Supreme Court sends Chilanga Parliamentary seat appeal back to High Court for re-trial

The Supreme Court has sent back for re-trial to the High Court the case in which Lusaka Province Patriotic Front (PF) Chairman, Geoffrey Chumbwe, who lost the Chilanga Parliamentary seat, had appealed against the High Court’s decision of upholding the election of Keith Mukata as dully elected Chilanga Member of Parliament (MP) after he petitioned the seat.

Acting Deputy Chief Justice, Marvin Mwanamwambwa, who sat with Supreme Court Judges Florence Mumba, Gregory Phiri, Munyinda Wanki and Elizabeth Muyovwe said the case was being sent back for re-trial at the High Court before another judge because the High Court did not resolve the disputes between the two parties and did not give reasons for its decisions in the judgment.

He said the High Court should have made explicit findings about the truth over the 55 bags of cement which are in dispute between the two parties whether Keith Mukata donated the cement to the electorate as alleged by Chumbwe or were bought by the two cooperatives.

Justice Mwanamwambwa said the trial judge should have made explicit findings about the source of the disputed bags of cement that were used to construct a slab at a storage shed hence ordered for a
re-trial before another Judge at the High Court.

The PF candidate for Chilanga Parliamentary Seat in 2011, Geoffery Chumbwe, had asked the High Court to nullify the election of Keith Mukata as not dully elected Member of Parliament for Chilanga Constituency after he lost the seat.

      Me , you and several others are skeptical about Sata ‘s health and his where about. There is still a mystery surrounding Sata ‘s departure to Israel. He sneaked out in the dead of the night and the government lied that he sneaked in the dead of the night.

      The only other President who sneaked out the country that way was Malawi’s Bingu Wamtarika. They tried to hide his death but some one from within let the cat out and the whole nation was informed.

      As for Sata I am not convinced he is fit and well. If he is fit, then why has it taken him so long to swear in important office bearer and yet swearing in people is what has characterised his presidency? Its unprecedented.

      The fact that government kept his trip to Israel a secret speaks volumes.

      Truely if you look at this week pictures, you may say “nabakaye tushako”. But Kabimbwa has strong witchcraft, ni no messy Tate, ati uwalowa Sata alowela limo.

    • One evidence to show that SATA is dead is the fact that, when they lied that he left for South Africa to see his son, nothing was said about who was to be acting president because Sata was not in Zambia. They avoided to make the same mistake they made when they sneaked him out to Israel.

      Any way lets wait and see if Sata will come out to campaign for the Magongo by elections as he enjoys campaigning. If he does not show up guys, then that will be the last nail in his coffin.

      They are trying hard to deceive the Zambians so they consolidate their power not knowing that we are watching them closely.

    • @Wanzelu, I think you have hit on something. It is a fact that people dont want to accept the truth becoz it will devastate them. I am also thinking that the Sata who was facing downwards towards his sick son in hospital in SA is a Sata lookalike. Imagine the way Sata likes yapping he would have yapped something already, but since that man is only a lookalike they can’t risk to let him speak and will not get a full frontal picture like the way his wife posed. I suspect that Mmembe and Nchito have concoted a plan to clone Sata, we may just hear that he some disease that affects his throat so that he doesn’t speak but will be paraded for photos.
      His supporters should tell us why he left the country without a President which is an abrogation of the Constitution. As a taxpayer I need to…

  2. Looks like sending back of things to the lower courts is the new escape button for the supreme court under PF political siege. They all look addicted to it now. The high already decided on this case, it’s your turn supreme court, can you be decisive for one rather than hit the exit button

    • The highest court in the hierarchy and its decisions shall always stand any where in the world. Common Law jurisdictions are mostly binding as well as persuasive.
      Nevertheless, unless in Zambia where a lower court in the hierarchy can squash the decisions of the highest court. As far as I am concerned, PF govt and its panga wielding cadres are squandering the money. Even if elections are budgeted for, but the money can effectively be used in improving the maternity ward at UTH where our mothers and women are giving birth on the floor. 20 a day, babies at UTH are delivered on the floor and this should send a chilling effect of how PF doesn’t mean well to its citizens.
      The three arms of govt in the PF regime are dependent and this is DICTATORSHIP as an entrée. Tired of PF shenaniganism.

  3. Not the best year for PF in terms of court cases! Remove Wynter Kabimba, as he has never won a single case in his life. You will then need to eject Mutembo Nchito and replace these scumbags with intellectuals in matters of law, there you have it!

      Are you not ashamed to emulate Sata who lied to poor Zambian that he will rule Zambia according to the Ten commandments? Is he ruling Zambia according to the bible now? If that was the case , he would have let his people know that he was leaving for medical treatment to Israel instead of sneaking in and out of Zambia.

  13. from UPND territories thus Central Western Parts of Lusaka and North western provinces.Thats how UPND shrinked.After the demise of Mwanawasa and coming in of Lupiya Banda most Zambians voted for Lupiya following Mwanawasa’s legacy,but still the Bembas still voted for Sata.Lupiya won the election.If bembas were the majority Lupiya nad Mwanawasa wouldn’t have won.Currently the situation has changed the 2001 mazoka map will repricate it self.Thats why William Banda told you that the wind is blowing towards southern.I for one how is mixed blood I don’t find such politics funy.I truly believe Zambia will start to develop when we change to feuduralism like USA even south Africa has a similar system,then all tribes will respect each other.
