President Sata to receive final draft constitution alone

The Technical Committee Drafting the Constitution has disclosed that the final draft constitution will be handed over to President Sata alone.

Addressing a media briefing in Lusaka Monday afternoon, Technical Committee Drafting the Constitution Spokesman Ernest Mwansa revealed that efforts to request government to allow them print more copes failed to yield positive results.

Mr Mwansa however failed to state exactly when the final draft constitution will be handed over to President Sata.

“In accordance with our mandate to be accountable to the Zambian people and also precedents set by the Mwanakatwe and Mungomba Constitution Review Commissions, it was our desire to have the stated documents handed over simultaneously to the appointing authority and to the general public, further, it was our desire that government prints adequate copies of the final draft constitution as well as the accompanying documents and this facilitate a meaningful validation process of the work that the technical committee has done by members of the general public,” he said.

He added, “Our request to the government in this regard has however not yielded ay positive results. The technical committee has not been given the mandate by the government to print adequate copies of the final draft constitution, report of the technical committee and the constitution of Zambia Bill to facilitate hand over to the appointing authority ad simultaneously general public. The committee is therefore left with no option but to hand over the documents to the appointing authority alone so as not to delay the conclusion of the constitution making process any further.”

Mr Mwansa also announced that the journey of drafting a new constitution that the technical committee embarked upon two years ago has now come to and end.

Of course it is alone, PF is Sata and Sata is PF, the other 9 copies are for PF A-team to help the preisent read it faster and help you understand it. The message from the president is I should that he should just read it alone.

If that is different, then let him authorise the technical committee to publish it on their website..we don’t even need a printed copy in this day and age ..we have chinese phones now, even our garden boys have them too and even our maids

Sata wants to sneak in some dodgy clauses in the constitution to allow his wife and son ascend to power on a silver plata. What does he take Zambians for?

We know his schemes, of trying to raise the term of office to 7 years and bar people who have never stood for parliamentary elections to stand for presidency. He is trying to doctor the constitution to disadvantage opposition leaders .

Its the quality of the report that is being castigated. You don’t need journalism skills to see the “hype” that someone is building around the facts concerning the constitution. At the end of the day, what matters is that the people of Zambia get their constitution and not the process of how they got it. I like how bloggers are able to see beyond the horizon.

No need to weep and mourn – it will only signal resignation and powerlessness which is an optimum requisite for tyranny. Real patriots will stand up and fight. It is when the government fears the people that true democracy prevails. For now, relax your nerves and let the New Year come in…

Maybe from a different angle guys, the committee was appointed by the same Sata, a national president. Definitely they have to report to him first before anybody. Even if it is not in the constitution processes, even in our various work places when the boss delegates authority of an activity to a subordinate he has to verify the work by going through a report written or verbal by the same officer who carried out the particular activity.

Sata having the privilege of reading the document first, does not amount to altering the statements enshrined there in but will be allowed to give his opinion first before the document is debated by the Public.

I do respect your concerns all above but lets try to be patient enough and time for us to debate will come soon.

Just own up you committee member, you have chewed far too much money. Just give it to the one who appointed you. Giving this document to every stake holder will just open another pandora’s box. These stake holders know no boundaries. They cry for anything. They will anyother day add, subtract, mutiply and divide the same message they submitted yesturday. They will oppose each other over the same correct or wrong sentences within the constitution. Give it to president and keep quite, you have sunk too much money into your pockets.

Newly-elected Kasama Central member of parliament Geoffrey Bwalya Mwamba called for reconciliation in order for people to work together.

Mwamba said people may have been filled with emotions during the campaigns but now was the time to work together.

Earlier in an interview on Saturday, Sata charged that President Banda was very deceptive.

On the PF’s victory in Kasama Central, Sata said at least the people showed that MMD losing candidate Burton Mugala was more popular than President Banda.

Ten copies or one, this is still a travesty. This is not how a people driven Constitution intended to stand the test of time is made. Sata will simply re-write it in a way that either preserves the status quo or accords him further leeway to act at the whim of his dictatorial grounding. Its mostly govt. powers that are meant to be clipped or re-defined by the new Constitution. Thus, not the executive, but the people and their representatives should have the final say – otherwise the whole process, yet again, has been a shameless political falsehood and money making venture at the expense of the tax payer. If we allow Sata to have his way with the Constitution, it will be the last nail that will confirm that Zambia is headed for anarchy.

The notion that President Sata will somehow find it in himself to respect the new constitution once it is in force is at best a very funny joke. History has clearly shown that President Sata has a very big ego. So big that he is a law unto himself. He resents and fights off regulatory framework or anyone who is perceived by society as more ‘powerful’ than him. So I do not know where this excitement about a new constitution is coming from. So, let us just be praying for and ENCOURAGING a robust NGO in Zambia because the opposition will always be weak, regionally based and fragmented. One can hardly tell the difference between MUZ and a political party nowdays!

There you are! Am not sure how many times I called for the Tech Comm not to dare govt on the number of copies as the argument was really stupid for lack of a better term.

All those technocrats on the committee belittled themselves so much over the number of copies and mistakenly fell into the same trap with CSOs who are now agreeing with me that copies can be printed off the internet since the draft document is not embargoed.

Today is 31st December and the Tech Committee mandate ends. The 10 copies will be handed over before 17hrs and all the hullabaloo will be history!

SOME PEOPLE THINK THAT IF THE DRAFT IS MADE PUBLIC, THEN IT WILL AUTOMATICALLY BECOME LAW. THAT IS WRONG.
I THINK THE CURRENT DRAFT IS GOOD AND IT IS THE BEST FOR ZAMBIA. BUT THE WAY WE ARE GOING ABOUT IT IS WRONG. THE OPPOSITION IS PRE-OCCUPIED WITH FIXING THE PF USING THE 50%+1. THEY DONT SEEM TO HAVE ANY OTHER PLANS AFTERWARDS. THE PF IS ALSO PRE-OCCUPIED WITH STAYING IN POWER AT ALL COSTS. AND THEY ARE VERY SUSPICIOUS OF THE INTENTIONS OF THE OPPOSITION. THE BIGGER PICTURE SHOULD GO BEYOND HH OR SATA. AND I WISH WE CAN ALL BE SOBBER, PUT OUR HEADS TOGETHER AND DO SOMETHING GOOD FOR ZAMBIA. AT LEAST THIS ONCE.
