PRESIDENT Michael Sata has said Zambia already has a Constitution in place and that public officers should not be part of the debate about a new Constitution since they swore to uphold the current document.

“Don’t talk about the Constitution,ignore those who are talking about the Constitution every day. We already
have a Constitution in place which you swore to uphold,” the President said.

The President was speaking at State House this morning during the swearing ceremony of former Kitwe Town Clerk Ali Simwinga as Zambia’s Ambassador to Egypt, Godwin Phiri as Commissioner of Police at State House and Pride Kabuswe and Robert Kasezya as public policy specialists, policy analysis and coordination division at Cabinet Office.

The President insisted that there is no Constitutional crisis in Zambia.He said Zambia already had a Constitution in place.

“If there was no Constitution, we would not be here. We are running three arms of Government under the same Constitution some people want to keep talking about,” he said.

Meanwhile the Law Association of Zambia has demanded the release of the draft constitution by whoever is holding on to the document.

LAZ president James Banda whose association is one of the conveners of the Oasis Forum told Qfm in an interview that they have been able to confirm that the technical committee has finished its work hence government should release the document.

Mr. Banda said that it will be irresponsible for the constitution making process to fail at this stage considering the time and resources invested in the process.

He says responsible people should behave in a responsible manner, stating whoever is holding on to the document should release it instead of having scenarios where the document has to be leaked through the media.

Mr. Banda added that government should release the draft constitution and state clearly what the next step is in the constitution making process.

He stated that the next stage of the constitution making process should not be a mystery as government had promised to inform the Zambian people of next step once the technical committed had completed its work.

The LAZ president added that as the draft constitution is being released, the referendum commission should be put in place stating that the Electoral Commission of Zambia can be converted into referendum commission so that they start preparing for the referendum.

Mr. Banda is optimistic that the country will have a new constitution as long as Zambians do not relent in demanding for their constitution.

      I would rather trust Mr Sata than HH or anyone here, thus I am not talking about it

      Remember this is the most IMPORTANT person in Zambia, if he says something we must learn to listen. OR like in an exam if you don’t follow the teachers, you will fail.

      I have tried to ignore @Mushota for months, but cant help first correct her of “hoarse” but more so on the fact that Mr Sata may be president of Zambia but surely not the most important person in Zambia. Such notions are what transform individuals into tinpot dictators.

      Whether with or without the new constitution PF will be beaten hands down come 2016. In fact without the 50+1 clause it will be easier to boot PF out without them claiming for a need for a rerun.

      RB ignored the clause because he thought the current constitution would enable him stay in power, alas he shed tears after losing. If and when people are tired of being lied to no amount of rigging will stop them changing the government. Examples are too many to mention but a good one is Ivory coast. Where is kk today after standing against a frog for 27years?

      Sata’s refusal to release the constitution and his arrogance on many issues affecting the poor majority in the country today is providing powerful ammunition for the opposition to use to boot him out of power come 2016.

    We all know that we have a constitution in place (no need to remind us). We also know that our constitution in its current form has a lot of defects for a modern democracy which we hope for. That is the reason we all agreed (including the PF) to make our own constitution instead of sticking to one which was handed over to us by the colonial masters of yester years….Now what I can say about all these happenings is that a good man would want his latter years to be better than his beginning. Alas, it shall not be so with PF.

Remember Kaunda felt the same, but his time came and tables overturned at blink an eye, from Livingstone through Copperbelt to Nakonde. He had no ideak where to start from but dissolve cabinet and call elections. Our patience is stretched to full tether, we’re choking with your insensitive dictatorial ways. Releasing the draft constitution is not optionaland as you will soon find out.

    Another scheme to waste public resources by giving a chief from Muchinga free money under the pretext that he is an expert in constitution formation process. That is all that constitution review committee was all about sharing the little resources through seating and sleeping in those meetings.

      A COUNTRY WIDE DEMONSTRATION CAN NOT WORK BECAUSE THE MAJORITY OF ZAMBIANS LIVE IN RURAL AREAS AND THEY ARE MORE CONCERNED WITH DEVELOPMENTAL ISSUES THAN THE CONSTITUTION.     Sata was elected mainly because he said he would give us a people driven constitution which will ensure that leaders in office are not there for play like the current situation. How dare he thinks come 2016 this very issue of the constitution will not be key in the election. He will regret like RB. History repeats itself. CSOs, churches and opposition parties should go flat out educating the masses especially in the rural areas and compounds about the importance of a people driven constitution. They should explain clearly how it is linked to national development, corruption, abuse of power, non delivery of farming inputs, arrogance of Govt leaders, absense of MPs especially in govt from their constituencies until election time, nepotism, tribalism, lies (donchi kubeba), selctive justic etc

      And just to add on; why did the Pf think it wise to constitute a team of consultants and pay them a lot of money just to dump the draft. PF supporters and leaders it wasnt your personal monies that you have since wasted for goodness’s sakes. you could have even taken that money to a school which has no desks if you knew that you would not honour the works done by the Constitution team.

    Is this all the president can do and say? On the other hand why waste time on Simwinga to send him to Egypt most likely to return in a coffin. Help him by giving him a local consultant job at State House so that his relatives can monitor his condition. This constitution Mr President is a time bomb; why can’t you for change act like late LPM- be on the side of the people.     I just don’t understand why the PF Govt is so ill bent on creating unnecessary problems for itself over this straight forward issue of a NEW CONSTITUTION. Have these people, all of a sudden, STOPPED REASONING properly?

    What stuff is in the Draft Constitution that scares these people to death? The 50+1 majority threshold to be elected Republican President? Wow, one would think a seemingly mature Govt and political Party like PF would relish such progressive Constitutional underpinnings to show what they are really made of as political heavyweights.

    Unfortunately, it appears Sata never even learned any lessons from the experience of the Chiluba THIRD TERM saga he personally pushed so vigorously.

    It is just incredible how African leaders NEVER seem to learn at all!!

The same thing happened in 1991 when people got rid of KK – that time you did not blame Bembas for getting rid of KK because there was no alternative political party.
