Current administration has no political will to release the constitution-Grilo

The Grand Coalition on a People Driven Constitution has observed that the country will go to the 2016 polls under the current constitution if people won’t stand up to the government and demand for the document.

Grand Coalition Deputy Chairperson Beatrice Grilo who was part of the meeting between the Oasis Forum and Justice Minister Wynter Kabimba said the current Government will not give the people their desired constitution as there is no political will from the current administration.

Ms. Grilo noted that the PF Government keeps saying the constitution is not a priority but has wondered if roads that are being constructed are a priority when mothers at the highest referral hospital; the University Teaching Hospital (UTH) are delivering on the floor.

She explained that Mr. Kabimba continues to remain adamant on holding on to the document because there are some contentious clauses that government is not comfortable with such as the 50 plus 1 claus.

Ms. Grilo however said the country will have the desired document sooner or later.

“It may take a bit longer but believe you me will get the constitution, whether the Patriotic Front want it or not we will get the constitution, we may not get it before 2016 because they are arrogant but we will vote them out and the person to come in will give us one but we want it now because starting the process again will cost us more money which would be spent on other areas such the UTH which more of a priority than the roads.” Ms Grilo said.

She charged that the current administration lacks political will as their reasons for not giving the people the document are motivated by selfish interests not the reasons being put forward.

“Its political will that we are lacking, we know and I’m not ashamed to tell you that there are some contentious clauses that some people are not comfortable with. The constitution is being delayed because of the contentious clauses otherwise if there were no contentious clauses the document would have been released by now,” she said.

Ms. Grilo was commenting on Wednesday’s meeting between Justice Minister Wynter Kabimba and the Oasis Forum were the Minister reiterated that the country has more important priority areas to spend its resources on and not the new constitution.

  1. It is not possible to get it before 2016 if all channels have to be exhausted. So since it is apparent that we won`t get it soon what about you concentrating on other issues? People won`t eat the constitution.Time we talked about real issues affecting ordinary people in Kaputa and Shangombo.

      You have doubted my ability to engage in a debate. Let me engage YOU in this one. Back in October 2011 Sata promised a new-people driven constitution in 90 days. This was part of his inaugural address to parliament? It is going to three years now. It has become clear that the president did not tell the truth. The least he could have done was to release the draft as soon as the committee was done. If there were channels that would take more than five years to complete the Constitution, why did Sata make it sound so easy? And Dr. Saulosi, what channels are these. Can you be specific. I will not be personal nor should you. Debate me.

I’m impressed.Never thought a person capable of constructing a good argument like this one you have made at times sinks as low as resorting to insults and character assination when he doesn’t agree with other people’s views.By channels i mean things like the document being tabled before cabinet.You just can’t release a document like that anyhow.Sata said so because he under estimated the work involved in having a new constitution in place.It won’t be possible before 2016 because of the expense involved.It must be subject to a referendum and we can’t afford having a referendum this year and a few months later general elections.Better to have both at the same time(running them parallel).

      Look who is talking about sinking low. At least you agree that Sata did not tell the truth. A president should not make “under estimations” in public, especially on such a serious matter. In this modern age and era, there is no constitution that takes more than five years. The cabinet you mention is always at the service of the people. If referendum is the problem, that’s what should be the bone of contention only after the draft has been made public. The problem is because you are a PF cadre you are inclined go with your party and give the false impression that a constitution is elastic. No scholar will agree with you. Stop treating people as if they are kids, you…(oh, I’m sorry).

  4. A constitution is essentially a contract between the govt and the people it governs, so this document is an absolute must from the get go. We don’t start work at a company without signing a contract. The same goes in this case. The current constitution is crap and favours only one person, the president who uses it only to intimidate, bully people and lazing around doing nothing.

  7. PF’s refusal to release the Constitution is purely a political ploy. It is the only way PF can ensure a slim chance of bouncing back into power. But this is not clean democracy. It is a betrayal of trust of the Zambian people. Indeed, the country is being held hostage by PF politically.

    What a contradiction! PF are up-beat regarding their performance as a government. But if they are indeed delivering on their campaign promises, like they are not hesitant to claim, why are they scared to run on a clean ballot, come 2016?

  9. Give government the benefit of doubt. The hesitation in release of the constitution must be taken as a rational move by government in its desire to protect public good. There is no compiling reason for the release of a half-baked constitution. Who are the drivers? Who are the passengers? Stick to the elements that are objectionable or acceptable.

  10. Blah blah blah, if we had the Oasis Forum of 2001 we would have the constitution tucked away by now and moved on to other priority areas. Also it seems the fire of 1991 is not with us at present. We have to wait for a firebrand leader to appear on the Zambian political scene who can challenge the status quo of Kabimba, hopefully he will appear on the scene sooner rather than later. Not these spineless clowns you call politicians, church bodies or civil society!

    Rightly said all of you; a Constitution is a contract; except it is a governance contract: On which the last political campaigns were based; except PF came out and articulated that they would put in place a desired constitution. They have not done so beyond the 90 Days; now three years.

The UK has no constitution and they are doing so much better than arrogant and pompus Zambians.
