Supreme Court Sets Monday as Judgment Day in Miles Sampa Vs Edgar Lungu case

Judgement in which Matero Member of Parliament Miles Sampa is challenging the consent judgement by the Lusaka High Court that declared Edgar Lungu the duly elected President of the Patriotic Front has been reserved for Monday 15th December.

Acting Chief Justice Lombe Chibesakunda sitting with the full bench of the Supreme Court heard heads of argument from both sides in a matter that has sharply divided the ruling Patriotic Front.

The full bench of the Supreme Court heard Miles Sampa’s application where he is seeking that he be joined and be allowed to contest the Consent Judgement that was delivered in the High court.

In the High Court judgement, Edgar Lungu was declared PF President and Presidential Candidate after PF Secretary General, Davies Chama and PF Chairperson Inonge Wina settled the case.

The Supreme Court refused to hear another appeal where Miles Sampa wanted the candidature of Edgar Lungu determined or barred until his application regarding the Consent Judgement was heard.

The Supreme guided that their Judgement of the earlier matter will determine the other case and its outcome.

Edgar Lungu’s lawyers argued that Miles Sampa cannot be joined to the Consent Judgement to allow him to contest its legality as he was elected from an illegal gathering that was barred by the Courts of Law.

The lawyers contended that any outcome of an illegal process barred by an injunction cannot be legal.

But Sampa’s lawyers contended that the General Conference that elected him was valid and legal as they were not aware about the Court Injunction.

The Supreme Court will on Monday rule whether Sampa can be joined or be allowed to contest the Consent Judgement issued by Judge Mulenga.

In the event that the Supreme Court allows Sampa to be joined to the Consent Judgement, he will issue originating summons before the High Court and the process will start afresh.

    • This is another technical knock out to Sampa and the team. Which means the case will not be resolved until after the nominations day.

    • Is this a case of bad reporting or did Miles Sampa’s powerful team use the argument of ” We were not aware of the Injuction”. Come on your presiding office is on record to have said he got the injuction and saw the messanger beaten. Further he is also on record to have refused to declare you a winner.

      If what is reported is true, then Miles and Cartel, this is a non starter, just Register a Party this afternoon and kick start your campaign with a mamoth rally in Matero this weekend Saturday or even better still on Sunday to spoile Edgar Lungu’s Mandevu rally.

    • While the PF boat is fast sinking, HH is making in roads in PF territory and attracting over 90% attendance in small towns.

      Zambian eye opinion poll places HH ahead of lungu, with 57.7% and 32% respectively. HH has a slight lead of 20% over Lungu.

      Caution must be exercised though, because the exact period over which poll was conducted is unknown.

    • I will be not be surprised if the supreme court rules in favour of Sampa to prolong the case so that it drags on the basis that, who was the legitimate authority after the suspendee suspended the suspender just before the conference?

      How ever, my prognosis is that Sampa ‘s case will be thrown out for final time and then the whole team indicted for contempt of court, because, their returning officer-Kaulungombe was aware of the injunction and despite the injunction Scott told him to ignore it.

      Monday ‘s ruling will be a decisive moment for the sinking PF (ZANU-PF). The ruling will either, build or split the party for F00ls.

      What ever the outcome, HH and UPND will gain tremendously from the PF- tower of babel.

    A latest opinion poll indicates that opposition UPND candidate Hakainde Hichilema (HH) would win the presidency if elections were conducted today, relegating the ruling PF’s Edgar Lungu into second place by more than 20 percentage points.
    The poll, which ran on Zambian Eye’s Facebook page, involved candidates from six major political parties that have confirmed participation in the January 20, 2015 presidential election.

    • Please state the Opinion Poll. The biggest weakness of the HH camp is this notion of assuming victory because it arrives. There is a very high chance that Lungu will emerge victorious, PF support is very rampant in the Copperbelt, Northern, Luapula Provinces. Just remember, PF has nearly 100% MP representation in these provinces. HH can win, that is just a possibility. Be objective.

      I stated the same thing in one post. I mentioned that Copperbelt is a problem for HH. If he is to get the C.B vote, an alliance would be the best for now. After 2016, he will not need an alliance because people will have trusted him and he will ride on his own popularity. An alliance with a party like MMD will get him the majority of Eastern and C.B votes, combined with Southern province which he wholly owns, he will definitely win no doubt at all. HH can sway the North-Western vote with no problem.The problem is that when you suggest something as sensible as this which all UPND supporters know is very true, they are on your @** with insults left right and centre.

  3. It seems judges and lawyers went to different schools with different education curriculums altogether…why all these conflicting statements and judgments?

    The fact before the courts of law is that everyone at “2nd conference “saw the court injunction as confessed by their returning officer and the respective response he got from Guy Scoty that ‘ DO WHAT IS RIGHT” that was around 15 hours.

UPND is a party with no dissent within its ranks. Really? Don’t we have some of their MPs supporting PF as deputy ministers? Every party has its problems. But there is also the argument that the first general conference was characterized with violence and made it impossible for other legitimate delegates ( Sampa’s supporters) to attend the meeting. Further, there were also allegations that some delegates in the first conference were not legitimate . If there is some truth in these arguments, then the outcome of the first conference will also be deemed illegal. Of course the court may ask the Matero team to prove these claims beyond reasonable doubt.

      Firstly, the ruling of Contempt for running the parallel hearing cannot be overcome. Your allegations cannot be taken into account.

      Scott, Sampa et al on receipt or hearing of the ruling decided to ignore it RATHER than run to the court to challenge it. What they are actually trying to do now is ANSWER the Injunction after BREACHING it.

      There is NO WAY Sampa’s win can be taken into consideration because likewise, other contestants, Kambwili, Lubinda withdrew because of irregularities and failure to form a quorum.

      Even if the Supreme Court somehow make a ruling against The1st convention, it will mean PF have NO recognisable candidate AND will have to go back to convention. DOUBT the Court would find that REASONABLE. Sampa must lose.

      Scott and the others were first invited to attend by Inonge Wina, who correctly met with Scott to raise concers of Health and Safety conditions for the convention attendees. Regardless of Health and Safety conditions Scott et al decided to act unreasonably and stay away.

      Even the insistence of holding the Convention under some false adherence to PF Constitution (which the court will note has irregularities and interpretations can differ); was UNREASONABLE. The convention was not necessary because IT WAS TOO LATE TO RUN A VERIFICATION OF CONVENTION attendees. It was UNREASONABLE to make that process during the convention. It caused confusion.

      REASONABLENESS is a legal balance check in Court Rulings. Sampa’s case is NOT reasonable.

  17. I wish the Supreme Court had not dragged this one out, but I trust our Judiciary.

    I think they want to make Sampa feel he has been heard, (full bench)…but they must deliver a knockout on Monday. This matter needs to end.

    PF cannot go back to the drawing board, to a new convention which is the only way it can be, consider cost etc…. It is also not advisable, potentially, Violence will be the outcome of this. The Judiciary in Zambia does seem to drag its feet, why prolong these matters?

    On balance, allowing Sampa the claim is damaging to the Judiciary’s image and on how they are perceived by the public and public confidence.

    Everyone in Zambia and beyond knew there was an injunction on that parallel convention, the veracity, of Sampa’s claim is questionable.

  20. How can Edgar deliver on President Sata’s vision if he can not even deliver a simple speech to a church gathering or a simple speech to his followers at a rally? I really wonder whether some Zambians still have brains! They can follow anything for anything. These are lost souls and they need both spiritual and political deliverance. Give the presidency to Miles Sampa. At least he seems quite more organized than EL. What will happen after 20th Jan 2015 when you hear that EL has lost? For him, he will just go to Chawama and drink his head off. What about the PF party?   25. This is what is going to happen. Lungu won’t be qualified to stand on PF ticket so will Sampa. If I had my way to advice the Sampa and Nevers’ camps, as I have said before, the most effective way is to work with Nawakwi as well as Nevers Mumber ‘NEVER’ and come up with a unity and formidable party to prove to the privatisation con and Kanitundila that you are a force to reckon with.

      It’s the irony of extremism. The Tea Party are, as we speak, a necessary evil within the U.S.’s Republican Party. Similarly, the Communist Party was a necessary evil within the ANC of S. Africa. Within the MMD, Dr. Nevers Mumba can be seen as having been less accommodating of, perceptively, divergent views. It has cost him dearly.

      At the time that unfortunate statement was issued, HH was not even an insider within the UPND party. As a matter of fact, he has largely been seen as the lone passenger of the train that you now suggest he should have “condemned” soon after alighting from it. That would have been unwise and an ugly spit in the face. It happens to be merely a trivia, a necessary evil that a leader, at times, is compelled to live with.

      Even the insistence of holding the Convention under some false adherence to PF Constitution (which the court will note has irregularities and interpretations can differ); was UNREASONABLE. The convention was not necessary because IT WAS TOO LATE TO RUN A VERIFICATION OF CONVENTION attendees. It was UNREASONABLE to make that process during the convention. It caused confusion.

      REASONABLENESS is a legal balance check in Court Rulings. Sampa’s case is NOT reasonable.

    • And with all other cases involving elements of Sampa’s case; Duplicity is a problem. A large margin of error can lead to years and years of appeal after appeal, not reasonable. For the ruling to make sense it must seek to address the problem at hand. Who goes to the polls? The deadline is 19, 20 December. Is it reasonable to declare both candidates illegal AND go back to Selection process, bearing in mind the broken relationships in the party it could very well lead to violence spreading to marr the elections.

      A common sense approach is the best. Leave well what is current and Sampa et al must face Contempt charges.

      Hon. Inonge put a stop to Scott’s unreasonable conduct in the last months. He really cut his nose to spite his face by his behaviour. Tripped himself.

    How would you have felt had Barack Obama been censored by the American public because of Reverent Jeremiah Wright’s scathing racial ranting? Fortunately, the Americans were smart enough to know and realize that Reverend Wright was not Barack Obama and Barack Obama was not Reverend Wright. Similarly, HH should not be made to pay for somebody else’s sins.

    • @Mei Matungu, and you don’t remember Barack Obama rebuking and distancing himself from Jeremiah Wright’s remarks? Which, ironically, HH has failed or conveniently ignored to do over the declaration “ONLY A TONGO CAN BE UPND PRESIDENT”! Is this because he has benefited from such NAKED TRIBALISM?

      And this is the same guy who blurted some more TRIBAL NONSENSE during by-elections in Katuba when he was campaigning for his bantu botatwe cousin, Shikafuswa. Remember that?

      I can only hope in his heart of hearts during his quiet-hour-of-reflection he has seen the danger and fallibility of TRIBAL POLITICS and UNNECESSARY TRIBAL ANTAGONISM. He is now campaigning in Northern, Muchinga, etc; I hope he sees how other tribes behave—Bembas have no “beef” with anybody!

      You are right except you missed the context of what I said. Barack Obama distancing himself from the remarks by Rev. Jeremiah Wright was not the benchmark. Racism was the benchmark. Despite the presence of racism in America, white people still voted for Barack Obama, a black man. Rev. Wright’s racial remarks were trivia.

      Similarly in Zambia, the benchmark is not a Tribal remark by a Tonga crack head. The benchmark is tribalism. Everyone knows that Bembas are tribal. In spite of that, however, people in other provinces do vote for Bemba presidential candidates. They have not used that benchmark – Bemba tribalism against a Bemba presidential candidate. And yet, Bembas are the first ones to protest against Tonga tribalism and use it against HH. !!!

      Since 1964, I do not recall an election when Bembas voted for a non-Bemba. And yet Bemba candidates have been receiving votes from other provinces. The idea of Bembas not voting for a non-Bemba, should come to an end. When the late Sata realized that he could not make it to State House purely on the Bemba vote alone, he trotted the whole country. People from non-Bemba territories voted for him. Those people did so, despite their knowledge that Bemba tribalism was real.

      To hide behind the tribal remark that the Tonga crack head made, is simply a poor excuse. Bembas need to demonstrate that they too can afford to vote for a non-Bemba even when there is a Bemba candidate on the ballot paper. That’s what “ONE ZAMBIA ONE NATION” means. Zambia has 73 tribes.

      Your rationale and that of GRAND above is that you would rather not vote for HH, because as far as you are concerned, he is tribal. But Chiluba was also tribal, so was Mwanawasa and RB as well as Sata who became the chief tribalistic of all. You happily voted for each of these without exception, didn’t you? At least you never criticized them. But you would rather not vote for HH “because he is tribal.” That doesn’t make sense.

      We all may be tribal by nature. If HH is tribal at all, which I doubt, he still would not be the exception. I see him as a Zambian genuinely interested in doing something for his country. Remember the old adage: “He who asks for the riddle has become a riddle himself.” It’s you and GRAND above who are sounding tribal, not HH.

  33. Sampa et al on receipt or hearing of the injunction decided to ignore it rather than challenge it. Though they had issues with the first convention, they should have challenged the court ruling. Dura lex sed lex– the law is hard, but it is the law. Although it can be argued that in the first convention there were allegations of violence, the court deals with facts and not allegations. De minimis non curat lex —- the law does not concern itself with trifles.Sampa and others needed to deal with that injunction before going ahead with the second conference. Sampa’s case is further damaged by the confession of the returning officer that he saw the court order and decided to go ahead despite the illegality. Further a quorum was not formed.
