Vincent Malambo applies to join the case of President Sata Vs Richard Sakala

Prominent Lusaka lawyer Vincent Malambo has applied to be joined to the matter in which President Michael Sata has denied defending his friends, Director of Public Prosecutions (DPP) Mutembo Nchito, Post Newspaper owner Fred M’membe and Nchima Nchito who owe the Development Bank of Zambia K14 billion which according to Judge Nigel Mutuna was obtained by fraudulent misrepresentation.

Mr Malambo who successfully represented DBZ and won the case against the trio and Zambian Airways in the High Court in the recovery of K14 billion loan was eventually removed as the lawyer of the bank after he refused to withdraw the matter from court.

Three weeks ago, President Sata in his evidence in-chief claimed that Mr Malambo could have been dismissed because of incompetence.

But now, Mr Malambo has said President Sata’s statement was injurious and has applied that he joins the case in which the Head of State has sued Daily Nation proprietor Richard Sakala and academician Choolwe Beyani.

The matter comes up on June 24, 2014 and President Sata is expected to be in the dock for cross examination.

    Can’t wait for the cross examination… so who has to grant V. Malambo permission to join the case? Is it the presiding judge or the defendant team? Please add Saki Sakwiba to the case too so they can go and demonstrate and prove how insane our President really is.

      Its not like Sata is going to court as a Pro-se

      Sata has his own legal team and besides, there are rules that govern the conduct of court proceedings.

    Am liking this! Winter K betrayed Ba Sata by allowing him to appear in person in court, this could have been dealt with by AG now malibu yakuilombela. Yes allow Vincent to be Joined to the case as his name is also in the centre of the case. Can’t wait for 24th June i wish i can be in Lusaka and in court to hear for myself.
    Also advice does it mean President Temporally Strips off his immunity when in Court? I expect all appearing before the Courts of law to be equal before the Law, please someone explain to me .

    I personally know vincent from chingola where he started his career. he is a very shrewd lawyer and am sure sata is in hot soup considering his lame and low education. let us wait and see. this sata made the worst mistake of his life as his level of thinking will be exposed to the bone marrow

    I have a few questions.
    1. Who advised ba Sata to appear in court?
    2. Did ba Sata consult Mumba Malila?
    3. Was Mumba Malila in court that day?
    4. Why did he assume Malambo was incompetent?
    5. Why did WK and Bonaventure both SC’s advise the big man to stay away from embarrassment?
    Am sure the appearance was for fun he will not appear for cross examinations so it will struck out of records of the court. I suppose heads are now rolling at Nkwazi house

    if mmembe nd nchito borrowed this money in their companies ltd names they cannot pay back in their personal capacities as per CA 1985/89. whether malambo or chilambo or kilambo or filambo or pilambo or zilambo or tilambo or hilambo or gilambo applies to join the case, nothing ll change what ll change is malambo’s life coz the chap is broke wants cash. apilefye hilambo.

    Excitement of small brains sata is the appointing authority for the judges. Nothing will come out of this if we have failed to get justice from former heads of state what of the sitting one only ***** will get excited about this viva sata viva PF come 2016 only ifinang’ani ifipwisha the all day blogging amafi are the one complaining.

      Be careful what you are wishing for.
      There are Judges which are there because they failed in private legal practice and then there are Judges for whom rule of law has been scope of life.

    This is a strange phenomenon for an incumbent Republican President to so recklessly throw away His immunity and end up be tossed up by brilliant Lawyers in Courts of Law. The scheme by Kabimba, Mmembe and Mutembo Nchito is coming to fruition just to get a Head of State embarrassed so as to flag their alternative man. The plan by the plunders of national resources is to install their preferred species to take over the reigns of PF Govt. The Cobra has been reduced to an EARTHWORM.
