Supreme Court Judge Marvin Mwanamwambwa has ruled that MMD Lunte MP Felix Mutati was duly elected in the 2011 general elections.
Judge Mwanamwambwa upheld Mr Mutati’s election in the matter in which PF losing candidate Emmanuel Chilubanama had petitioned the election results.
Judge Mwanamwambwa dismissed Mr Chilubanama saying it lacked merit.
Mr Chilubanama had petitioned Mr Mutati’s election victory in the Ndola High Court on grounds of corruption, intimidation and bribery and his petitioned was thrown out.
Mr Chilubanama had alleged that Mutati had on September 15, 2011 donated desks to Kabwesha Community School in Lunte Constituency.
Mr Chilubanama had also asked the court to nullify Mr Mutati’s election on grounds that his wife, Grace Chipalo, a medical doctor specialised in eye treatment distributed medicines at James Mutati Village, in Lunte Constituency shortly before the September 20, 2011 general elections.
Mr Chilubanama contended that the distribution of medicines was meant to woo people to vote for Mr Mutati.
He had also alleged that Mr Mutati on September 14, 2011, distributed food to the electorate at Mukupa Kaoma Village and asked them to vote for the MMD.
Mr Chilubanama said the PF cadres were being intimidated by the MMD cadres who were in the habit of disrupting meetings.

And tell your Sata that we that draft constitution that he is keeping in his bedroom. Ask him if a Pastoral Letter from the Catholic Bishops has been read to him(because he cant read on his own). ASK HIM THESE TWO QUESTIONS AND GIVE US THE ANSWERS QUICKLY QUICKLY.
Of course Sata told the judges not to nullify all the petitioned parliamentary elections. And blockers don’t rule out Mutati from the list of those in contention to succeed ifolo!

The senseless spate of by-elections are eroding our national economy and thus stagnating the much needed development in this country. Senior patriotic members of the Judiciary do not live on Planet Jupter, but are well integrated into a diversity of our communities to appreciate what God expects us to deliver to Mother Zambia. A Judicial system endowed with high levels of integrity is our only hope to promote and sustain civilization in this country.
Apparently, these by-elections have been induced by a bunch of a greedy clique of persons who refuse to accept the tenets of democracy. Thank God, the tide of normality can now be seen at the far distance in the horizon of the seas of hope.
