Mulenga Sata gets court injuction restraining PF from stopping him to contest

THE Lusaka High Court has granted Patriotic Front presidential candidate Mayor Mulenga Sata an injunction restraining the party from stopping him from contesting the presidency on account of his parentage.

This is in a matter in which Mr Sata sued PF secretary-general Bridget Atanga and the Electoral Commission of Zambia (ECZ) and wants the court to declare that he is eligible for election to the office of President of the Republic of Zambia.

According to a statement of claim filed in the High Court, Mr Sata also wants the court to declare that he is also eligible for election to the office of the president of the PF in accordance with the provisions of the party constitution.

Mr Sata further wants a declaration that the eligibility of the office of president of the Republic of Zambia is an evidential matter that cannot be determined as a threshold issue by the returning officer but is the preserve of the full bench of the Supreme Court.

He also wants a declaration that the eligibility for election to the office of president of the PF on grounds of the parentage clause is an evidential matter that cannot be determined as a threshold issue by the returning officer or electoral commission of the PF but is a preserve of the High Court.

Mr Sata said he would suffer irreparable and ruinous damage if he is prevented from exercising his constitutional right to contest the election for the office of president of the Republic of Zambia.

He said there have been false and malicious allegations allegedly calculated to disqualify him from contesting the presidency of the PF and that these have been attributed to senior party members.

In delivering his ruling, High Court judge Isaac Chali granted Mr Sata an injunction restraining the PF from preventing him from contesting the party presidency.

      Judge Isaac Chali granted Mulenga Sata an injunction because he knows that the Zambian people know that styupidity is inherited!

  2. I want today to endorse HH for the 2015 Presidential bye-election.We have to vote HH.He will surely bring sanity to Zambian politics and we can breath new fresh air in Lusaka.He also has two years to work and if he fails in that time we will kick him out in 2016.GOD BLESS ZAMBIA.

  3. Mulenga Sata realizes that what is up for grubs is the PF party presidency while the Republican presidency per se is a distinct and separate issue! For that, he is smart. But the PF party presidency isn’t going anyone’s way on a silver platter. It’s a power struggle that calls for political maneuvering. Mulenga may end-up being the unlucky kid who gets trampled-upon in the process. It is the law of the jungle in PF – only the fittest survive.

    • He feels is the right candidate because his father worked so hard to kick the mmd out. not that he has the desire and plans for his nation. his taking the presidency like a mansion that his father left after his death.

  6. There’s a saying which goes like “Umwana wansoka, na ena ni nsoka”. So maybe Mulenga has qualities of his father and deserves a chance.

  7. This ex- dog trader is mad! It was his father and others including Gen. Miyanda who were in MMD made that clause to stop Kaunda. The Cobra forgot that his children had a mother with a pink NRC!

  8. Surely if this will continue, PF as a party is dead and buried………ooooh, PF is already gone. It is really sad for a Party that had shown alot of promise. This coming Presidential election will be the easiest for HH. There is no competition this time around for HH.

      If I were Baby Cobra, I would stay out of it. There is no legacy to preserve here, P.F and its vision died with King Cobra.

  9. Zambia. Thought the Immigration department would have simply verified the matter in question. They know where his mother is from.

    The Zambian Judiciary is full of the most suspect individuals. This case is bizarre. Injunction g the Party you want to head in gov’t is clear indication you are not in good terms.

    He hasn’t even a hope in hell.
