.

  7. Best way was to secure an appointment to meet KK and respectfully apologise instead of doing this through the press albeit that the misdeanour was committed through the press.

    And if I interviewing Dr. Mumba I would have guided or curtailed him from critisizing individuals the who cannot defend themselves. But then…..
