HH writes to President Sata over the constitution

Dear President Sata,

THE CONSTITUTION HAS BEEN HIJACKED

The above captioned which is also reported as your utterance by the Post Newspaper Limited refers.

We are pleasantly surprised that in over two years of your administration, we have finally agreed on a subject. We wish to remind you that during your inaugural speech to Parliament on 14th October, 2011, you promised the nation that the Patriotic Front (PF) administration would deliver a people driven constitution within ninety (90) days.

This declaration was made long after the campaign period and the Zambian people believed that you were not politicking but making firm commitments, particularly with regards to fulfilling the dream of having a people driven constitution. Alas, over one thousand, one hundred and fifty (1,150) days down the line, the constitution still remains an illusion. The people of Zambia are left to wonder whether the ninety (90) days referred to in your speech were rebased days!

Reflect seriously on the following:-

· From day one (1) the constitution making process was doomed to fail as it lacked a legal framework to protect it. The Civil Society Organisations (C.S.O.) have a refrain, ‘Process Protects Content’;

· How can the PF deliver a people driven constitution when the PF President is in the fore front of violating the terms of reference under which the Technical Committee was appointed? The terms of reference clearly stated that the final draft was to be released to the executive and the people simultaneously. Now the ‘hijackers’ have changed the rules by insisting that only ten (10) copies should be delivered to the President.

It is becoming clear, that your administration is embracing the same failed strategies on constitution making that previous Zambian governments have tried. The path you are leading the country on is lending legitimacy to the failed constitution making processes of the past that you criticised not so long ago. These failed strategies have cost this nation both time and money without producing a document that could stand the test of time.

Your administration is not standing with Church mother bodies, civil society organizations, opposition parties and people in general on this matter. The only ones that seem pleased with the way things stand are the Minister of Justice, Hon Wynter Kabimba, Information Minister, Mwansa Kapeya and a few Patriotic Front zealots. Is this not telling? Posterity will find the PF on the wrong side of history.

Your policy on constitution making is in tatters, as there is no clear road map. It is ‘Chipante Pante’ all the way.

As a way forward, we propose the following:-

1 Immediately release the final draft constitution to all stakeholders and the people electronically and in print.

2 Table a bill at the next sitting of Parliament to create a legal framework to protect the constitution making process.

3 Immediately constitute the referendum commission to prepare for the referendum.

We trust that our proposals will be given your most favourable consideration.

  1. But HH, ati “ni chipante pante”, where did you see Sata kick a ball, with that kind of walking sure? Just imagine asking Sata to kick ball with left leg, it will be a memorable miss of ball and his fall will be worse that the chaotic fall of PF is experiencing.

    • HH you are wasting your time. The people in Mapatizya and Mporokoso have no problems with the current constitution and are not in a hurry to change it. All they want are roads, schools, hospitals

    • A picture of kindergarten boys in a pitch playing football came to mind. Where the ball goes, there every one goes, no order, no one keeping position – hehehehehehehe.

      Accurate description of one govt I know. Any one does or says anything – pure dis-organisation.

    • I remember in the village when playing “Chimbompo” a ball made of plastics.
      regardless of the number in the play fields, all we cared was where the ball went. the other just removes the shirts. No rules and the team with most talkative person wins.

      Be careful. Those letters (replies) are genuinely from Plot 1. You must be summoned to Woodlands police station for insinuating that they (replies) are not from plot 1.

    • …but for sure Sata’s response will start with “your useless letter refers”. Something like that; he is sooo predictable in his unpredictability!!

    That HH cannot even be president…
    If by chances he can be president by manipulating MMD, I’ll leave this damn country and go to Zimbabwe….

    He thinks Zambia is a Ka company or ka Farm and HeHe think Zambians arr Cattle….

    so, HH, instead of exchange panches with ba Sata what is your selleable message to the zambian people? mind you Sata worked hard to be where he is. I remember when I was in zambia I listened to him on radio ichengelo that was 12 years ago and his party had only one MP. dont just please ZWD, try to bring in bena bwinjimfumu paper, let them support you.

    • Instead of just waiting to criticize. We the bloggers are already doing that very successfully. We want ideas and policies. What will ou do for the country, not just telling us about chumbu. And people are talking about no discipline in your party. Which one of the Vice Presidents is it they are referring to who is indisciplined?

    Chumbu munshololwa, it is good to be born a child, but bad to remain a child.

  9. The message is clear but ka language is something else and now HH is lining up for serious punches from Chella. When you approach people with good language expect a more reasonable response, as we already know, state house has the habit of being sarcastic and we should expect such response especially that he HH’s letter is written in form of an attack and not seeking audience over the matter.

    • @The Observer, in the past HH has tried to be civil and moderate his language when writing to Sata many times, but that has been misunderstood to be a sign of weakness. All HH (and other parties) have received in return is abusive language not fit to come from a Head of State. So, now Sata is getting what he dishes out. What goes around, comes around. In fact Sata has much more verbal attack of his own making coming his way. Sata has brought nothing but shame to our Country. He is nothing but a conman.

There you are now; the cobra is spitting venoms into your eyes. Do the right thing before it transmutes itself into a python and swallow the whole lot of ye.

    and Sata are of HH, coming to constitution, America is where it is now because of a great constitution, which they proudly brag about, a good constitution will give us pride ,security and keep us from making same mistakes 50 years and we still so impouverished

  17. MR HH MAY BE HOPING THAT BY THE NEW CONSTITUTION, HIS CHANCES OF RESIDENCE AT PLOT ONE WILL BE HIGHER. WE CAN FORGIVE HIM. AFTER ALL OUR CURRENT CROP OF OPPOSITION LEADERS ONLY WANT SATA OUT OF STATE HOUSE AS THEIR ONLY CHANCE OF STEPPING INTO PLOT 1.
    HOWEVER HH HAS STATED FACTS HERE, WHATEVER HIS MOTIVES. AND PRESIDENT SATA WILL DO WELL NOT TO IGNORE WHAT HH HAS SAID. LET THE PRESIDENT ACT OVER BOARD AND LOOK BEYOND HH. LET HIM SEE THE GOOD THAT IS IN THIS NEW DRAFT. YES THE OPPOSITION WILL ALWAYS BE OPPORTUNISTIC IN EVERYTHING. THAT IS THEIR NATURE. BUT A GOOD LEADER REMAINS FOCUSED NEVER CHANGING PLANS SIMPLY BECAUSE HH OR NEVERS ARE APPEARING OPPORTUNISTIC.LET SATA EMULATE GREAT LEADERS LIKE MANDELA WHO WERE READY TO SACRIFICE EVEN THEIR LIVES FOR THE GREATER GOOD OF THEIR PEOPLES.
