Justice Minister Wynter Kabimba has been cleared of any wrong doing by the Judge Evans Hamaundu led tribunal.
One of the petitioners confirmed that the three man tribunal probing Mr Kabimba’s alleged breach of the constitution did not find him wanting on any of the allegations.
Mr Mulusa told Journalists at Supreme Court that the tribunal has found that Mr Kabimba did not breach any law in his conduct as Justice Minister.
Mr Mulusa condemned the verdict and described entire justice system in Zambia as laughable.
“If the tribunal is saying Hon. Kabimba didn’t breach any law when a Supreme court ruling said that Kabimba’s copying of that letter and passing on the opinion from Solicitor General to the Acting Chief Justice gave a perception that there was interference in the matter. So the Supreme Court took a stand that this is what it means and then to have a tribunal comprising High Court judges rule otherwise, I can assure you that the entire judiciary is now a laughing stock,” Mr Mulusa charged.
He added, “This is why the Judiciary should stop referring to themselves as learned, they are not even educated because how can High Court Judges in a tribunal over rule Supreme Court Judges? This is very unfortunate.”
Mr Mulusa suggested that the entire judicial system be disbanded and new Judges appointed.
President Sata this morning received the report from the tribunal and promised to leave the report.
Mr Mulusa along with civil rights activist Brebner Changala had petitioned Acting Chief Justice Lombe Chibesakunda to set up the tribunal in order to investigate whether Mr Kabimba breached the constitution and the oath of secrecy when he shared a legal opinion from Solicitor General Musa Mwenya to Justice Chibesakunda over the nullification of MMD seats.

on thousand UPND bloggers most of them in the diaspora, who cant even vote will not influence the outcome of the 2016 elections.
UPND cant take Lusaka, central, copperbelt, Luapula, Nothern, Muchinga, Eastern provinces even if elections were called today.
They can dominate southern, take a few seats in western and north western and surely, that will never deliver them the presidency.

Indeed Zambian Justice is laughable and some people can’t just see how much damage their single acts are inflicting on the very last structures that the nation SHOULD rely on for sanity.
@Action Man: It isn’t so much about that the opinion being secret or not..but rather the reason why and intentions of Kabimba copying the Acting Chief Justice into his political party correspondence. If that isn’t disputed then Mulusa has a point. Just to challenge your point. We all know that the draft constitution is not a state secret but why is it then so tightly guarded?
@Gen: it’s not a case of “just wanting judgements to be decided in his favour, but rather for “justice to be seen to be delivered” and that is why it is not only laughable in this case but quite embarrassing too.
Kabimba be ware that you have not been cleared but your case has just been shelved for the time when you be in bad books with Sata. In the next government all the cases against you will become live.

If mulusa committed corruption why has not been arrested? I thought the natural course of justice demands that both the giver and the receiver in any corruption scandal are guilty of the offence.

What do you expect when Hamaundu and Kabimba are close friends. A few weeks before the tribunal was constituted the two were partying at Hamaundu’s house. The Judge should have recused himself yet he chose to pretend that they were not close at all.

This was expected, I dont know why this govt. is wasting money on these tribunals when the findings do not represent the actual. there was so much evidence against Kabimba in the public domain, but for him to go scort free is an embarassment to the judiciary. What do you mean the judiciary is laughable??? LUCKY MULUSA should know that petitioning does not mean you have WON the case. In fact petitioning is about seeking legal clarifcation, NOT passing judgement about who is guilty! The SUPREME COURT offered the opinion that the action HAD THE POTENTIAL TO BE PERCEIVED as inteference, so the SUPREME COURT did NOT SAY it IS ILLEGAL. Lucky mulusa should not petition anybody in future if he can’t even understand English. It is him LUCKY MULUSA who needs to be educated. What is happening in Zambia is sad where you take someone to court but already you are saying he should not be found innocent???? Then why did you petition then! This is glaring proof that what Mulusa and Chengala did was politically motivated. Viva Kabimba and PF!

Are you serious that you can not see the conflict of interest in this case? State one case anywhere in the world where a friend to the accused has been allowed to sit on the panel of judges? In fact I can state many cases where an accused has been aquited merely because one of the judges or a member of the jury was seen to say hi to the complainant. Please do not pay a blind eye to what is wrong in your country. Hamaundu is a friend to the accused, he stopped the tribunal prematurely, did not allow the petitioners to call all the witnesses and he has not even had the guts to avail the report to the petioners and you say this was ok? Blind loyalty does not pay. Look at GBM what more you guys who dont even count to PF? Look at the wider picture.

Kabimba is cleared but his reputation is tainted, with a lot of accussations, with questionable clearances. they were calls for him to step down, just like any reasonable person would do, but alas he stayed put, no one likes this guy even

Bravo WK. The Justice Minister conducted himself professionally. It was wrong to expect him as Justice Minister to stand by and watch miscarriage of justice. Justice is not based on perception and allegation. It is based on legal training and maturity associated with experience.
Justice is NOT based on legal training or maturity associated with experience (by the way, Kabimba does not have either) but is based on well established LEGAL PRINCIPLES.
In addition, the Tribunal findings can be subject to Judicial Review based on blunt breach of Natural Justice.
Lastly, keep quiet. You will sound inteligent.
