Nevers Mumba case against decision to adopt RB adjourned

The Supreme Court has adjourned the case in which MMD President Nevers Mumba is contesting the decision by Muhabi Lungu and the MMD NEC to adopt Rupiah Banda as its Presidential candidate for the 20th January 2015 Presidential by election.

Acting Chief Justice Lombe Chibesakunda sitting together 6 other Justices adjourned the matter to Tuesday, 16th December,2014 at 11.30hrs.

Last week the Lusaka High Court ruled in favour of Muhabi Lungu in the case where embattled party President Nevers Mumba challenged his suspension by the NEC.High Court Judge Chalwe Mchenga ruled that Dr Mumba should have set out in definite terms what Mr Lungu should be precluded from doing during the period of the injunction.Dr Mumba had sued Mr Lungu in his capacity as National Secretary and asked the court to restrain him from interfering with the running of the office and functions of the party President.

Electoral Commission of Zambia Chairperson Irene Mambilima last week disclosed that the Commission has  extended the nomination days to run from 17th to 20th December 2014 to accommodate the number of aspiring candidates which has so far exceeded ten.She advised political parties facing internal wrangles to resolve them as soon as possible as the Commission will not extend the date of nominations.

    • Ba nevers mumba what happened to victory ministries. pastors are ment to preach and not be part of politics which involves lying, stealing, racketeering, etc

    • Confusion still the order of the day in both MMD and PF.

      UPND tili ziiiiiiiiii. just busy mobilising voters. Today, Mansa, then next Chilanga, Chongwe and kafue. Next Eastern province followed by Copperbelt then Western province , North western province, Then Southern province- Monze , mazabuka, Namwala, Itezi itezi. Then back to Lubebemba land .

      FlightHH 2015, wants to visit smaller towns and villages in Eastern Western ,North western province just like we have done in Northern, Luapula and Muchinga provinces to assure voters that HH is the man to correct the mistakes made by PF.

      HH is more than ready for a presidential debate, is Lungu and others ready?

      Tithe is difficult to come by nowadays in these tricky economic circumstances. So Mumba can not survive in church because there is too much competition.

      Mumba is a specialist at selling faith and hope not ingenious products of knowledge and entrepreneurship like HH.

    • LT is biased somehow. The case of Edgar Vs Miles will be heard at 14.30hrs where the one who was elected by raising up the hand as if it is in grade one will have to kiss the ground.

    • We all know that legal technicalities as opposed to facts influenced the outcome of this case at the high court. Judges in higher courts are duty-bound to look beyond what is layed on an application.

      More so in a case as sensitive as this with its abundant evidence of underhand practices of the defendant Muhabi and his other hate-driven practioners in Kaingu, Mulusa and Siliya(Rupiah’s secret lover).

      I trust the Supreme Court will reign supreme in looking at all facts that triggered this impasse in the first place. Make fair ruling and expose the wrong-doing that led to Rupiah’s Banda’s shameless daylight coup d’etat. Fingers crossed!

    • Supreme Court must look at evidence for this case seriously.Making a wrong ruling will have far reaching negative views on the future of political parties.

      It will also send a message to greedy polticians of Rupiah’s ilk.
      1.That it was ok to wrestle power from legitimately elected leaders provided a few people existed to help push the ill-conceived agenda.

      2. That it was ok to turn up on Election Day and claim to be on ballot paper without a record of contribution to the party for years.

      3. That it was ok to come out of retirement and make a claim to leadership position even if one already existed.

      4. That it was ok to wake up from a slumber and be party president without applying for it or be elected.

      Rupiah’s ways must be rejected with contempt they deserve.

The Supreme court should not have wasted peoples time by adjourning the case when they had the whole weekend to tie loose ends.Knowing the Zambian justice System the Supreme court will also throw out this case citing the same reasons the high court threw out the case.I hope Dr.Mumba’s lawyers changed the wording of their appeal.

    • dumb & dumber! they are both going nowhere but are making sure they drive last few nails in the MMD coffin. Chiluba will be turning in his grave. Even VJ abandoned the party he new how to pull strings together to make it success. It seems the strings cannot be pulled any more as they are at breaking point!

  2. Mumba is definitely losing the case especially that time is not with him and his supporters. He should just walk away and leave the game to crooks. He has been struggling with MMD from the time he was elected president and to be treated like that, he should just give up because even if RB loses the election MMD manipulators will not entertain him.

    • Would be interesting to see what happens to MMD after Jan 20. If RB loses do they expect Mumba to remain president or do they call for another convention?
      On the flip side I wonder how much integrity Mumba has – will he agree to remain as party president despite the blatant disrespect?

      I hope they thought beyond immediate gratification.

    I cannot even consider voting for a party led by a weasel like this one! I’m sure a lot of people are put off MMD since RB did the dirty to Nevers.

  5. Presidency is not for life. These leaders should know when to call it a day. We need strong party structures which will produce leaders not political parties. Mumba gate crushed the MMD and should be ashamed of himself trying to destroy it the same way he destroyed his ministry and political party. What realistic chances does he really think he has when he failed to make an impact opposing the rampant PF. Mumba was secretly chewing with the PF whilst HH was a constant target for PF violence machine. He has vowed not to go quietly but should also take part responsibility for bringing the party in to disrepute. Let him tell the people what deals he was negotiating with RB in the initial meetings and then tell us what went wrong.

    • You are posting nonsense. Mumba was democratically elected, unlike that nincompoop Nyama Soya. No back door entry to the nomination.

  6. Mumba is nervous about the outcome of this case tomorrow. My political advise to Mumba is that please walk away and support either HH or Lungu. Even if Mumba stands under MMD he will not win. But he can blocker a deal with the potential winner (HH or EL) that can ensure his political survival and that of his key supportors. MMD be it RB or Mumba will come third in any case.

    To me this reads like Nevers is challenging Muhabi Lungu about his freedom to run the office of MMD president and not the candidacy. Now what has this got to do with the candidacy of RB? Does this amount to a challenge to RB? Or am I missing a legal point? If not, what do we expect the Supreme Court to say tomorrow?

  9. Am glad that the lawyers defending RB and MLungu hard a time explaining to the judges what should be done, there looked confused, nevers is winning this case
