Matero MP Miles Sampa has filed a Notice of Appeal against the High Court’s verdict to dismiss his application for an injunction to declare null and void the election of Edgar Lungu as PF President.
Mr Sampa has filed a Notice of Appeal in the Supreme Court and has raised seven arguments.
In his application, Mr Sampa argued that he was dissatisfied with the
ruling of High Court Judge-in-Charge Isaac Chali on grounds that he erred in law and in fact when he delivered the ruling without hearing both parties.
The Matero member of Parliament argued that Judge Chali erred in law
when he held that the appellant sought for an order that the court
found that the plaintiff ought to have been recognised as PF president and be declared official candidate for the January election when the appellant did not seek such relief.
He also said Judge Chali erred in law when he used the holding above
to arrive at the final decision of dismissing the entire action of the appellant, which considerations were irrelevant as the appellant never sought for such a relief.
Mr Sampa said the High Court erred in law when it held that it
appeared by the time Mr Sampa had filed his action, a judgment by
consent had already been approved and signed by Judge Mungeni Mulenga when there was no evidence on record of when the consent was filed and signed.
The High Court judge decided on mere assumption and speculation that
the action was filed after the consent judgment had been filed and
signed by the court.
Another appeal ground is that the High Court judge erred in law when he held that the appellant had abused the process of the court based
on the holding about the consent judgment.
He further argued that there was no evidence that Mr Sampa had come
across reports on the consent judgment as held by the court that the
appellant ought to have been aware of the earlier case and the consent judgment because such cases had been widely reported in both the print and electronic media.
Mr Sampa through his lawyers Iven Mulenga and Company, Makebi Zulu
Advocates and SNB Legal Practitioners also filed a certificate or
urgency.
“We Messrs Iven Mulenga and Associates, Makebi Zulu Advocates and Lungu Simwanza and Associates hereby certify that this matter is of
utmost urgency as the nomination dates for the presidential election
are scheduled for December 17, 2014 wherein the appellant or the respondent are possible for the said election,” reads the certificate of urgency.
The PF has been embroiled in a leadership wrangle following two
general conferences that elected two different candidates for the
general election, forcing both factions to seek legal redress.
On Wednesday, the Lusaka High Court declared Mr Lungu as the duly
elected PF president before Mr Sampa filed an injunction restraining
Mr Lungu from holding functions of the ruling party president, but the matter was dismissed, forcing him to appeal to the Supreme Court.
Here we go again. These PF guys will be fighting until January.

To honest be Sampa should listen to me very carefully.
What he has done will land him into more problems with the Lungu establishment because the notice to appeal to the supreme court still has to be handled by the same judge who threw it out. If the judge decides that his case is worth wasting the supreme court ‘s time, he will allow it . Otherwise, it will be another throw out. Mean while the lawyers will have spun some money.
Next if Sampa is still stupid enough, he will still spend money to make application to be granted the right of appeal which the court will grant him easily. But what this means is that who ever will be looking the case will not receive any new material but simply rely on the reasons why his first appeal was thrown out. The chance at this stage are near 0.
Sampa was technically knocked out by that fraudulent judgement.

Miles is right.Lungu was not constitutionally elected either. He has to show his supporters that he can soldier on and has the resilience it takes to be president. Justice is Justice indeed. But Sampa has not been treated unfairly but taught a lesson about Justice. There is nothing to listen from him by the Courts because he didnt want to “listen” to the same Court when it served an injunction on his convention. If you want justice, make sure you respect justice and seek it with clean hands…

The combination of GBM and Sampa sounds like a familiar story: PF was formed by a Bemba and shall remain a Bemba party. However to the disappointment of Sampa/GBM, the good thing is that unlike in the other case before, in this case different tribal groupings have united behind Lungu. As seen in Nsanda, Luo, Kambwili and many others too numerous to mention.
I don’t see it as a tribal issue. Rather, it was a democratic issue. Lungu’s morals are rotten and decayed in that regard. He has not demonstrated to have even a single grain of ethical behavior. Otherwise, he should have allowed himself to be subjected to a democratic process. After all he claims to be the more popular candidate within PF.
There was a concerted effort for a democratic process, which Lungu evaded and trampled-over. How sad that he did so. And this is the guy you want to be president?
Lungu is the thief. He stole democracy from the election process at the convention. That should not be condoned under any circumstances. Otherwise, it will become a bad precedence within PF.

Miles Sampa is just a rented rogue being used by the cartel to sabotage Lungu’s PF for the fear of Xvier Chungu who’s in Lungu’s camp. The cartel are aware that Xvier has compiled a devasting dossier on the activities of the cartel starting from the Chiluba era to date. This information was availed to the late President Sata but due to his ill health he couldn’t act but insist he confided into Lungu and requested him to protect his Presidency which was under threat.

Any wonder that Zambia is Zambia! All of a sudden EL is a political hero just because he has the stature of PK (Paul Kagame) and happens to be slightly taller than MS (Miles Sampa)! It behooves us to learn from Dr. Watts who told Queen Elizabeth that: “Madam, the mind is the stature of man.” Going by the stature of his mind, this EL guy is no PK and a half-size pygmy relative to MS.
Zambians are analytical. In all this what they don’t want is the force behind sampa. On popularity EL is still while ahead on grounds of Sata’s trust for him. Sampa made a mistake of only restricting himself to matero, his constituency where he is the song of a day. Youth empowerment is cardinal in any form. I personally salute him. Unfortunately have only known his doings after the well cherished submarine has sailed. Truly nothing EL has to point at as his achievement. Sampa has learnt a lesson at a great cost. Someone clever can workout his ladders on sampa’s great ideas. Frankly speaking i’m blindly in support of EL, probably because been kind and good to people does not always mean one is a leader. Me too have heard that Miles was somehow implicated in Ruth murder —– Lungu was Minister of Home Affairs -and certainly has a dossier on this. Wonder why Miles has started panicking directionlessly???
Once again, politics of convenience have managed to lump unprincipled characters in one camp: Suddenly, Sampa, GBM, Scot, Meembe and Kabimba find themselves on the same side of the fence against a person they otherwise had nothing against – until he beat them at their own game! Even Kambwili has come out smelling of roses compared to the scum that is GBM! Indeed it is true that a fool and his money are soon parted!

As for those advocating for EL ask yourselves have you even got money to take your children to a good hospital? have you even got mealie meal in your home? Anybody wanting to finish sata Legacy of selfishness does’nt deserve my vote period!!
