Legal process required to hold a referendum cannot be completed before 2016-Kabimba

MINISTER of Justice Wynter Kabimba says it will cost Government K15 million to conduct a census for a referendum on the Constitution.

Mr Kabimba says the legal process of a referendum would also take more than 15 months to complete.

He was speaking in Choma yesterday during a special church programme to fundraise for the construction of a children’s chapel for the Choma central church of the Seventh Day Adventist (SDA).

“The new constitution has been delayed by those who want to hijack the constitution-making process. I assure you that Zambia will have a people-driven constitution,” Mr Kabimba said.

The minister, who is Patriotic Front secretary general, said it appears that Zambia will have a referendum on the constitution but the legal process leading to that stage cannot be completed before 2016.

“A referendum under our present law requires that we should first conduct a national census of all those eligible to vote and this exercise alone is expected to take more than 15 months,” Mr Kabimba said.

Mr Kabimba said co-operating partners have offered money for the constitution-making process but Government wants first to ensure that it develops the country.

“While we appreciate the offer of money for the constitution-making process, why should our co-operating partners not give us this money for development first?” he wondered.

Mr Kabimba said the constitution-making process is important but the opposition must not play the political blame game.

The Minister of Justice has since called for unity and consensus across partisan politics.
“We must all rally together and promote advocacy on the constitution-making process,” Mr Kabimba said.

Mr Kabimba said he desires a new constitution the same way the opposition does but the law must be followed.

“None of the political parties in Parliament have two-thirds members and we need consensus and come together to have the constitution,” he said.

Mr Kabimba said the opposition has waged a political campaign against Government on the constitution when it is the very Government that started the process.

“Acrimony will not give us a new constitution, but unity and dialogue [will],” he said.
Mr Kabimba said President Sata has people’s interests at heart and has not back-peddled on the promises made during campaigns in 2011.

The bigger worry for all of us should be that come 2016 when they are voted out of power, will they step aside and allow a new party into office?     • Kabimba should not for once think that the people do not know what they are doing with the money donated to government. Recently they diverted $40 million from the £120 million meant to recapitalise the railways to fund PF operations of appeasement.

      If only that money was used to fund the constitution making process the people would start trusting the PF government. But they are still adamant that Zambia does not need the constitution and hiding under the pretext that there is no money and yet they can spend a lot of money bribing MMD MPs to join the PF , cause bye elections and fund those elections.

    • 1. How different is eligibility to vote in a referendum from that required in ordinary democractic elections such as the 2016 ones? Does this mean the 2016 elections will also be postponed until a national census has been done?
      2. How competent is Kabimba to give us the cost estimate he’s giving – he cant win a single case in court but thinks is suddenly competent in CSO’s work?
      3. Doesn’t this bogus lawyer no that a people driven constitution is a catalyst for development?

    • In case none of you knumb-skulls have done the maths, delaying this matter until after 2016 is calculated to increase the chances of PF winning, i.e. no 50+1 issue to contend with.

      The PF is made up of committees comprising of men and women who individually can do nothing but as a group they decide that nothing can be done. Its a group of shameless lazy thinkers afraid of their shadows.

    • Does Kabimba surely think his statement will be believed when we have concrete examples of countries on the African continent that have come up with a new constitution in under 2 years. Kenya appointed and swore in the Committee of Experts (which included a Zambia, Dr C Beyani) in Feb, 2009. They collected 26, 451 submissions across the country within 8 months. The Draft constitution was submitted to a national referendum which required only a “NO or YES” answer to the question, “Do you approve of the proposed New Constitution?” The constitution went through and on 27th Aug, 2010 Kenya was celebrating the enactment and adoption of a new constitution. The whole process took 19 months. Zambia still has under 30 months before the next elections in 2016. Mr Kabimba, there is still time.

    • We already spent K235m on NCC (MMD time) and K160m on Technical Committee (PF time). So what is K15m to complete the process? By the way, those monies already spent could have built 2 Levy Mwanawasa type hospitals or stadiums. So Kabimba, you are saying (on the equivalent) we might as well bring down both LPM hospital & stadium!! Shouldn’t this man be charged with (a new law) constitution terrorism?? Its penalty should be death sentence (like treason)!

  14. Fellow Zambians, PF has done well in infrastructure development especially roads, schools and clinics construction. They should be commended for that. No one can take that credit away from PF!!

    However, the conduct of the PF cadres at BGOCA, Kabwata/Libala grounds, Mano Radio, harrassment of brother Chipimo in Lusaka, harrassment of HH in Kasama; Police manipulation of the Public Order Act to disadvantage the opposition (which Zambians need for checks and balances), denying us a new constitution, putting to shame the Litunga, Chitimukulu and other chiefs etc will make it difficult to support them in 2016. Hon. Kabimba as SG of the ruling party and Minister of Justice is a contradiction of what the PF promised it stood for. Sad. Really sad. Let it be a lesson for opposition parties.

    How much money have they spent on this exercise already? And how did he come up with this figure anyway, who did the accounting maths for him? Why a referendum anyway when the contents of the document were already contributed by the people. The commissions already went round the country gathering people’s opinions… so just send the damn thing to parliament unedited for adoption and stop worsting our time. Even with the referendum it shouldn’t take that long – the people of Crimea put together a referendum within 2 weeks, albeit with Russian help.

Poverty is more complex to deal with than the Legal process to hold a referendum. The New Constitution is suppose to be the foundation of everything. When the oppostion and CSO were in Eastern province police issued a warning to deal with anyone taking about the issue in church what has changed now ba IG.This is why the people of Zambia and the world have lost faith in the Zambian Police.

  32. In my view a referendum is unnecessary as key issues are not in dispute with majority of Zambians. Parley can therefore adopt at almost no cost other than what they are already paid. Things like dual nationality have a good precedent where they work and all we need to do is strike off a few countries from eligibility and in Africa and elsewhere these are obvious;
    (i) Congo DR (already too many as it is in Luapula and Northern)
    (ii) Sudan, Somalia, China, India …

    Add to the list as you see fit …

You never talk about (sustainable) development without having better laws(constitution) first. It is like building a house without a proper foundation.   34. Was delaying receipt of the draft constitution from the Technical Committee part of the ploy to buy or waste valuable time? It is interesting to be told now that “development” is more important than a constitution. Development is an on-going process and there will never be a time when a government will say now we have developed, we can look at the issue of governance or constitution. Where are we headed to?

  42. The Minister of Education sir, We the daughters of Zambia camping DK secondary school for inter provincial games are going through a lot of problems of abuse and defilement’s every day . All this headed by a man called Justine Simbeye impersonating as a coach track and field coach and teacher. This the issues have been taking place almost every year of camping .

  44. Here we see how lawyers are only make things difficult in society. Kabimba takes himself to be a lawyer and has powers as of now to object any sensible opinion from Zambians. On the other hand, technical committee comprised of most lawyers and yet in their jargon words and semantics hold the entire nation to ransom. Lawyers have to be trusted with a pinch of salt and certainly not in influential posts in governments. Administrative technocrats are better than lawyers for a country.

  45. News item- Simataa by Mathani. How on this earth Mathani is suing everybody, he is entangled with everybody-cobbles, bankers, politicians, foreigners, Zambians, Churches, NGOs. He cries foul when he is sued for money laundering, taking others assets but becomes a Saintly Figure when useless President is bribed and provides him protection. Mathani your days are numbered and take my word next government of HH will not only make you account for all the stealing, bribing and atrocities you committed on your ex-employees and partners, you will be sent to prison and you with your prostrate cancer (you will be on TV looking for sympathy) and Heart problem (you will try to politicise it but you know it is your own creation) and STD (You got it with your own deeds) will be on fast track to Hel.l

  46. RUSSIANS are cleverer! They dealt with constitutional issues in a matter of hours and absorbed Crimea. Zambia! Always can’t do this, can’t do that! Fear of change or resistance to change is due to the huge benefits people in power like Kabimba enjoy, which they will never let go off voluntarily.

Dear Mr. Kabimba, we were ably informed before the 2011 general elections that you, Mr. Sata and PF collectively had no capacity to govern this country but we did not believe, however, we now believe we have no capacity to take this country anywhere- not even to bring water in our compounds. I can predict that 2016 you as a party will not be walking in the corridors of power- I personally feel as party you have no direction and for the sake of this country- I hope you and PF will withdraw from participating in the 2016 general elections so you allow serious people and parties to contest- however even if you contested YOU WILL BE OUT OF GOVERNMENT!

  49. It makes sad reading to note how the constitution making process has been riddled with lies. The question still remains as to whether or not the PF will deliver this document, considering the number of statements and counter-statements from several government officials and the committee drafting the constitution.

    It is a lesson learned many times. there was need to have a legal constitution making roadmap and this would have allowed us to take the government to court for failure to deliver a people-driven constitution. As it stands, it is just the issue of morality and not legality for the PF to fail to have us our constitution.

Pliz pipo shud no tht 1 of th major rison why we hav failed to achive proper developmnt, thy ar so many loop holes in da constitution such tht ther is major misappropriation of funds and evn stealing. I cn assure tht with a proper constitution da development tht cn b attained in da next 10years cn b attained in jst 1year.
