Scores of PF youths marched through Cairo Road to Cabinet Office on Thursday afternoon protesting against the appointment of Vice President Guy Scott as acting President.

The cadres who sang mostly solemn music carried placards denouncing Dr Scott’s appointment.

They contended that Dr Scott does not qualify to act as President adding that this is the reason late President Michael Sata never allowed him to act in the three years since PF took over Government.

The cadres clad in PF regalia chanted slogans that demean Dr. Scott and demanded that the party’s Central Committee force Government to reverse the decision.

And in a statement issued to the media yesterday, PF Lusaka Youth District Chairperson Yelisa Khondowe stated that Dr Scott is illegally occupying the office of the President.

“We the youths of Lusaka District have agreed with what General Miyanda has stated over the eligibility of Dr Scott to act on both the Republican Presidency and Vice Presidency. Article 34 which deal with who should be President or Vice President has been amended has been amended,” Mr Khondowe said.

He added, “This is the more reason Dr Scott has never been left to act as President. Zambia has a constitution and we should endeavor by all means to follow the constitution.”

Mr Khondowe said the youths of Lusaka District consider Justice and Defence Minister Edgar Lungu as the legal acting President of Zambia.

“We the youths of Lusaka wish to place it on record that Hon. Edgar Lungu is the legal acting President of Zambia and he can only cease to perform such functions upon the Speaker informing him of the incumbent’s return,” he said.

Mr Khondowe stated that it is not provided anywhere that Mr Lungu can hand over power to another acting President but only to the substantive one who is President Sata.

“President Sata left for the United Kingdom purely for a medical checkup and his coming back was obvious. His death has not revoked Mr Lungu’s appointment. Why is it that Vice President Scott was never allowed to act?”

But Secretary to the Cabinet Roland Msiska has promised that Attorney General Musa Mwenye will give a detailed response on who revoked the appointment of Mr. Lungu as acting President.

Addressing a media briefing in Lusaka yesterday, Dr. Msiska insisted that government did nothing wrong in the process of stripping off instruments of power from Mr. Lungu.

Dr Msiska also stated that the decision has been taken and is irreversible.

Some legal experts have argued that President Sata was supposed to revoke the appointment of Edgar Lungu as acting President since he was the one who appointed him before his death.

  1. It is a a civic and constitutional responsibility to defend the constitution against any dangerous schemes of extra-constitutionalism. Simplicity on matters of the constitutional is too dangerous with high propensity of turning the scheme combustible. Forewarning is forearming.

Michael Sata left a mess in Zambia, had he voiced out his opinions from day one people in his party would know where they stand and all this infighting would have been reduced.     • Now Miyanda has serious issue to contain. He can probably address Zambian on TV, and not internet again . Like I said, he should not have clicked “send” that article after confirmation of expiration of Ba Sata. The was 90 days to discuss such Constitution issues.
      The best here is Miyanda, HH and Nawakwi should help Guy Scott and Edgar Lungu. Address people today, they listen to you. They will listen, believe me.

    • Sata and PF has always had an Attorney General advised against appointing Guy Scott to act as President. This includes his Lordship Mumba Malila who now on the Bench of the Supreme Court. .

      Has the death of Mr Sata now altered that clause that barred Scott? Fred Membe never protested this clause up to this time. Why is he now unleashing insults on those who are suspecting a coup d’etat in the way Scott has been appointed? Fred wants to impose Kabimba on the PF and remove Lungu. This time round, Membe, the Zambians wont allow you and will support the PF Youths.

This means we have to look to the law and hence cabinet appointing the VEEP as per constitution.     We are facing these trying times because of ‘donchi kubeba’ a phrase of deceit coined by Guy Scott, exploited by Sata, popularised by ganga taker Dandy Crazy’s song….ashi wilalila….donchi kubeba…. and entrenched by the chief sata popagandist Membe. A doctrine of lies without shame was thus born.

    And so has been the rule of Sata. Marred with corruption, blatant nepotism and reckless borrowings, suppression of opposition, this man goes to the grave as a sigh of relief for democracy.

    • For the first time I don’t agree with Wanzelu and others on the issue of GUY scott.I am one person who is against racism ,tribalism and religionalism.We had no Zambia before 1964 and both the parents of Guy scott were citizens of northern Rhodesia before independence.Guy was born in Zambia and has lived in Zambia for more than 70 yrs.RB was born in Zimbabwe and yet he was our president whats wrong with Guy.Those who bring the issue of race and tribe in the case of HH are backwards.Guy is constitutionally right to aspire for presidency.Out of in PF Dr Guys Scott is the right candidate but for Zambia I support HH as the best because of his age and Economic knowledge as well as his moral standing.So Zambians abash racism and Tribalism lets choose the best president not drunkurds .

      The question you have to ask yourself before questioning my intelligence is; Would Kabimba have handed over power to Guy Scott, if he was acting president when Sata died? Would Mmembe have allowed this to happen? The answer is a big NO.

      If you look at my comments, I am not on the the constitution ramifications of this, but fact that, Mmembe and Kabimba are scheming to ursp power via the back door.

    • Sido Mark thank you for your contribution. There is no reason why Guy Scott should be prevented from standing. This parentage clause was inserted to bar the likes of KK and should therefore be changed. People need to understand that there was no Zambia before 1964.
      The appointment of Guy Scott will ensure all those people who still in the tribal era to maybe reform and understand that there is more to Zambia than their tribe or fighting for ancient tribal recognition.

The cabinate knew the state of health of the president, they knew his days were few and knowing that there leader had never left Scott in acting position, these are issues they should have sort clarity before he died.Suppose it was Winter acting, do you think they could have removed him? Why was it that Mmember was the first to interpret the constitution on the day of the demise of the president in his editorial that the “rightful” person to act was Scott?

The fact that it is irreversible doesn’t preclude you from returning to the Supreme Court to get a definite, final interpretation of what you suspect.   14. Since when did PF hoodlums become legal experts? Mumba Malila had clearly stated when he was the Artoney General that Scott qualifies to act as president. Actually he qualifies even to stand as president. The law says anyone who was in Zambia on 24th October, 1964 automatically became a Zambia and therefore Scott’s parents are Zambians.
    Just understand that its not always that your favourite shal be the pesident and respect the rule of law.

Get a brain and analyze the constitution and the current situation. When the INCUMBENT President is incapacitated or dies, the Vice President will ACT as President. That means Edgar Lungu (who was only ACTING and NOT the INCUMBENT) ceases to ACT as president. It also happens here in the US, when Obama is giving the State of the Union address, a DESIGNATED SURVIVOR has to be in an undisclosed location. If anything happened to the President, it is the Vice President and NOT the Designated Survivor that will be Acting President. Again Miyanda is at the helm of needless confusion. This person is commander of Armed Forces, you can’t garantee his allegence. Already some extent the security of Zambia is compromised. This man one time made a statement which almost brought a comflict with the south african government. The statement seemed to demean the black dominated government of South Africa. When our friends from the western world came first came to Africa, they came in the name of Christianity and ended up colonailizing. A president in Africa means all land invested in his name.   27. PF is a grouping which is not built on clear ideology. Look at what drives them i.e. ‘Dochi Kubeba’, ‘Pamaka’, ‘more money in the pockets’, ‘likeni ateke’ and many others. These do not stand on honest approach to politics or life in general. Hence the confusion being witnessed should not surprise anyone.

  29. Article 39- Where any person acting as President is appointed in cases where the President is ill or incapacitated to carry out his duties or out of the land of Zambia, no one can revoke such an appointment unless the President himself in writing to the Speaker. I rest my case.

Article 39 becomes irrelevant once the president dies; otherwise then we might as well continue with Sata as president until 2016, even though he is bloody dead. Read article 38. Don’t go round citing articles that suit your argument. Sata was not the constitution of Zambia, when he dies he becomes totally irrelevant to our lives. If you want him to continue ruling your life that is up to you, but don’t use dubious articles to force him on the rest of us even in his death.   33. All these “interpretations” of the constitution by any jim and jack are really about which PF camp will be holding the instruments of power during this transition period. Having an incumbent head of state in your camp certainly helps during the hot campaigns as he will do you all sorts of favours such as rides in his helicopter, full access to state resources, etc. All these come in handy during this torrid time. I would rather busy bodies like Miyanda and Mwaanga much as they want to “interpret” the constitution, should keep away from these PF fights unless they seeking “favours” from these protagonists.   34. The PF cabinet was so paralyzed with the fear of Sata that they could never do anything even when mandated by the constitution, the yellow cowards. Look now where they have delivered us. Ba Khondowe, please dont be mislead by Gen Miyanda. i read what he wrote but i am afraid that what he wrote is not true. to put the record straight, we need to understand that actually Guy Scott not only qualifies to act but also be president (LT 12th January 2012; Lewanika et al vs Chiluba 1998 court ruling). any person who was on Zambian soil by midnight 24th October 1964 is a Zambian. now for GS his parents came in Northern Rhodesia in 1927 and he was born in Zambia in 1947 so that qualifies him just like any other person to act and actually run for presidency. i like Edgar Lungu but that doesn’t mean we should cloud our judgement with sentimentalism and subjectivity. a precedence was already set and we have to live in.

Sata is deceased now,therefore the constitution should be followed, simple. If Sata did not want Scott to rule Zambia even for a day, maybe he should have revoked his appointment, especially after it became very clear that he wasn’t well and appointed another person. However that being said Scott is a Zambian by birth just like all of us. He is only overseeing the process for 90 days and ensure that the Zambian government is running smoothly. I was neither a fun of PF nor Sata, please PF cadres let the nation mourn our president with dignity and respect. It is my prayer that next time people should vote for level headed people rather than these thugs.

      Are you telling us that even Roy Welensky (Last Governor of N. Rhodesia) became Zambian by virtue of being in Zambia on 24 October, 1964? I do not think that was the case for non-indigenous N.Rhodesians who had a second choice. That is why the majority whites left after Zambia became independent and took up British nationality instead.

Coming to the matter of Dr Guy Scott being appointed as acting president, the cabinet followed the constitution which we as Zambians adopted. He did not just throw himself into that seat the way you perceive things, but appointed by operation of the law. Even Hon.     PF cadres need to know that Mr. Edgar Lungu is a Lawyer and a full member of the Law Association of Zambia (LAZ), who fully understands the interpretation of the Constitution. Guy Scott is acting President in accordance with the Zambian Constitution. Therefore, PF cadres must understand that Sata should have rectified this apparent mess by firing Guy Scott and appoint a replacement long time ago.

    It is a pity that PF is Sata’s own investment venture. Hence PF is likely to be buried along with the true owner.

    • There is no question that Michael Chilufya Sata had, over the long years of his political career, attained the status of an admirable politician in Zambia. Many Zambians from a wide spectrum, including the educated, had a natural liking for him and for his brand of politics. That is what defined PF’s success. Now that he is gone, the arrogant and the ignorant in PF are about to discover otherwise. They will soon wake up to their rude shock, that they are in fact irrelevant and inconsequential.

  67. When a person is alive and they have been given a certain responsibility they can operate that responsibility in whatever manner they want as long as it is unfettered. MCS had unfettered responsibility to appoint Ministers and VP. Our constitution does not prevent an incumbent President from appointing any Minister as VP. However when a person dies the only enduring authority of their decisions is to the extent of their personal estate. Anyother prerogative decision is not binding. If the constitution provides for VP to act incase of incapacitation or death so it shall be. It does not say only a person who is qualified to stand shall act. Article 38 (2) of the Constitution of Zambia says: “Whenever the office of the President becomes vacant, the Vice-President or, in the absence of the Vice-President or if the Vice President is unable, by reason of physical or mental infirmity, to discharge the functions of his office, a member of the Cabinet elected by the Cabinet shall perform the functions of the office of the President until a person elected as President in accordance with Article 34 assumes office
