President Sata’s directive to terminate GBM’s contract is abuse of power-Father Bwalya

President Michael Sata’s directive to terminate the business contracts that former defence minister Geoffrey Bwalya Mwamba’s company had with the Food Reserve Agency (FRA) has been described as a dangerous abuse of power.

This is according to Frank Bwalya who released a statement to media in which he described the action take by the president as a form of corruption as it clearly confirmed that the president was involved the awarding of Government contracts.

FOR IMMEDIATE RELEASE

President Michael Sata’s directive to terminate the business contracts that former defence minister Geoffrey Bwalya Mwamba’s company had with the Food Reserve Agency (FRA) is a dangerous abuse of power and intolerance typical of tin pot dictators and it raises serious concerns about the role Mr Sata has been playing in awarding government contracts.

Mr Sata has no power to direct the termination of a dully awarded contract because of personal or political differences. The public is aware that the differences that have emerged between Mr Sata and Mr Mwamba have nothing to do with Mr Mwamba’s businesses.

Therefore, Mr Sata’s action to order the cancellation of contracts Mr Mwamba’s company, Arizona Transport, had with FRA is a clear abuse of power by a president that wants to use government contracts to control people and promote the primitive culture of patronage.

The action of Mr Sata is also a form of corruption and confirms his involvement in the awarding of government contracts. The simple logic here is that if the president can order the cancellation of a dully awarded contract then he must also be involved in awarding contracts to those aligned to him and his party.

Furthermore, if President Sata was not involved in the awarding of FRA business to Mr Mwamba popularly known as GBM, how can he be involved in terminating such business?

Against this background, Zambians must be very worried about what is happening at Road Development Agency (RDA) which Mr Sata has grabbed and put under his armpit. Hence, we challenge Mr Sata to explain his involvement in awarding of road contracts to companies that are aligned to PF.

Moreover, one message that is very clear is that for a business person to get and maintain business with government and state enterprises they need to align themselves to the ruling party and the republican president in particular.

This is against the spirit of entrepreneurship in a civilized society. It is also against the spirit of multi-party democracy let alone intra party democracy.

In the case of GBM, he is still a member of the ruling Patriotic Front party, hence targeting his businesses in the manner Mr Sata has done shows a dangerous type of intolerance that has potential to kill intra-party democracy as well as business initiative.

What Mr Sata has done to GBM speaks volumes about what those of us in the opposition and those with dissent views go through at the hands of primitive governments such as the PF government.

This primitive behaviour is negatively affecting our economy and entrenchment of democracy. It is breeding fear and promoting the big man syndrome.

Finally, we think that such reckless behaviour of Mr Sata will cost the government a lot of money through litigation for breach of contractual obligations.

People like GBM will go to court and get favourable judgements that may make government pay them huge sums of taxpayer’s money.

At the end of the day it is the poor Zambian who can’t even afford to buy a bag of mealie meal who will pay for the primitive and irresponsible behaviour of President Sata.

Zambians should rise and condemn this costly abuse of power by Mr Sata.

    • Well, for those still believing that Sata is not a dictator, here is the evidence for you to digest. If you cant still accept , then just wait until you are caught up in the confusion and your katemba contract is terminated prematurely?. GBM also never believed that Sata is a dictator until this happened.

      Political slavery is the one of the worst forms of slavery still prevalent in many poor countries more especially in Africa. Political slavery is when people , educated on or not are forced to things against their wishes where refusal is not an option, in the name expressing loyalty to their master, a political leader.
      Zambia is one of the countries still practising political slavery. Sata is the master while all his followers are his slaves.

      Only UPND and HH will end this.

But what’s interesting about this development is that both Sata and GBM had been involved in wrongdoing before their recent fall out, by scheming huge government contracts in their favour. If we had an independent office such as South Africa’s Public Protector (PP) we would be asking the PP to investigate both Sata and GBM in connection with these government contracts. But in Zambia who does the public run to for protection against such day light robbery and looting of national resources? Sad!

    • Most bloggers are inexperienced when it comes to African Politics. This is not Europe but Africa.

      In the first place Mwamba’s riches have come about through corruption with the MMD government and later on with PF. This Grade 7 has no more business acumen than any of you. This guy was just in a position to corruptly award himself those contracts. As such if he leaves government he can’t hold to those contracts, another corrupt chap will take over from where he left. Simple rule of corruption – Don’t bite the government that feed you!

I feel very weakened and see no future for our children.   8. Very well put ba Father. FRA should be vety careful. They should not terminate those contracts since Sata has no authority , and there are no grounds for terminating the contracts. If FRA terminate those contracts, the FRA CEO should personally bear the consequences. Otherwise FRA will be complicit in the promotion of the ‘big man’ syndrome and dictatorship in this country. All these matters will be investigated once the PF leaves power , not long from now.

    • In the South (Fred’s bantustan) we say, ‘konahuna silumba, sinzala utunda tubi/chibi.’ Never help a hungry man rather a warrior for when the hungry man is satiated with the food you have offered him, he will do evil/wrong on you!! And so it is with GBM and Sata. The poor are now rich and powerful and will oppress if needs be to death their erstwhile saviour. So the march of life and greed goes on. Who remembers Emmanuel Kasonde (late Kasama MP), Maina and others when they resigned from Chiluba’s government to form was it National Party? My advice to GBM is to work with the private sector to sustain his business. FRA is not the only one with transport contracts. What of the mines, coal, etc .

A proper draft constitution must provide as follows: “To qualify for plot 1, a candidate must own atleast 7 hactares of productive farmland, as opposed to owning 7 firearms.” Among other things, this provision will ensure food security is assured and we gonna put a break to having pretenders somewhere in independence avenue.

I know there is a perception that HH’s party is tribal, but what we have witnessed with PF I guess people will start changing their opinions. And this tribal issue should not even arise in these modern times due to the intermarriages that are happening between tribes.

( Not that I am in favour of any priest becoming a political leader) jesuit fathers for instance are mandated an education in their tine of priesthood, not through the Zambian government if you know what I mean. And no Catholic either, but like today’s young Zambians the wits to want to understand what’s stale or fresh, have respect for knowledge and freedom, because people worked hard for this democracy and rule and law we are enjoying and unless you stand up to this trial and error appointments. Although what has happened to GBM is bad , people should never forget that not long ago , he was busy wanting to succeed Sata through the back door of wanting to hound Kabimba by painting him ‘Black’ and using money to rise against a friend. ‘Do unto others as you would love them do unto you, love your friend as yourself’, KK still teaches. In as much as it is wrong for Sata to deny Bembas of the coronation of their Mfumu , its equally wrong for GBM to hide behind Chitimkulu whilst knowing full well what he wants is political power.

  44. Sata just dug another grave for himself, the people are watching and he will not get away with his pronouncements after he loses power whenever that is. Issuing such directives are really a source of concern and the president is just exposing himself, it is a pity the entire cabinet can watch the president behave in this manner. Such statements should be far from the highest office. It is really a pity that nobody can differ with Sata on principle and policy, if you object him you are in trouble, what a messy we are in. Sata will have more court cases than any other previous presidents!

    • Luapula, and when he is awarded these damages, who is going to pay for them? Sata or the Zambian people? Why do you refuse to think most times Mr. 60 year old man? I would expect a mature person to first comment on the wrongness of terminating a binding contract when no clause has been abrogated. Why I waste my breath with you, I do not know but maybe I have a hope that one day, you will break these chains of political slavery as wanzelu stated but that would mean giving up your livelihood, wouldnt it? The only way to explain your radical support for PF is if you are a direct beneficiary which you admitted to in a way when you said you were on the ground campaigning. I can only feel sorry for you old man.

  46. I can see a rush to insult the president but can someone tell me they have seen a contract cancellation yesterday as this could not have happenned yesterday or at Christmas. Contract cancellation require a legal procedure and is usually when the contractor is underperforming or has violated the rules of the contract. In this case GBM should not worry and leave the president alone. Why such hype on one resignation?

  47. There are too many ignoramus dunderheads debating a non issue. Who has seen the actually contract that you are wasting time debating? Let GBM publish the contract he signed. A verbal contract can be terminated without notice. GBM signed no paper.

    • A verbal contract can be binding. Intent to enter into a contract can be inferred. However, the issue is not how the contract was awarded. It is whether the president can use political patronage to award and terminate public contracts.

  48. Sata is such an illiterate so and so. He cannot even disguise his corruption. I hope he has found a country which will accept his family when the game is up. He and all those involved in RDA and FRA will be made to dance. He is a deluded tin pot dictator. Like all dictators, he is also a coward. Look at how Gaddafy ended up – hiding in a drain pipe! Saddam was also found hiding in a hole! Of course I am not comparing our sad excuse of a leader to these two dictators. But all dictators in Zambia seem to repeat the same mistakes – Kaunda, Kafupi and now Sata.

  50. Advice to FRA CEO, do not act on verbal instructions, you will suffer when this regime goes down in 2016, ask Chibanda she will tell you her experience while your boss will be taking his tea you will be grilled by the courts of Law. Take this advice seriously.

      This can be stopped, the courts can stop that! Come on Zambians, there are structures already in place to redress this. There are a lot of judges and jury ( meaning the Zambian people like father Bwalya in this case ) with a clearcut sense of wrong.

      Zambia is capable of bringing down injustice, we have demonstrated that before…they will not let this go on. GBM resigning is for example a visible and tangible demonstration.

  51. Can we not collect signatures over this? Father Bwalya, can somebody quote the laws which have been broken, and if one cannot sue the presidency, why not sue in individual capacity?

      Your idea has tickled my brain. I think it is the best way forward. We can advance any argument for the good of all well meaning Zambians starting from blogs like this one.

      Seriously I am contemplating on trying it and see if it can work. Fortunately all PF information stooges read these on line papers on a daily basis.

  52. I once heard that one politician was “more corrupt than the word corruption itself” and we brushed this aside in naivety. If some people think that they have seen the worst in this Govt that Fr Bwalya meanly describes as primitive then they need to brace themselves for a rude awakening. We have not yet hit rock bottom we are still in a free fall mode. SAD and SAD indeed.

Zambia under the able leadership of Sata is doing very well in all angles, the issues such as relating to the cowardly resignation of the big sack and many others ,those are some of the things but a few that happen in a government. The issue of the big sack must not become a big thing.His uncle or whatever ,Sosala is a political cadre who must be met with force in this political arena. This is not a secret Sosala is an MMD cadre and must be treated just like that period.

    • He has the right to if association, we the generation don’t give a **** what sides or political affiliation one belongs to. Sosala was chosen by a group of respected adults who command our respect, and who have a right to their political freedoms! If you want to compete with chiefs, get the feel of their hierarchy and Presidency and politics are below the ladder. Your parents are parents chosen for you through inheritance and wisdom.
