Sata’s constitution remarks misunderstood-Kabimba

MINISTER of Justice Wynter Kabimba says President Sata’s statement that the constitution only needs to be amended was misunderstood to mean he does not want a new constitution and that the constitution-making process is still ongoing.

Mr Kabimba said in parliament on Teusday that if the President did not want the constitution-making process to go ahead, he would have dissolved the Technical Committee on Drafting the Constitution.

“If that were true, the president would have dissolved it [technical committee]. He has those powers but its mandate is still ongoing,” he said.

Mr Kabimba was responding to a point of order by Mazabuka UPND member of Parliament (MP) Garry Nkombo, who wanted to establish whether the Patriotic Front government had deviated from its campaign promise on the constitution making process.

Mr Nkombo said there have been varying and contradictory statements about the constitution-making process, adding that the President said the ‘constitution only needed to be amended’.

Mr Kabimba said Government remains committed to the process and that the technical committee is expected to hand over the final draft to the president by December 31 this year.

He was responding to Lupososhi MP Patrick Mucheleka, who wanted to know why Government has not given permission to the technical committee to print more than 10 copies of the draft constitution to hand over to the President and members of the public.

He said the committee will hand over 10 copies to the President and that more copies will be printed after the handover.

Mr Kabimba said Government will wait for the technical committee to hand over the final draft report and bill and that the next course of action will be guided by Government and stakeholders.

He said Government is not contradicting itself and that it will deliver a people-driven constitution, and that it will do everything in the interest of the people.

Mr Kabimba said it is unfair for some sections of society to impose their views on others because of their inability to understand the constitution- making process.

He said there should be equal and unhindered participation from all irrespective of their status in society.

“I would like to implore all stakeholders and participants to desist from pouring scorn and contempt on those whose views are at variance with their own. This is what democracy entails,” Mr Kabimba said.

  1. he was not misunderstood he was understood clearly word by word and he said “Zambia does not need a new constitution but just to amend the current one”. we can only understand and believe you mr wynter if you say he did not mean what he said because of mental lapses due to his illness

    • But politicians, How can you live your life lying all the time? Where is your conscience? You lie in the morning, in the afternoon, and before you sleep you have to come up with a lie for the following day. What a life! Liars!

Why then did someone instruct the committee to print only 10 copies when it was earlier said that hand over to president will be simultaneous with the public? ba-fi color what is it that you want to hide from Zambians? Now i remember RB’s comment over don’t kubeba “afisanji mambala” we are watching all you deeds and it wont be long before you see Zambia on fire. RB become arrogant now tell me where is he now? PF has already failed Zambians in all walks of life.

  4. I fill sorry for Hon. Kabimba.
    It must be very difficult trying to remember these few instances where his “A-Team-mate” has been understood.
    Bottom line, “A-Team-mates” have been constantly misunderstood.
    It must be problem with below average control of English language, hazy line between lies and truth or perhaps perception that 14 million Zambians are absolute dummies.

    • On the other hand, why not publish final draft of the Constitution? What is the secret hidden within? After all, it is the majority of the People of Zambia which are going to accept or refuse Constitution and acceptance or refusal by the “A-Team” its irrelevant in a DEMOCRATIC society.

  5. We lose elegance each time we make these run-arounds of trying to explain something we said in a different way. Kabimba reminds me of a lapdog that twerks each time its master dangles a piece of meat! Why can’t we have simple explanations that refer succinctly to what we assured, or promised? We move timelines, change goalposts, and then try to explain that we never did any of those moves…

  6. This makes me feel a little bit better. Lets keep the pressure on this government. We need a new constitution.
    A word to Ba Shikulu ba Sata. You are an old man (over 70) presiding over a young nation (only 50 years old). Your legacy should not be about how many roads you can build or how many clinics you construct. Your legacy is about leaving a Zambia full of democratic institutions and the rule of law to preserve democracy, dignity and the human rights of our future generations. A strong, people driven constitution is the best way to do so. Therefore, as you enter the evening of your life, you have nothing to lose but to give your great, great, great grand children a better governed Zambia through a strong people-led constitution.

  7. Chi Winter its you who misunderstood what Sata said. The chi man meant what he said that Zambia does not need new constitution. What a bunch of Shameless liars PF are. 2016 you are going out. Fools….

    • It will end. If you analyse properly, you will note that some section of the group have settled down and gone quiet, why? Something is happening. We yet have to know what it is.

In my opinion, these dudes are looking at ways of sneaking in a clause in the constitution to bar anyone (HH) who has never been a ward or whatever councillor or held any public office from contesting the presidential elections. The tenure of the PF is not about delivering to the people but about ways and means of staying in power, no matter how i.diotic the means.
