Oscar Pistorius jailed for five years

Oscar Pistorius has been sentenced to five years behind bars for culpable homicide after a seven-month trial in the North Gauteng High Court for the death of Reeva Steenkamp at his luxury Pretoria home in February 2013.Judge Thokozile Masipa handed down her sentence shortly after 10:30 on Tuesday morning.

“Count 1, culpable homicide, sentence imposed is maximum of five years.”

He was also sentenced to three years in jail, suspended for five years, for discharging a firearm in a Johannesburg restaurant. Both sentences will run concurrently.

Pistorius will be eligible for his sentence to be commuted to correctional supervision after 10 months.In terms of Section 276 of the Criminal Procedure Act, the accused may serve one-sixth of the sentence. For a five-year sentence, this would amount to 10 months.

“I have taken into account the seriousness of the offence, which led to the death of the deceased, the personal circumstances of the accused, and the interests of society,” Judge Masipa said during sentencing.

“I am of the view that a non-custodial sentence would send the wrong message. A long sentence would also not be appropriate either as it would lack the element of mercy.”If sentences are too lenient, the administration of justice will fall into disrepute and people will take law into their own hands.”A suspended sentence would not be appropriate in my view,” Masipa said.

“The loss of life can’t be reversed. Hopefully judgment on sentence will provide some sort of closure for all concerned,” Judge Masipa said

    • I have followed this case and believe Oscar proves once again When you have Money and are a Celebrity you turn Murder into a Misdemeanor, he will be out on parole in 10/12 months. Pistorius is a narcissistic sociopath who murdered Reeva because she dared to go against Oscar’s wishes. This is known by the majority inside of them (their hearts)

      The Judge claims she wanted to strike the right balance but in reality if Oscar was an average Joe he would’ve been convicted of intentional homicide and sentenced to 20 years to life and probably to the most inhuman jail one can think of.

DON’T GET ME WRONG. I AM NOT A FAN OF PISTORIUS AND FOR ME HE SHOULD HAVE BEEN GIVEN A MUCH LONGER SENTENCE BEHIND BARS. THE ONE GIVE TO HIM IS A PICNIC. OBVIOUSLY, WHEN THERE’S AN INTRUDER IN THE HOUSE AT A WRONG TIME, THE FIRST PEOPLE ONE WOULD THINK OF ARE CHILDREN AND WIFE BEFORE STARTING TO SHOOT INDISCRIMINATELY AT HE DOOR. IN FACT JUST ONE SHOT THE GIRL FRIEND SCREEMED AND HE DID IDENTIFY HER VOICE BUT CHOSE TO SHOOT ON. HE KNEW WHAT HE WAS DOING. HE PLANNED IT.

    • I followed this case closely and if I was the judge, I would have found him guilty of murder. The judge should have asked him or reasoned (1) if it was the first time his girlfriend was going to the toilet in the night whilst at his house.
      (2) Why he did not first check if reeva (girlfriend) was in the bed.

      In my eyes he is a murderer

  1. He will serve ten months ,then released for correctional surpervision. Anyway South African prisons are clean,meals three times a day.Don’t compare it to a zambian prison

    • He is actually going to serve at least 8 months, and NOT 10 months, thereafter he may be eligible for parole, or may be released to go and serve the community or supervised community service. This is what money can do. You can get good lawyers.

    • HE IS GONE IN FOR A PICNIC. HE SHOULD HAVE MURDERED SOMEONE HERE IN ZAMBIA. HE WOULD HAVE LEARNED A LASTING LESSON. BECAUSE, FIRSTLY, OUR JAILS AREN’T 5STAR HOTELS, SECONDLY, IN ZAMBIA AFTER ESCAPING MUKOBEKO HE WOULD AT LEAST SERVED MINIMUM 15 YEARS WITH HARD LABOUR. IN SHORT OUR LAW IS STIFFER THAN SOUTH AFRICAN LAWS MAYBE THAT’S WHY THERE SEEM TO BE INDISCRIMINATE MURDER CASES IN SOUTH AFRICA. MY HEART-FELT SYMPATHY GOES TO THE PARENTS, RELATIVES AND FRIENDS OF THE GIRL. THEY WILL DEFINITELY THINK THEIR LEGAL SYSTEM IS A JOKE.     • I live in South Africa and I totally agree with you. In South Africa, life is cheap. The legless ***** goes in for 5 years for intentionally killing a beautiful young lady. I like America (USA), because when they say life, it is life and sentences run consectively and not concurrently. South Africans will continue bulchering each other until the justice system is revisted.

    Kanene in for 15 years for “defilement” and Oscar in for five years [probably only 10 months] for killing a fellow human being…

    Both are serious cases but I am not sure that the sentencing is fair on the balance of probabilities. Dear bloggers, I distinguish that this is Zambia and theirs is RSA.

    • @REASONING, THIS PISTORIUS GUY IS A MURDER, PURE AND SIMPLE. YOU DON’T NEED TO GO TO A LEGAL SCHOOL TO PRESIDE FAIRLY, INTELLIGENTLY AND WITH WISDOM ON THIS CASE. THIS GUY INTENTIONALLY MURDERED HIS GIRL FRIEND AND EVERYTHING POINTS TO THAT. OBVIOUSLY THE GIRL FRIEND SHOUTED FOR HELP AFTER ONE SHOT. HE SHOULD HAVE STOPPED SHOOING IMMEDIATELY. EVEN BEFORE A SINGLE SHOT HE SHOULD HAVE FIRST OF ALL LOOKED OUT FOR REEVA TO ENSURE HER SAFETY. EVEN BEFORE THAT HE DID NOTICE REEVA’S ABSENCE IN BED TO HAVE PRACTICED CAUTION. IT IS ENCOURAGING ON THE PART OF MURDERERS IN SA TO CONTINUE CRIMES AS THEIR LEGAL SYSTEM IS A BIG JOKE.

    Without any doubt, all the defence lawyers…including Judge Masipa know that Reeva was killed/murdered in cold blood and that the intruder story was just fake…they were hiding behind the academic conspiracies they were taught at school of law…interestingly, had the same prosecution lawyer Nel been part of the defence team, he could have backed Oscar’s intruder story with tooth and nail..
    Reeva must have been turning in her…
