Guy Scott moves to Chikwanda’s defence over VAT and shares

VICE-PRESIDENT Guy Scott has said the repayment of Value Added Tax (VAT) owed to the mining companies is within the law and not something Finance Minister Alexander Chikwanda wants to cook up.

Dr Scott described the attacks on Mr Chikwanda as unwarranted and that the finance minister was above board on the VAT rule number 18.

“This matter has been discussed here in my office, at ministry of Finance and elsewhere, the payment is not voluntary but within the law, it is nothing that Mr Chikwanda dreamt up and requires change, it is within the law.

“We owe more money to the mining companies in VAT refund and we have to do something about it and not just leave it to accumulate or leave it to our next generation, the money is theirs,” Dr Scott said.

The Vice-President said the question at hand was how the country would pay back the money.

“It is payable unless the law changes it might not be payable, it has accumulated and that all the minister of Finance is talking about,” he said.

He said the issue of ministers owning shares in companies in Zambia was not illegal but that it was something that needed to be declared to relevant authorities.

“If Mr Chikwanda did not make a declaration over his ownership in Sigma Enterprise, am sure it was an oversight on his part. I have been a minister before and I owned shares in some farms, in a consultancy company, its normal in this country and I don’t see any fuss about it,” Dr Scott said.

He said there were no differences between the ministry of Finance and the Zambia Revenue Authority (ZRA) over the repayment of the VAT to mining companies.

“There maybe disagreement about practicality and opinions, but there can’t be disagreement that the money is owed, the way forward in future is to change the law, but the situation is that the money is legally owed,” he said.

He refuted claims there were factions within the Patriotic Front (PF) describing the speculations as not being worthy his comment.

“Just be careful on the source of information, any party in power usually has some funny people, but I will not comment on them until they are named. I am Vice president, my job is to ensure the party wins elections, the job which I am doing very well, we won Mangango and we are going to win in North Western Province,” he said.

  1. Why is Guy Scott all of the sudden defending Chikwanda? I smell something fishy here. I think GS has now noticed where the balance of power is now, the Bemba clique. Chikwanda is now in control of government and GS is trying to protect himself.
    On the elections in NWP, GS don’t lie to yourself. You can only win through violence, intimidation, rigging and vote buying.

      Now since we have got Guy Scott on our side, it is time for Kabimba to go.
      In fact Kabimba has done worse than Edward Mumbi.

    • To be honext Guy Scott is a very undecided fellow who just like Kabimba needs to be fired. Sanity in the PF will only return when these 2 are fired and replaced with Given and GBM in cabinet.

    • Chikwanda is just the natural choice to lead PF in the absence of Sata because of his calmness and being a very close relative to Sata. He is the only one who can protect Sata ‘s family from all the looting scandals at RDA. He can also manage to extend an olive leaf to the dying MMD and RB to strengthen PF by forming MMD-PF now that the vicious characters have been shoved aside.

      Well there you have it folks, the Bemba clique has just stopped a major purge against them by letting Chikwanda to lead PF.

      The sooner they confirm chikwanda as vice president the better so that the political wheel can start rolling again.As soon as chikwnada gets the confirmation and is allowed to open parliament then it will become clear that Sata is incapacitated or no more.

    • We told kabimba to calm down and play it cool. Many bloggers here said that he was just a tool to help Sata and PF shake off the Bemba tribal tag. Mmembe was co-opted to sing praises for the PF in return for favours not to pay back 14 billion. Nchito was also brought in to taunt RB to such an extent that the whole cartel get hated by the people.

      Sata is a master dribbler. He managed to f00l the criminals into believing he can protect them and yet knew that in an event that he dies, Chikwanda should take over and groom his son to eventually take over. There is a possibility that Mulenga Sata can take Kabimba ‘s place as an appointed MP.

      Reality is now sinking in Kabimba ‘s head that he is being used and will be dumped if he does control his men to respect ABC.

      If we had windfall tax, the 600 would have been swallowed in tax and we would have raised the 750 or more from the windfall tax.

    • The only guy Sata failed to deceive is HH. HH is a stragetist, and could see through Sata that he is the type not to be trusted.Thats why he jumped off the PF ‘s boat. How clever! Here HH employed the same strategy he uses to run his business empire to avoid blinking once and fall.

      Its such traits I look for in a leader. HH is the only one that ticks all the boxes for me. I know people will say why did he join the coalition with PF in the first place? The answer is if you want to get into your enemy ‘s mind, join him briefly and you will come out richer with data on how the beat him.

      Kabimba has lived in f00l’s paradise for a long time now. The only way he can salvage a bit of credibility is tell the nation truth about whats happening to Sata so the people can begin to trust…

    • Declaring a conflict of interest is a requirement for all these posts, by law. Where are the audit reports for this so called VAT returns saga. Who is owed what and where is the documentation for said calculations? And again…..where are the audit reports and who is owed this VAT back? Where are the reports that show what has been exported? Where is KCM’s audit report?

    • On the VAT issue, there is nothing wrong that Chikwanda did on this issue. VAT is supposed to refunded when goods are exported from any country. Nearly every one who has ever imported goods from abroad understands how the VAT system works. If you have imported a car from Japan, just know that, you are one of the beneficiaries of the VAT refund regime.

      Therefore a VAT issue is a non issue being blown out of proportion by the cartel to out manoeuvre Chikwanda from the PF leadership bid. Unfortunately the cartel is are late, they can not have it their way.

      Kabimba and his cartel live in f00ls paradise now. He is just a tool being used by the PF Bemba clique.

    • The sad thing is how we/our GRZ quickly wants to follow the rules on VAT refunds to the extent that the whole F/minister is writing to the President whilst on the other hand issues of tax evasion (KCM) making 500 billion usd per year and yet declaring losses was NOT taken up by the F/minister and his vice president. Glencore tax evasion exposee by the European Bank has gone quite. ABC did NOT find it FIT to write MCS about it. Instead these serious issues TAX EVASION ARE left to Action Aid’s Pamela Chisanga. Even eletricity tarriff increases to mines are resisted (taken to High court)THIS GIVING OF THE OTHER CHEEK FOR THE MINES TO SLAP IS REALLY DISGUSTING.   4. I have said it so many times that Guy Scott is a liability to Zambia. We need a thorough investigation in this. How do you allow such a law when you have incentives on top which take away the very revenue that these mines should pay to get that rebate? This old man’s motives are to enrich his friends at the expense of Zambians. He has brought confusion in the PF now he wants to confuse the entire nation because he smells a shift in balance of power. Surely how do you allow the mines to pay very little tax in the first place but yet still qualify for tax rebate? This is fraud and you want to use the law to protect yourselves? We need to trace the beneficiaries of this money. No wonder he went to check up on his investments in Scotland.

    • @Fr33dom, please do some reading on how the VAT system works in Zambia and many open market countries before you get so worked up. And also note that the system was not developed in Zambia by the PF but by MMD. It is a very good system to the government and business entities but costly on consumers.

    • @Titus,nobody is disputing how the VAT system works. VAT should be a revenue raising exercise and not an expense. Since you claim to know many open market that use this very good system, name 1 country that offer Tax breaks on their main revenue generators in combination with rebates? If the MMD asked people to put their heads in the microwave, does it mean the PF should continue with this because it was started by the MMD? Think out of the box my friend. Don’t be fooled, check if the biggest economy in the world uses your so called good system.

  6. PF have been borrowing left, right and centre and their lies are now catching up with them. $600m owed in VAT refunds alone?? How much else do they owe to other parties? What about on Treasury Bills? Eurobonds? Where has the money gone? I don’t see the fake “massive infrastructure developments” they brag about. They have stolen the economy with Chikwanda at the helm.

      We have told you many times that an implosion is pending in PF but you chose to bury your heads in the sand only to come out when the damage has been done. You expended all your energies on slagging UPND and HH instead of using all your brains to advise your PF and Sata to avoid this crisis.

      To us in UPND this is good music because even the courts and the police will begin to realign themselves in preparation for change to get rid of this confused PF.

      HH has been vindicated again. He was absolutely right when he said PF is CNP.

  11. Why the fuss about the VAT refund people? this has always been there and Mr. Chikwanda has done nothing wrong. Please if you are ignorant about the taxation principle when it comes to VAT, go to ZRA advise center and they will advise you accordingly. The mines are to be paid their refunds period.

These monies were accumulating per consignment, and because you did not pay as and when, now you are even equating it to the first Eurobond – funny Zambians; just pay, else it will reach the second Eurobond level!   22. From the contributions of most bloggers, it is clear that most bloggers don’t even understand the concept of VAT and VAT refunds. As far as they are concerned money can only flow in one direction from the Mines to Government, they can’t picture the situation where Government pays VAT refunds. That is the tragedy of our simpleton bloggers, yap yap yap on no basis at all. And some media houses make headlines out of what they know is pure ignorance, shame! I never imagined that even Bishops and Fathers can be that ignorant, why did I think that clergymen are well trained individuals? There is an issue of VAT Rule no. 18. and the leaked letter on this rule.
    @Gunsdown laments correctly for Zambia. We owe them according to information, we owe mines 750M, we are giving them back, 600M. Windfall tax may have alleviated that. We are getting far too little and investors are mining at large quantities. One day we will find we over mined and have little for future generations. Reasonable people would find the application of VAT Rule18 unfortunate in this context. Nationalise Mines, Chile has?

  28. Yesterday, I strongly condemned Hon Chikwanda for the way he responded to media gossip and showed a total lack of leadership skills.
    Now, see how Guy Scott has approached THE SAME issue. Solid leadership. Guy Scott is the kind of leader the country needs, somebody smart and quick thinker and who knows exactly how to handle the media. Nomba the rest in government, including civil servants, katwishi ngakukana kulabwino, they just wake up and spray-paint the whole country with gossip everyday! I don’t even know why the police want to investigate the leaking of a letter: how many top secret govt documents have been leaked even just this year alone? The whole country binges on gossip daily. There are no government secrets anymore. And when Sata calls them i.d.i.o.t.s they complain!

    His Hon. The Vice President Dr Guy Scott has finally seen sense in not squeezing innocent people who want to do good to the Country. Hon. Alexander Chikwanda is simply implementing a Government programme. If those VAT refunds were made during the times Ms Edith Nawakwi, Dr Katele Kalumba, Dr Musokotwane and Mr N’gandu Magade served as Finance Ministers, the country would not be owing the mines such colossal sums of money. Everyone should appreciate what Mr Chikwanda is doing otherwise it will be a burden for the next generation just as the Vice President indicated. I can’t see any problem in having shares in a company. How would Mr Chikwanda have survived for so many years before appointed minister? Its good he has now declared having Sigma…

  30. Failure to declare interest is a crime. I invite you to a case of Prof Clive Chirwa who did not declare interest in Zambia Railways, he ended being fired and now being prosecuted. So what is so special with Alex Chikwanda??? Guy Scott…You say an oversight?? Really? No fuss about it??? Is it animal farm where some animals are more equal than others??? Alex should be prosecuted. Period, the Law should visit him. I agree with Wanzelu analysis

The sad thing is how we quickly want to follow the rules on VAT refunds to the extent that the whole F/minister is writing to the President whilst on the other hand issues of tax evasion (KCM) making 500 billion usd per year and yet declaring losses is NOT taken up by the F/minister and his vice president. Glencore tax evasion exposee by the European Bank has gone quite. ABC did NOT find it FIT to write MCS about it. Instead these serious issues TAX EVASION ARE left to Action Aid’s Pamela Chisanga. Even eletricity tarriff increases to mines are resisted (taken to High court)THIS GIVING OF THE OTHER CHEEK FOR THE MINES TO SLAP IS REALLY DISGUSTING. WAS ABC & GS PUT IN OFFICE TO REPRESENT MINES OR ZAMBIANS? THIS IS ABOSOLUTELY DISGUSTING!!!

    LUSAKA, Thursday, August 28, 2014 – His Excellency, Mr. Michael Chilufya Sata, President of the Republic of Zambia, has with immediate effect revoked the appointment of Hon.Wynter Kabimba as Minister of Justice and party Secretary General.

    Hon. Edgar Lungu becomes the new party Secretary General and Minister of Justice, in addition to his portfolio as Minister of Defence.

    The Head of State thanked Hon. Kabimba for the service rendered to the Government.

    • Kabimba, however one may want to brand him was never good for the country. I think that had he also belonged to HH’s shop, he would have suffered the same fate. The man has no grassroot following but was busy throwing his weight around because of his political connections. It was only a matter of time and I am glad that it happened sooner than later. Cobra temunobe. I am pretty sure that Wynter was completely blindsided by this decision. They say that you need to be nice to people on your way up because you will need someone to cushion your fall when you finally come down from the clouds. Zambia has been partially saved, now we need to figure out how to get rid of the entire PF circus.

  34. @Mulungu, whomever you are, I am neither hungry nor going through a humbling introspective time! I am in fact obese and ought to stop eating as much. My personal situation is looking very good, as I have worked hard over the recession period to renew my skills by taking on a Masters programme, and I am now enjoying watching better job offers filter through my mail box. I have business opportunities to start my own Digital company and am working hard to that. My bank account statements do not prove your ridiculous and moronic attack on me.
    My right to express my opinions are enshrined in my basic Rights to Freedom of Speech
