Supreme Court throws out bail application by Musician General Kanene

The Supreme Court has thrown out a bail application pending appeal by Musician General Kanene.

Supreme Court Judge Albert Wood ruled that the appeal case will be heard in less than two years and there is no possibility that Clifford Dimba alias General Kanene would have completed his 18 year jail sentence for defilement.

Judge Wood has ruled that Kanene will remain in custody until when his case comes up for hearing next year.

General Kanene’s lawyer Treshford Chali has however disclosed that he will appeal against the ruling before a full bench of the Supreme Court.

“What was happening today was the bail hearing application to a single Judge but he has denied it. So the option we have is to make the same application to a full Supreme Court bench,” he said.

General Kanene was sentenced to 18 years imprisonment for defilement by the High Court this year.

And Mr. Chali has refuted reports that his client is on hunger strike.

“These reports that Kanene collapsed and he is not eating are not true. My client is in high spirit and he is coping very well,” Mr Chali said.

  2. Its so sad how this happened,when l read the news here in sa and looking @ the picture of the lady looks like she’s old enough and new what she was up to. So ya ne,l hope the appeal will be in a reasonable manner

  3. there are so many defilers who have been sentenced to more than 18years and still in prison. if really that is the true age of tt girl, y complain? jst sve the sentence so tt others can learn fr. you. God b with you Kanene as u a in prison and if he wanted to b pardon the every one b pardoned cos we o have relatives who have bn jailed wth the similar offence

  4. I feel Kanene has not been fairly treated because the girl is a sex worker and so the judge should take that into consideration. If the stories about her having a child are true, really I think the girl is not innocent in this. What about the fact that she was found in a night club.

      ..having a child or found in a night club may not be used as the basis to determine the age of the girl. That 10-yr old girl in Kaloko township in Ndola fell pregnant may have delivered by now. If the same girl happens to visit a night club and any man pounces on her…he shall be committing an offence of defilement that is if the age is supported with either birth certificate with clear date of birth..e.g 9th Feb, 2004. However, there are other circumstances which don’t require proof of age like a baby in diapers or a 5, 8, 11 year old. But when the girl gets into 14, 15, 16 range…for some girls, it becomes abit tricky to determine their age just by looking or otherwise… other than birth certificate details..which is missing on Kanene’s case…..

  5. ..no-one condones defilement….its a very barbaric act…but kanene’s case is still clouded with the fact that the age of the said girl has not been established ‘beyond reasonable doubt’….which is the basic requirement for every court case…..

  7. Our judiciary is rotten and too compromised. According to our constitution gays are supposed to serve a minimum of 15 years, but look at the kapiri “couple” just because donors got involved and tied their aid to the so called rights for the gays, the court decided to quit them. Kanene’s issue is not different. That lady has a child and we can’t say that she is under age. God is watching.

  9. but pipo ar vry funny, so wht if da gal had a child? Tht shud nt b a defence… Having a child does nt increase her years! He took advantage of a young gal and 4tht he hs pay… Who in ther ryt mind let a man who slept with yo child go bcoz yo child made a mistake and had i child(who z less thn 16 of tht mata)?
