I qualify to act as President, parantage clause misunderstood by many people-Guy Scott

Vice President Guy Scott has said that he duly qualifies to act as President in the absence of the Head of State.

Speaking today during the 30-minute Vice President’s question time in parliament today, Dr Scott clarified that he duly qualifies to act as President in the absence of the Head of State and that the parentage clause has been misunderstood by the Zambian people.

He said ‘brains in the judiciary” including lawyers and the Law Association of Zambia are aware of this development.

And Government says it has guidelines and structures for honouring statesman and women, including freedom fighters.

Vice President, Guy Scott, says government has structures available for national leaders.

Dr Scott, who is also PF Lusaka Central Member of Parliament (MP), says it is the consideration of the Head of State to honour a statesman or woman or freedom fighter to be given a medal or to be named after a public institution.

The Vice President was responding to a bonus question raised by MMD Mwandi MP, Michael Kaingu, who wondered why some statesmen and women, including freedom fighters in Zambia, were allegedly not being honoured or recognised by the State for their immense contributions rendered to the government.

This was during a ministerial statement issued yesterday in parliament on the preparation for the golden jubilee independence anniversary. The jubilee theme is dubbed, “Commemorating God’s Favour of Zambia’s 50 years of independence for continued peace, unity, democracy and prosperity.”

Dr Scott singled out educationist and veteran freedom fighter, Mutumba Bull, who was recently awarded by President Michael Sata with the order of distinguished service first division, together with late Prison Service Chief, Gibby, Nawa posthumously.

He was quick to say that some veteran politicians have benefited awards before from former Presidents to the current Head of State, translating to being awarded more than once.

President Sata has named K107 million Robert Makasa University in Chinsali district in Muchinga Province after veteran freedom fighter, Robert Kapasa Makasa.

The Mwandi law-maker, who clarified his question through a point of order, argued that giving medals to statesmen and women, including freedom fighters, was allegedly not enough when others were being named after public institutions like universities, schools and hospitals.

Dr Kaingu caused laughter in the House when he said people did not recognise renowned Zambian, Paul Mushindo, who the Head of State has named Paul Mushindo University in Lubwa Mission in Samfya district in Luapula Province that is currently under construction.

And in guiding the House, National Assembly Speaker, Patrick Matibini, ruled that leader of the House, Vice President Guy Scott, was in order in his response to the point of order raised by Mwandi MP, Dr Kaingu.

“There are structures put in place especially in awarding national leaders. Therefore, His Honour, the Vice President Dr Scott, was not out of order in his response to the point of order raised by Dr Kaingu,” the Speaker said.

Meanwhile, MMD Chadiza MP, Allan Mbewe and his Mafinga counterpart, Catherine Namugala, were angered when the Vice President allegedly refused to disclose how much money the 50th Jubilee Anniversary would cost.

But Dr Scott said no country in the world can fail to celebrate its own jubilee.

Dr Scott counselled the parliamentarians and said the total amount of the commemorations was not important but to focus on putting energies on celebrating the peace Zambia has continued to enjoy since attaining her independence in 1964.

    • In short, Guy Scott is saying that he is well positioned to act as President in any evident that Ba Sata was not able to be found as he is currently classified as a ‘Missing Person’. Scot is saying he is also positioned to take over as President. He is implying that Lawyers and the Judiciary are not wise and intelligent to see this. He is actually insulting their intelligence – I am not shocked. He is a continuation of British colonialism in Zambia. (He is a modern racist in a Blackman’s world- Martin Luther King).

    • It will be interesting to know which home Scott grew up in.
      He never stops amazing me at the level of his arrogance.
      Surely, can he tell the parliament that it was not important for the leaders of our nation and the general public to know how much the celebrations of the Golden Jubilee was going to cost?
      Then who should know? I thought that was public money used which needed to be a public concern.

    • The constitution says a president should have both parents born in Zambia. Technically speaking only those people whose parents were born after Independence in 1964 when Zambia was born can be president and act as president. This raises the question if President Sata is legally allowed to be president of Zambia. Following the letter of law strictly Sata and Guy Scott do not qualify for their positions!

    • I 100% support Dr Guy Scot over the parentage clause to be scraped off from our constitution because it’s discriminatory, and we know how that clause came into being it was birthed by stupid and selfish individuals SATA and Ka CHILUBA. If sata is truly dead(and I hope so). Then let’s not waste time can Guy scot take the leadership mantle , for me Guy Scot is much better abnormal than Sata

    • Scott, no please don’t say that old man. You said, just four days ago that the parentage clause was a bad clause and you wanted wanted it changed. This made Saki to contribute to the topic. Now today, under a week you say you qualify to act as president and people don’t understand it. This is the reason we are saying GIVE US OUR NEW CONSTITUTION where your interests under the running mate clause allows you, Scott, as vice president to automatically act as president and in the very sad event that HE Micheal Sata disappeared permanently you would automatically become president to finish his term of office. So many U-turns at short notice. Swine!

    • @1.2 Ola – Scott has always been eligible to act as President if the sitting President is away or incapacitated. Please read your constitution before criticizing the fellow. In fact, its like he just read it last nite cause he has always maintained that he can’t act – until now.

  1. Well, succession battle phase two. He does qualify based on this case,

    Lewanika and Others v Frederick Jacob Titus Chiluba (Constitutional Jurisdiction) (S.C.Z. Judgment No. 14 of 1998) [1998] ZMSC 11 (10 November 1998);

    but PF are just too dull to understand this judgement and later on do what was suggested.

    Anyway looks like there is some repositioning happening in PF. This movie keeps creating captivating plots

  2. Iam 65yrs old,i never heard of a renowned freedom fighter named paul mushindo,can someone shade more light.

    • Mr. Paul Mushindo was a renowned church leader who worked at Lubwa Mission to spread the gospel, especially after the death of Mr. David Kaunda. He authored books in Icibemba such as ‘Amapinda mu Lyashi’ (1958) and ‘Imilumbe ne nshimi'(1957). Tha is why he has been honoured posthumously by naming a university after him Paul Mushindo University at Lubwa in Chinsali. It’s good to honour our heroes.

    • A few months ago i came across a book Paul Bwembya Mushindo wrote.The man was a very accomplished writer,leader and moralist.He deserves to have that university named after him.

    • For those who don`t know Paul Bwembya Mushindo also played a very big role in translating the bible from English to Bemba.He was among the first breed of African intellectuals and thinkers in the pre and post colonial days

    • Mushindo was indeed a cut above the rest.Educated by colonists ,but his thirst to share his knowledge with his fellow Africans was commendable.Todays generation can say bad things about him because they don’t understand how the economic and social situation was by then.

    • @Saulosi- I agree 100% He was a very good writer and I still have some of his books on my book shelf currently- Those questioning him is a sign of poor reading culture in Zambia. In one of his books about Imilumbe sha Chibemba he writes, Kana Mwansa Kali Mwisamba Lya BaLume Kaleteta, Chi chipelelo cili kwishilya lya mumana na chikolwa chiletukana- means, Mrs Mwansa, is under her husbands chest enjoying his warmth while another disgruntled and poorly brought up woman is drunk insulting passers-by: This is moral advice: Paul Mushindo.

It is a waste of time trying to pump sense into people who are incapable of accepting opposite views. Let’s look at his performance in government starting as far back as Minister of Agriculture under Kafupi, the yellow maize scam and railway truckloads which went missing during his time in office. Fast forward to the current time as Vice President the man takes a great pleasure in passing very derogatory comments example what he said about South Africans which true or not had it not been for Kaunda’s presence at Madiba’s funeral would probably have seen Zambian visa free travel to SA revoked amongst other penalties. The way he will talk one way to his fellow musungos and then speak to us blacks as if we are all just some illiterate grade 2s.

  5. Lubwa Mission is in Chinsali, the birth place of KK. While LUBWE Mission is in Samfya. The two names are similar, but very different. Paul Bwmbya Mushindo was a reverend in LUBWA and preached in the area, especially after the death of David Kaunda. He has written two Icibemba books.

    “Whenever the president is absent from zambia or considers it desirable so to do by reason of illness or for any other cause he may by direction in writting,authorise the vice- president,or where the vice- president is absent from zambia or is incapable of discharging the functions of the office of president,any other person to discharge such functions….”
    So each time Sata has been appointing someone else instead of Muzungu opusa he has breaching the constitution while the useless MP’s watch on and only wake up when the issue of allowances arises.

Lack of intellectual capacity landed the so called politically-enlightened Bembas to opt for being led by Tanzanians and Scottish invasive species. Point of clarification LT, Paul Mushindo was a gallant freedom fighter and a compatriot of Kenneth Bichizya Kaunda, Simon Mwansa Kapwepwe, Robert Kapasa Makasa, Malama Sokoni and many more whose political activism was born at Lubwa, Chinsali. Lusaka Times learn from me that Mushindo University is not in Samfya, Luapula province but in Chinsali, Muchinga province.

    Sata appointed more than the designated nominated members of parliament. He had to drop a named person. Then Sata appointed a certain Guy Scott as VP, white as they come, from a famous colonial line of nice guys. Who screened? None!
    Scott has been substantive all along until time comes for him to claim the Prize. Mind you, who has been the brain behind the otherwise-would-have-been a dysfunctional PF; Guy Scott!
    Compatriots, women and children, Guy Scott walked sometimes with bare feet playing with black kids because that was his Dad’s attitude. He deserves the top job. He will give you a robust constitution that none of the Pretenders to the Throne is promising.

  18. 90 days might set the tone of governance for next President to follow. He may even abolish draconian laws and get constitution approved in parliament.
    Let us not look at skin of people. Those days of black, white, brown and yellow are long gone. A thief as a President just because he is black does not bring food to our table, does not improve hospitals, law and order. A British, an Indian or a Serbian with unblemished background might deliver us what we have been yearning for years.
    On same vein we shall stop looking at peoples’ tribes. As an example compare and contrast Zukas with Chiluba and Sata. Choose what you think has contributed more to the cause of Zambia and stood by it through and through. Whose life has been an exemplary example?

Let’s honor people that have a national appeal, that that have achieved something that has been recognised or has had an impact on the majority of the people. We are now told by his ministers that it’s not nice in AFRICAN CULTURE to mock or sick people or talk about other people’s ill-health even if our president used to talk ill of Mwanawasa’s health.     Kabimbas attempt to convene a Cabinet meeting when Sata was in Israel was thus a serious breach of the constitution and the Ministers who refused to attend did the nation a favour in upholding it.

  25. Functional illiterates. What he means is, as long as he is in cabinet he can ACT as President. Whether both his parents were born in Zambia or not.   26. Is it any wonder why Sata and Scott have been friends for so long? Apart from being smoking partners, Sata and Scott are cut from the same cloth. They both live in Utopia and think Zambians are gullible. Scott has tried all his best to put Kabimba as president and now he is ready to impose him when he becomes acting president in a matter of days. He is preparing Zambians on his coming acting appointment. He wants to make sure that GBM, Kambwili, Lubinda, Chikwanda, Mulenga Sata are no one near the PF presidency. He will also want to frustrate RB’s come back in case wants to return. I advice PF that it should let their cabinet choose acting president to thwart Scott’s maneuvers. Watch this space! In the mind of Guy Scott he has been acting as president each time, is it (late president Michael Chilufya Sata , correct me if wrong) went on holiday or wooing investors and once went for medical check up in India but forced to return promising to buy a ticket for HH and typical of ‘Dochi Kubeba’, HH has never received that ticket. Guy Scott believes he needs to continue acting as president now that Sata is missing in action. Zambia awaits how long Scott will co-act with Kabimba of Mulenga Sata during the famous 90 day theme muted by Mr M C Chalie Mango Sata.

  30. Scott has been aware that the Vice-president can act as President but does not qualify to stand as president. Only afew agumenentative you have tried to politicize things. Further, scott understands that his acting as President depends on the appointing authority, who in this case is the president. He equally knows that he can act as president for three months (90 days) should the unusual happen.

  32. We have a lot of poeple who have written books and traslated the bible in many local lunguages. Im not being jealous or tribal, poeple like Smoke Hangala,Dominic Mulaisho and many others. We have catholics missionaries like Father moral in chikuni, Anderson SDA in Rusangu and many others in other provinces. Some of the writters we use their books in schools for our children. I not seen Muzindo University’s books. nor head what contribution he deed for our independence. Someone educate me on this. Mushindoooooo! lol.

  33. Dr.Scott is right its taken a while for him to understand that he can act as President.Even Mumba Malila had explained that to him but he decided to go with the interpretation of George Kunda. The law is clear Guy Scott can act as President he just cannot stand as Republican President.In the event that Our current President died Mr.Sata .Guy Scott can act as President till that 3 months elapses to vote in a new President.Which he cannot stand for.Guy Scott can also act whenever the President is out on trips.I couldn’t how the whole of PF and there lawyers couldn’t understand that for such a long time.
