President Michael Sata fires Stephen Masumba

President Michael Sata has with immediate effect effect revoked the appointment of Stephen Masumba as deputy minister in the Ministry of Youth and Sports.

In a statement made available to the media by State House , the President thanked Hon. Masumba for the services rendered to the Government and wished him success in his future endeavours.

This week the Lusaka magistrate court has sentenced Mr Masumba to one year imprisonment with hard labour after convicting him of a charge of obtaining pecuniary advantage by false pretences contrary to section 309 a (2) c of the penal code as read with section 41 of the Anti-Corruption Commission Act number 42 of 1996.

Masumba is said to have fraudulently obtained employment as accounting officer at the Lusaka Business and Technical College using accounting qualifications which he obtained erroneously from the National Institute of Public Administration (NIPA).

In delivering judgment, Deputy Registrar in-charge of Local court sitting as Principal Magistrate, Wilfred Muma said Masumba should be punished accordingly in order to deter would be offenders from committing similar offences.

Magistrate Muma said he had carefully considered the mitigation factors but stated that the conduct of the accused person had far reaching consequences.

He added that the damage caused by Masumba’s conduct was serious.

The magistrate said the court had a duty to protect the nation against profession decay hence Masumba should be punished accordingly in order to deter would be offenders.

Earlier during mitigation, Masumba said through his lawyer Mutakela Lisimba that he was a first offender, a married man with children, a Member of Parliament, a deputy minister.

He said he diligently and faithfully attended and followed court instructions.

Masumba therefore asked the court to exercise utmost leniency in meting out the sentence on him because he had learnt a lesson and has therefore regretted finding himself in such circumstances.

He further stated that the effect of a longer sentence against him (Masumba) as a Member of Parliament and a bread winner will cause misery to his family and the community he represents in parliament.

He said he (Masumba) was a law abiding citizen, a conduct which earned him an appointment in government.

Masumba further pleaded through his lawyer that a suspended sentence be slapped on him because it delivers the same message as a custodial one.

But Magistrate Muma slapped Masumba a 12 months jail sentence with hard labour.

Meanwhile, magistrate Muma has granted Masumba a K10, 000 bail in his own recognisance pending appeal to a higher court and two working sureties from either government or quasi institutions.

Mr. Lisimba, who is Masumba’s lawyer, confirmed to journalists that his client had been granted bail and that the defence team would proceed to appeal against the whole judgment.

Sports minister Chishimba Kambwili and former deputy minister of Commerce, Trade and Industry, who is also former Solwezi East Member of Parliament Richard Taima were among the notable people who attended the court proceedings.

    • Ba @Sau wasn’t this action a given considering that Masumba indirectly admitted to knowing he was not supposed to graduate? Anyway, go a decision has been made.

      This has nothing to do with the President being a man of action, but what the law says. Once one is convicted even their parliamentary seat is declared vacant. In fact he should have been dropped on the day he was convicted. Do you now see that your ‘man of action’ is not full of cation after all?

    • Let him deal with Mutembo Nchito who also forged a High Court Order in favour of his client.This matter is well known to Michael Sata.Why the double standards bwana Cobra????????????

    • Some people on this thread are either stupid or pretending to suffer from memory lose. Before PF approached Masumba this case was in the courts and in the media. Saulosi, then your man of action went ahead and bribed Masumba to cross over to PF from MMD. Your hero is the chief confu!! he invites dodgy characters around him. If Sata had the heart to develop zambia he should have known better not to bring in Masumba in the first place. Nothing positive will come out of this PF engineered confusion.

    • Masumba should have been disposed of maybe a year ago. This year he should have released from prison after serving a sentence. This case has gone on far too long because of Masumba crossing over from MMD to PF.

    • Kabimba camp baakali. One gone , three more to go. GBM, Kapata, and Kambwili should tread with extra care from now on because the Kabimba camp is on the look out for any one in the GBM camp with traces of corruption. GBM should clean his act of awarding him self defence force contracts.

      Kabimba camp has managed to save their own Masebo because they control the judiciary. Lets wait and see the GBM camp’s next move.

      Are you sure this is about Kabimba versus GBM? You are reading too much into things, man. Slow down. So in your books what Masumba did was not wrong and the only reason he has gone to jail is because he belongs to the wrong camp??? C’mon, things are not that bad in Zambia; Masumba was wrong and the law has just taken its course and he has to serve time in jail. Stop belittling the efforts who work day and night bringing justice to the people. There is politics in life yes, but don’t reduce everything to politics.

      To be frank frank with you the actions of Masumba are nothing compared to the graft that is being swept under the carpet by Sata. In PF there are untouchables like Masebo, Kabimba, and GBM. These guys are stealing billions out tax payers coffers and yet they are protected by Sata. If Sata is to play it fair he should let the ACC to probe Kabimba ,Masebo , Sichinga,and GBM for not following the government procurement procedures.
      Kabimba ‘s handling of fuel procurements , Masebo ‘s issuing of game licences, Sichinga’s fertilizer procurement, and GBM’s monopoly to supply the armed force should all be investigated thoroughly. Otherwise the actions of these people are making the life of a poor Zambian worse off.
      What has happened is good but its not enough to tackle…

    • I feel Masumba is a sacrificial lamb offered to blindfold gullible Zambians to believe that Sata is allergic to corruption. This is 90% a political move. If it were not then Masebo’s tribunal should have been allowed to proceed. Kabimba GBM and Sichinga should have been probed and cleared by the ACC. Why is Sata blocking ACC to probe these officials if its’ not political?

      The jailing of Masumba, though laudable does not go far enough to tackle corruption in PF ranks.

      I hope this is the beginning of more corrupt politicians to be investigated and jailed if found wanting.

Life is so difficult to predict.Masumba was well ok until he started antagonizing MMD who had that killing information about him.Masumba started insulting the party that helped him to become an MP for Mufumbwe and forgot about the burden he was carrying on his shoulders.Its good to appreciate the people that have helped you.Look now Masumba! The appeal may put you again in more serious problem.Mind the offense carries a maximum of 5years imprisonment, unless otherwise you become another Gabriel Namulambe.

  13. Masumba….its not yet too late boyi, my only advise is that you can still seat for that paper at NIPA next yr and you might be given another position in 2015.

Its like u grab yo friends husband as she is divorced u can dance but wen u get a divorce yoself can u dance surely?

  17. Masumba forgot that the media can create and destroy you at the same time. The late Lucky Dube in a song ‘The way it is’ says “Don’t forget the people on your way up the ladder because you will need them on your way down”. The young man Masumba grew too big for his shoes and clamored for publicity no matter how negative it was in the public eye. On this I salute the President for acting quickly and not waiting for the appeals to be dispensed of. Magistrate Muma needs to be commended for sending a strong message to young kids that you do not buy your education but should earn it and that no one is above the law. Shame on those PF MPs who were posing with Masumba for a photo kulibonesha. It shows what kind of life they also lead of bending corners to achieve their selfish goals.

  22. Masumba was know for wrong reasons that is why the law has caught up with him. How can a deputy minister dance like a Koffi Olomide dance and tell everyone that he loves dancing. A lessons to all:
    1.0 There is more wisdom in keeping quiet as people will feel sorry when you are in trouble.
    2.0 Work hard for your qualifications.

  23. There’s nothing to commend the President for doing the obvious thing to do in such circumstances. If anything this reflects badly on him for having appointed this muppet as deputy minister in the first place. The security wings obviously did a background check on this muppet and knew he was a fake. Why then did he appoint him as deputy minister?

  25. Why did Masumba try to bring in the name of the President when he was convicted by telling the media he had phoned the President over the matter? Was Mr. Sata there when Masumba was engaging in crookedness? Did this not happen before he even became PF? He tried to bring the office of the President in disrepute by bringing it in his case. He deserves to be fired.

  31. From the very beginning before Masumba stood on the PF ticket this case was around and the President knew about it. He shouldn’t have picked him to stand as member of parliament. But he saw it politically correct to do saw so as to gain popularity in that constituency. I don’t think its any other reason.

  34. Masumba should explain how he got access to a blank certificate, signatures and the seal? Who helped him to get the diploma? If Masumba cannot disclose how he managed to obtain the diploma he should be jailed for 5 years. I think the case of Dr. Katele Kalumba should be reviewed by the court and the court should jail him for 5 years for stealing. Katele accelerated poverty by stealing from the Zambian people

  35. The bible is very explicit on matters of this nature. The Wages of Sin is Death. But the best we can do is to encourages him soudier on, life is full of ups and downs. All of us go wrong everyday in one way or another. The law is their to put us straight.   37. The institution NIPA is very questionable institute too, President fire the awarding officers also.
    Anyone with NIPA papers at this time can not be trusted and it wouldn’t be wrong to discredit this learning institute.
    For employers stop employing people with NIPA credantionals.

  39. When any worker anywhere is convicted of a crime, they are fired. What does the law say about MPs convicted of a crime because Masumba is still worrying about his constituency? Is it not automatic that he has lost his MP seat?
